CONFIRMATORY AFFIDAVIT
I, the undersigned,

MNCEDISI SIMON MQWATHI
do hereby make oath and state that:
1. I am the current Municipal Manager of the first respondent (‘the Moqhaka Municipality’). Kroonstad falls within its area of jurisdiction.
2. I am authorized to depose to this affidavit on the Moqhaka Municipality’s behalf.
3. I have read the answering affidavit deposed to by Mr. Zola Malvern Percival Majavu
“Mr. Majavu” as the first respondents attorney of record and confirm the contents thereto in so far as they relate to the Moqhaka Municipality and my office as the current Municipal Manager.
4. At the time of institution of the legal proceedings which have culminated to this appeal, before this Honorable Court, I was not at that stage the Municipal Manager. It is on those bases that Mr. Majavu has deposed to the answering affidavit, as he has knowledge of the matter and facts before this court, than I do.
5. I raise no objection to him deposing to the answering affidavit, and accordingly support it.
