NOTICE OF APPLICATION
TAKE NOTICE THAT the Applicant applies to this Court for an order-
1.1 Granting the NDPP leave to appeal to the Constitutional Court against the judgment and order of the full bench of the South Gauteng High Court in the case of NDPP v Meir Elran
1.2 Upholding the appeal with costs, including the costs of two counsel;
, under case number A5050/10, which judgment was handed down on 8 March 2012;
2 1.3 Setting aside the order of the full bench of the South Gauteng High Court and
replacing it with the following order-
1.3.1 The NDPP’s appeal is upheld;
1.3.2 The application by Meir Elran under case number SGHC 4577/06 is dismissed with costs;
1.4 Further and/or alternative relief.
TAKE NOTICE FURTHER that the affidavit of WENDY LISA DA SILVA attached to this notice of application will be used in support of the application.
TAKE NOTICE FURTHER that the Applicant has appointed the State Attorney, Johannesburg, at the address referred to below as the address at which it will accept notice and service of all process in these proceedings.
TAKE NOTICE FURTHER that if you intend opposing this application you are required to respond to the applicant’s attorney in writing within 10 (ten) days of the lodging of this application, indicating that the application is being opposed and the grounds for such opposition
TAKE NOTICE FURTHER that in the notice of intention to oppose referred to above you are required to appoint an address at which you will accept notice and service of all documents in these proceedings.
