Melk Fest wat vir die eerste keer in Klerksdorp aangebied is, het derduisende mense gelok om na van die land se top Afrikaanse kunstenaars te kom luister. Die fees het op Vrydag 25 November afgeskop en sangers soos Francois van Coke, Van Pletzen en Droomsindroom het die skare mal gehad. Die elektroniese dans- musikant Synth Peter het tot kort na middernag nog musiek ge- maak. Slegte weer en stormsterk winde het genoodsaak dat die fees op Saterdag 26 November kort na 18:00 gestaak word om veilig- heidsredes. Diegene wat egter al van vroeg af die fees bygewoon het, was vol lof vir die fees. Klerksdorp Midweek het verneem dat daar beslis weer ‘n Melk Fest in Klerksdorp sal plaasvind.

Pieta Myburg het die foto’s van die aantog van ‘n verwoestende storm op Saterdag 26 Novem-ber geneem. Hy het dit om 18:12 in Meiringspark geneem met sy Samsung Galaxy S21 Ultra selfoon. Stormsterk winde, reën en ligte hael het oor Klerksdorp uitgesak en die Melk Fest wat in volle swang was in sy spore gestuit. Feesgangers het skuiling gesoek terwyl die winde verskeie tente uit die grond geruk het. Geen beserings of skade is aangemeld nie behalwe van die tente wat geskeur het, het Bart Havenga, een van die organiseerders gesê. Die polisie- en rampbestuurspanne wat by die fees was het die besluit geneem om ter wille van almal se veiligheid die fees te staak.

Klerksdorp Midweek, Klerksdorp - The Hawks’ persistence to arrest the Temporary Employer/ Employee Relief Scheme funds fraudsters led to the arrest of a total of 16 suspects in the early hours of Sunday No- vember 27.
According to W/O Bonnie Nxumalo, police spokesperson, the suspects aged between 23 and 57 were arrested in Gauteng and North
West during an operation by a team compri- sing of Hawks’ Serious Commercial Crime Investigation (SCCI) based in North West, Hawks’ Tactical Operations Management Section (TOMS) and Hawks’ Priority Crime Specialised Investigation (PCSI) assisted by the office of the Director of Public Prosecu- tions (DPP).
“In 2020 during the Covid-19 pandemic,
three sole directors of different dormant en- tities applied for TERS funds from the De- partment of Employment and Labour for 47, 133 and 141 supposed employees.
The department paid the funds to compa- nies’ bank accounts.
The funds were allegedly transferred to certain individuals for personal enrich- ment.
The department suffered a total loss of more than R1.4 million due to these siphon- ing activities.
The Hawks investigated the matters and warrants of arrests were issued.”
The suspects were scheduled to appear in the Mahikeng District Court on Tues- day November 28, facing charges of fraud.

“For many, many people, I’m a firm believer that 60 is the new 50.” (Carolyn Aldwin, director of Oregon State University’s Centre for Healthy Aging Research).
As even the youngest boomers (the generation born be- tween 1946 and 1964) approach the “Big Sixty”, an increasing number of employees will be thinking about whether or not they want to retire. And an increasing number of employers will be wondering whether to ask them to stay on or to retire them (and if so, when).

Bear in mind that the law does not recognise any con- cept of a general “normal/standard retirement age” and that you need to tread carefully here because a dismissal is automatically unfair if the reason for the dismissal is that the employer unfairly discriminates against an em- ployee, directly or indirectly, on any arbitrary ground such as age.
The courts look upon automatically unfair dismissals with particular disfavour, and a guilty employer can ex- pect harsh penalties. When is age-related dismissal fair?
As an employer you can avoid a finding of automati- cally unfair dismissal if you prove -
That there is a clause in your employment contract specifying an agreed retirement date, or
That there is a “normal or agreed retirement age” for employees “employed in the capacity of the employee concerned”, and
That the dismissal is based on age and not, for ex- ample, a disguised retrenchment or dismissal for some other reason.
What if your employee wants to stay on after retire- ment date?
“Sixty really is the new fifty” says at least one recent scientific study, and it certainly is the case that many employees want to carry on working long after 60 or 65.
Sometimes economic necessity is the motivation, some- times a need to carry on being useful, sometimes just a reluctance to “retire and go fishing”.
Equally, many employers are reluctant to lose the ex- perience, loyalty and talent of senior staff and will hap- pily accept a request to stay on.
However, a recent Labour Appeal Court case confirms the need for all concerned to tread carefully in such a
employer told him that his services would now terminate as he had reached the agreed retirement age. He disputed this as an automatically unfair dismissal, arguing in the Labour Appeal Court that a new employment contract or “tacit” (implied) contract had come into effect, and that this contract extended his employment indefinitely or at least to 65. “Alternatively, he said, his employer had waived (relinquished) the retirement clause. The Court disagreed, holding that the employment con- tract and its agreed retirement date had continued un- interrupted, with both employer and employee having a right to terminate employment at any time thereafter.“
Per the Court: “The focus is not so much on when the employee reached his or her retirement date, but rather that the employee has already reached or passed the nor- mal or agreed retirement age.” There was also nothing in the conduct of the parties to suggest they had entered into a new tacit contract or that the employer had waived its rights. The employee’s enforced retirement stands.
AN ACTION LIST FOR EMPLOYERS
Avoid a situation where your employee can no long- er do the job but there is no agreed retirement date. That would leave you trying to prove a valid ground for dis- missal - incapacity or incompetence perhaps. Not easily done, and traumatic for you both.
Moreover, it’s not always easy to prove what a
“normal” or “standard practice” retirement age is for your industry and circumstances. Much safer to have a specific retirement clause in all your employment con- tracts.
Don’t try to unilaterally impose retirement clauses on employees if their existing contracts don’t already have them - this is a matter for negotiation and agree- ment.
Diarise each employee’s retirement date and before that date rolls around, either make it clear to the employ- ee that their employment is about to end automatically or put in place a new employment contract.

If you work beyond an agreed or normal retirement age, the harsh reality is that you are, as the Labour Court has put it before “working on borrowed time”.

Klerksdorp Midweek, Klerksdorp - After the recent incidents of the mauling and killing of children by Pit Bull Terri- ers, the Orkney and Klerksdorp animal shelters are struggling to keep up with all queries and concerns from the public.
People are also surrendering their Pit Bulls to the shelters, said Renée Strick- land of the Orkney and Klerksdorp animal shelter.
She said there is a lot of misconception about the dog breed. “The American Pit
Bull Terrier is not all bad and not all pit bulls are killers. It depends a lot on how they were bred, raised, and treated by their owners. Keeping them chained up in a small yard without enough stimu- lation is absolutely not advisable as it causes great frustration and aggression within these dogs.’’
She described the dogs as fearless, powerful, and intelligent and said they are highly protective of their owners and property but with the right handling, they
can be loyal, courageous and energetic companions.
It is best not to acquire a Pit Bull if you have small children or are frail yourself as these dogs can be quite wilful and difficult to handle. They suit singles and owners who love the outdoors as they have abundant energy and need lots of exercise.
“We recommend going for dog training from early on with a reputable trainer that won’t use forceful methods in train-
ing. It is vital to socialise them from a young age, both with other dogs and people,’’ said Renée.
Responsible owners should have their dogs sterilised and properly cared for. A secure yard with high walls or strong fencing is essential. As a pet, it is best not to keep more than one dog as they have a strong pack mentality.
Unfortunately, many Pit Bulls are bred specifically for dog fighting, and the shelter would like to see this banned outright;
but stricter enforcement of regulations would also help.
Over the years, and since ta- king over the Klerksdorp SPCA premises, the animal shelter implemented strict rules for the adoption of all the power breeds, especially Pit Bulls especially. “We attract a lot
of bad criticism from individuals when turning them down for adoption, but since these new concerns have arisen, I hope that the community can now un- derstand why we must apply these rules in the first place. We are just trying to protect the public and to keep these dogs safe from harm,’’ she said.
The animal shelters don’t have the man- power or funding to investigate every complaint or concern they receive.
“When contacting us for assistance, we must ask if you are sure of your facts and, if at all possible, to supply photographs to illustrate the problem, like cruelty towards the animal(s) and inadequate fencing, etc. so that we can investigate further and issue warnings where necessary.
“A complaint just because your neigh- bour has a Pit Bull does not warrant a call unless there is a genuine concern.’’
Due to the current circumstances, all Pit Bulls that are being surrendered to the shelter will not be re-homed for at least the next three to six months or until further clarity. Owners surrendering their dogs must understand and accept that their dogs will become the property of the Shelter.

Klerksdorp Midweek , Klerksdorp - November is Diabetes Awareness Month, a time to shine a light on the oral health implications of an escalating epidemic that affects one in 11 South Africans.
In addition to the many health con- cerns that come hand in hand with dia- betes, there is also a well-established two-way relationship between diabetes and oral health. Diabetes puts you at a higher risk of bleeding gums, cavities, gum disease and bad breath. People with diabetes can also tend to have a lower resistance to infection, and heal more slowly, which can also further exa- cerbate gum problems.
One of the reasons for the oral health issues facing people with diabetes is dry mouth - when the body produces too lit- tle saliva.
An estimated 42% of people with dia- betes experience dry mouth (medically known as xerostomia).
Saliva is the body’s way of keeping the mouth clean. Plaque and bacteria build up more quickly without saliva to wash
them away, making bad breath, gum disease and dental decay more likely.
Dry mouth isn’t usually alleviated by simply drinking more water. It can have a major impact on quality of life.
Swallowing and talking can be more difficult. In severe cases, dry mouth suf- ferers can even become malnourished.
Dirna Grobbelaar, Ivohealth’s oral hy- giene expert, says the symptoms of dry mouth include thirst, a burning sen- sation on the tongue, dry, cracked lips - especially the corners of the mouth - bad breath and impaired taste.
She recommends avoiding caffeinated or sugary foods and drinks.
“Rehydrating the mouth is the num- ber one priority. Drink water frequently for temporary relief. Chewing gum can stimulate saliva flow. Use hydrating products like GUM Hydral Dry Mouth Relief gel or spray, which lubricate oral tissues, soothe irritation and create a protective coating in the mouth, giving longer-lasting relief.
”Smoking is a big no-no if you suffer from dry mouth. And the same goes for
alcoholic drinks, as they also cause de- hydration.”
Meticulous oral care is essential: “Ex- tra special attention should be given to your oral care routine, because of the high risk of cavities and gum disease,”
says Grobbelaar.
“Brush teeth properly at least twice a day, using a soft toothbrush and fluo- ride toothpaste. Clean in-between teeth daily, using floss or an interdental tool. Then rinse with an alcohol-free mouthwash.”
Regular visits to the dentist and effec- tive oral care will help you live healthier with diabetes. Once you are diagnosed, schedule a dental appointment right away. Let them know about your diag- nosis and continue to go for regular check-ups which enable your dental team to detect any problems early.
A professional cleaning done by the oral hygienist at least every six months is recommended. This will help keep your mouth in tip-top shape, removing plaque and tartar (hardened plaque) that can’t be removed by brushing at home.

Orange belts
Klerksdorp Midweek, Klerksdorp – Runners are pre- paring for the three top marathons in the area for 2023.
Pre-entries are open for the Ottosdal Draf en Trap on January 28. Pre-entries close on January 14.
Pre-entries are also open for the prestigious Klerksdorp Marathon that will take place on February 12.
The N12Ultra will take place on April 29, this year running from Klerksdorp Recreation Centre to Potchef-
stroom. Entries for this race haven’t opened yet.
The Klerksdorp Marathon will start and finish at Hoër- skool Wesvalia and pre-entries close on February 5.
The local marathon club is organising the official ASA event.
Free T-shirts to the first 200 runners and medals to all finishers. It is an official qualifier for the Two Oceans and Comrades.

Klerksdorp Midweek , Klerksdorp - Tic- kets sales for the first-ever FIH Indoor Hockey World Cup in South Africa, pre- sented by SPAR, are open to the public.
In the sixth edition of the tournament, and the first to be held outside of Europe, hockey fans will be able to see the world’s 12 best women’s and men’s teams in action at the Heartfelt Arena in Pretoria from Fe- bruary 5 to 11 next year.
South Africa and Namibia will represent the African continent, joining such power- houses as Australia, the Netherlands and Switzerland, all of whom will be challeng- ing defending champions Austria (men) and Germany (women) for Cup glory.

Local organising committee chair- man Simon Martin
said the growth of the sport in South Africa would ensure plenty of interest in this fast- paced and exciting version of hockey.
“For over 20 years our country has driven the growth of indoor hockey on the conti- nent,” Martin said.
“We have focused on the grassroots level to develop a strong interest and culture in the game and now the time has arrived to host the biggest and most prestigious tour- nament in indoor hockey.
“Having the chance to host a tournament of this magnitude on home soil is a once in a lifetime opportunity and we are working hard to ensure we make it an incredible experience for spectators and players, and, most importantly, to leave a legacy for future generations.”

The men’s and women’s competitions will each be contested by 12 teams, divided into two pools.
The teams will play one pool match each day from February 5 to 9.
Thereafter the top four sides in each pool advance to the quarterfinals, while the fifth and sixth-placed teams will face off for positions nine to 12.
