18. WHISTLEBLOWING SYSTEM
Sebagai bentuk komitmen Danamon untuk menerapkan tata kelola perusahaan yang baik dan memastikan praktik bisnis yang berintegritas, Danamon mengimplementasikan Whistleblowing System melalui Kebijakan Whistleblower (Surat Keputusan Direksi No. DIR-COMP-025 tanggal 07 Desember 2011).
Whistleblowing System merupakan jalur komunikasi karyawan, nasabah, vendor, agensi pihak ketiga, dan pihak-pihak lainnya dalam melaporkan kejadian- kejadian yang diduga berhubungan dengan tindakan fraud, kriminal, pelanggaran ketentuan perusahaan dan pelanggaran kode etik yang melibatkan karyawan Danamon dan/atau pihak-pihak yang mempunyai hubungan dengan Danamon. Keberadaan Whistleblowing System diharapkan dapat mendorong semua pihak untuk melaporkan pelanggaran tanpa disertai rasa takut akan menjadi korban, diskriminasi, atau mengalami kerugian.

Danamon requires all employees to incorporate the Code of Conduct. Employees are also obligated to report to their direct supervisors, Leader of Working Unit and/or respective HR division in the event of Code of Conduct violation, or attempt of violation. Further, Leaders of Working Unit is expected to socialize the Code of Conduct to other employees under his/her unit.
As part of Code of Conduct enforcement, Danamon has the Conde of Conduct Statement Letter to be signed by each employee and submitted to HR Division at the Head/Regional Office. Code of conduct is also part of performance appraisal indicators for employees, conducted every semester.
18. WHISTLEBLOWING SYSTEM
As part of the Danamon’s commitment to implement good corporate governance and ensure that its business practices are executed with integrity, Danamon established Whistleblowing System through Whistleblower Policy (Board of Directors Resolution Letter No. DIR-COMP-025 dated 07 Desember 2011). Whistleblowing System is a platform for employees, customers, vendors, third party agencies, and other parties, to report incidents that potentially pertain to fraud, criminal acts, or violations of Danamon’s regulations and code of conducts, which involve Danamon’s employees or other parties related to Danamon. Whistleblowing System is expected to encourage all parties to report the violations without fear of being victimized, discriminated, or suffer any kind of damages.

Apabila pelanggaran, atau potensi pelanggaran, dilakukan oleh anggota Dewan Komisaris atau Direksi, maka selain melalui jalur komunikasi di atas pelapor dapat pula menyampaikan laporan secara tertulis melalui surat tertutup yang ditujukan kepada Ketua Komite Audit (Komisaris Independen).
Pelapor tidak wajib menyertakan identitasnya. Namun, untuk memudahkan proses identifikasi, laporan perlu dilengkapi dengan:

Danamon is committed to provide protection to the informants. The objective of informant protection is to provide assurances, and encourage informants to report violations. Protection are provided in the following forms:

Protection applies not only for informants, but may also be extended to the family members of informantAside from the above protection, Danamon also provides legal protection in accordance to prevailing laws and regulations. Legal protection includes protection from civil and/or criminal lawsuit as well as protection for personal/family safety from physical/mental threats.
Procedure of Reporting Handling and Unit Responsible to Manage Reports
All reports are evaluated to determine follow up actions of either further investigation or escalation to relevant parties. Investigation process is conducted objectively by applying the presumption of innocence.
Investigation report is the conclusion of investigation process, and is used as basis of decision making to imposing action and/or penalty. Individuals whose violations are proven will be sanctioned in accordance to prevailing regulations and/or Danamon’s internal policy. To maintain objectivity, penalty is imposed by Fraud Committee at the Head Office and Regional levels.
Investigation report is documented monthly and reported regularly to the BoD and Audit Committee.
Result of Reporting Follow-Up
Whistleblower policy implementation is deemed effective to disclose frauds.
In 2012, there were a total of 68 frauds reported through whistleblowing channel. Following investigations, 37% (25 reports) were proven as violations and frauds.
