1.3 "Contract Price" means the price payable to the Supplier under the Contract for full and proper performance of his contractual obligations. 1.12 "Force majeure" means an event beyond the Supplier's control which does not involve the Supplier's fault or negligence and cannot be foreseen. 1.15 "Goods" means all equipment, machinery and/or other materials which the Supplier is required to supply to the Buyer under the Contract.

Patent Rights 6.1 The Supplier shall indemnify the Buyer against all claims of third parties for infringement of patent, trademark or industrial design rights. Within thirty (30) days of receiving the contract award notice. bond The successful bidder must provide the purchaser with a performance bond of the amount specified in the SCC. Shipping details and/or other documents to be submitted by the supplier are specified in the SCC.

Such notice, whether in the original bid or later, shall not relieve the supplier of any liability or obligation under the contract. Unless otherwise specified in writing by the buyer, the supplier shall continue to perform its obligations under the contract to the extent reasonably practicable and shall seek all reasonable alternative means of performance which are not prevented by the force majeure event.

The site slopes gently from east to west towards the river at the western boundary of the site. Under the approved Cape Flats District Plan (SDP) (2012) of the City of Cape Town, the proposed site of the site falls within the urban fringe of the city and is designated in an Urban Development Area, Water Bodies and Flood Prone Area. The service provider is obliged to carry out specialist studies with regard to the location in order to substantiate a land development application (parcelling application).

Subject to the adoption of the rules and regulations set out in the latest Cape Town Municipal Planning By-law. The information session will be held at the DRDLR offices on 24 April 2019. An on-site biodiversity assessment should preferably be done during the late winter or early spring season when transience is evident and more species are in flower. , to allow its identification.

Flood line Map showing suitability for urban development (GIS file format) - (Development in flood-prone areas must take into account the municipality's policy on flood-prone areas). Consolidated report and map indicating any restrictions or no go areas related to specialist report findings, including a preliminary subdivision plan for the development friendly area. Engineering Geologist/Geotechnical Engineer – Appropriately qualified with a minimum of B-Diploma in Geology with verifiable experience as a registered Professional Civil Engineer with the Engineering Council of South Africa (ECSA). GIS Practitioner – relevant accredited GISc qualification or equivalent qualification approved by the South African Council of Professional and Technical Surveyors. Engineer (Flood Line Estimation) – suitably qualified with verifiable experience as a registered Professional Civil Engineer with the Engineering Council of South Africa (ECSA).

Registered Urban Planner - Minimum B Diploma in Urban and Regional Planning and professional registration with SACPLAN (South African Council for Planners);. Surveyor - minimum B Diploma in Surveying and professional registration with PLATO (South African Council for Professional and Technical Surveyors);. NB: If the team does not have all of the practitioners listed above, their bid will not be considered.

Response of methodology to the assignment in terms of paragraphs 6 and 7 (Including a detailed work breakdown structure indicating tasks, resources allocated and appropriate timeframes and accompanying detailed cost analysis). Note: Bidders will be required to score 70 points or more for functionality in order for their bid to be further evaluated.
