(1) The objective of this clause is to deliver the highest standard of architectural and urban design.
(2) This clause applies to development involving the erection of a new building or external alterations to an existing building on land identified as “Area A” on the Height of Buildings Map.
(2) This clause applies to any development, comprising residential floor space, which contains a building with a height of 25 metres or more.
(3) Development consent must not be granted for development to which this clause applies unless the consent authority considers that the development exhibits design excellence.
(4) In considering whether the development exhibits design excellence, the consent authority must have regard to the following matters:
(a) whether a high standard of architectural design, materials and detailing as established in The Hills DCP is achieved,
(b) whether the form and external appearance of the proposed development will improve the quality and amenity of the public domain,
(c) whether the building displays the desired character established in The Hills DCP,
(d) whether the building meets sustainable design principles in terms of sunlight, natural ventilation, wind, reflectivity, visual and acoustic privacy, safety and security and resources, energy and water efficiency established in The Hills DCP,
(e) whether satisfactory arrangements have been made to ensure that the proposed design is carried through to the completion of the development concerned,
(f) whether the configuration and design of communal access and communal recreational areas within the residential elements of development incorporate exemplary and innovative treatments and will promote a socially effective urban village atmosphere.
(5) Development consent must not be granted to the following development on land to which this Plan applies unless an architectural design competition that is consistent with the Design Excellence Guidelines has been held in relation to the proposed development:
(a) development in respect of a building that is, or will be, higher than 45 metres or 13 storeys (or both) in height,
(b) development having a capital value of more than $5,000,000,
(c) development for which the applicant has chosen to have such a competition.
(6) Subclause (5) does not apply if the Council certifies in writing that the development is one for which an architectural design competition is not required.
(5) In determining whether to grant consent to the development application, the consent authority is to take into account the recommendations of the Design Excellence Panel results of the architectural design competition.

REPORT
The purpose of this report is to present to Council the recommendations from the Local Traffic Committee (LTC) that was held on 21 March 2016 in Community Room 1 at Council’s offices at 3 Columbia Court, Baulkham Hills. Eleven items were reported to the Committee.
In accordance with the "RMS Delegation of Authority" and the recommendations contained within Council’s resolution of the 27th May 2014, the LTC recommendations are included in this report for consideration by Council.
IMPACTS Financial
Items 1and 2 of the Recommendations will have no financial impact on Council’s budget.
Items 4, 7, 8, 9, 10, 11 and 12 of the Recommendations will be funded from Council’s existing Signs and Linemarking budget.
Part funding for Item 3 (concrete slabs at new bus stops) and full funding for Items 5 and 6 of the Recommendations is already included in the 2015/16 Works Program.
The Hills Future - Community Strategic Plan
The operation of the Local Traffic Committee ensures that local traffic conditions are safely managed for the benefit of the local community.
RECOMMENDATION
Council adopt the recommendations of the Local Traffic Committee for 21 March 2016 as detailed in the report.

The Northwest Rapid Transit (NRT) Consortium has requested Council’s consideration and approval of proposed traffic facilities on both existing and proposed public roads around the Norwest, Bella Vista and Rouse Hill station precincts.
BACKGROUND
In 2014 the NSW State Government announced that the NRT Consortium had been selected as the preferred operator of the North West Rail Link (since renamed the Sydney Metro Northwest) project. NRT will design, build, finance and then operate the new rapid transit train service.
NRT’s responsibilities will include the construction of eight new railway stations as well as the adjoining station precincts. Six of those stations – Castle Hill, Showground, Norwest, Bella Vista, Kellyville and Rouse Hill are located within The Hills Shire.
The new station precincts will include modifications to existing roads and intersections as well as the construction of new roads, transport interchanges, cycling and pedestrian facilities. In the case of Kellyville, Bella Vista and Showground stations, commuter parking is also being constructed.
The roadworks associated with these station precincts also includes various traffic facilities including marked pedestrian crossings, regulatory and advisory signposting, and linemarking on both existing and proposed new roads. Some of these proposed new roads are to be dedicated to Council as public roads while others will be managed by

NRT on behalf of Transport for NSW (TfNSW). Any new traffic facilities on either existing or proposed local public roads must be approved by Council in accordance with its delegation from Roads and Maritime Services (RMS) to regulate traffic.
After considering a recommendation from the November 2015 meeting of the Local Traffic Committee in regard to proposed traffic facilities at the Norwest and Bella Vista station precincts, at its meeting on 15thDecember Council resolved:
“1. Council approve the position of the two marked pedestrian crossings on Precinct Street A at the Bella Vista Station precinct as per drawing number NWRLOTS-NRT- BLV-RO-DRG-450898 Rev. 02.
2. Council defer:
a) the approval of a marked pedestrian crossing on Brookhollow Avenue outside the Norwest Station as per drawing number NWRLOTS-NRT-NRW-RO-DRG-440712 Rev. A, pending the submission of a Road Safety Audit for review by RMS and Council;
b) the approval of traffic facilities, regulatory signposting and linemarking around the Norwest and Bella Vista Station precincts pending ongoing reviews by RMS and Council, and submission and approval of a Stage 3 Design.”
REPORT
In accordance with Council’s resolution of 15th December 2015, NRT has resubmitted their Stage 3 Designs for traffic facilities, regulatory signage and linemarking around the Norwest and Bella Vista Station precincts. They have also submitted a Stage 3 Design for the Rouse Hill station precinct which has not been considered previously by the Local Traffic Committee.
Norwest Station Precinct
Attachment 1 provides details of the proposed traffic facilities in Brookhollow Avenue, Norwest Boulevarde and Century Circuit around the Norwest station precinct.
As Norwest Boulevarde is a State Road, all traffic facilities associated with the proposed signalisation of its intersection with Brookhollow Avenue and Century Circuit and construction of the bus zones on either side of the road, are subject to a separate approval process by RMS in accordance with the conditions of a Works Authorisation Deed (WAD) that has been entered into between TfNSW and RMS.
NRT is now seeking Council’s final approval of the various traffic facilities, including a marked pedestrian crossing, regulatory signposting and linemarking, in Brookhollow Avenue. These traffic facilities have been reviewed and are considered acceptable.
In accordance with Council’s previous resolution, NRT engaged Beca to prepare an independent Road Safety Audit (RSA) for the entire Norwest station precinct, including Brookhollow Avenue. A copy of the RSA is attached (Attachment 2).
Bella Vista Station Precinct
Attachment 3 provides details of the proposed street pattern around the Bella Vista Station precinct.
It should be noted that:
x Precinct Streets A, B and D (East) will be public roads dedicated to Council under the provisions of the Roads Act 1993;

x Precinct Street E is not to be dedicated as public road and will be managed by NRT on behalf of TfNSW;
x Precinct Street F is a proposed public road that would be constructed in conjunction with the future development of the adjoining TfNSW owned property;
x Precinct Street C (not shown on the Attachment) linking Celebration Drive to Precinct Street A may be constructed in the future through the development site bounded by Celebration Drive and Precinct Streets A and B;
x Precinct Street D (West) is not to be dedicated as a public road at this stage and will be managed by RMS as part of the Northwest T-Way. Access to and from Precinct Street D (West) will initially be limited to buses providing a link between the T-Way and Precinct Street A pending construction of precinct Street F;
x access to Precinct Street A (between Celebration Drive and Precinct Street B) will initially be limited to buses and taxis only pending development of the large vacant parcel of land to the east and construction of a new public road linking Celebration Drive at Brighton Drive to precinct Street A (referred to as precinct Street C and not shown on Attachment 3);
x following development of the vacant parcel of land and the opening of precinct Street C, traffic will be able to turn right into Precinct Street A and head north while traffic heading east along Precinct Street A will be able to turn left into Precinct Street C.
x the location of the proposed pedestrian crossings on Precinct Street A was considered by the Local Traffic Committee in November 2015 and subsequently approved by Council at its meeting on 15thDecember 2015.
Attachment 4 provides details of the proposed traffic facilities in Celebration Drive and new Precinct Streets A, B, D (East and West), E and F. It also provides details of regulatory signage and pavement markings associated with proposed speed limits that have been the subject of a previous report to the Local Traffic Committee and subsequently endorsed by Council. A final decision on the proposed speed limits is still yet to be made by RMS which is the determining authority.
Changes to the existing traffic signals and associated traffic facilities at Celebration Drive and Old Windsor Road, as well as the new signalised intersection at Celebration Drive and Lexington Avenue, will be the subject of a separate approval process by RMS in accordance with the conditions of WADs that have been entered into between TfNSW and RMS.
The approval of traffic facilities, including a pedestrian refuge, regulatory signposting and linemarking in Precinct Streets D (West) and E are not a matter for Council.
The proposed traffic facilities including signposting and linemarking in Precinct Streets A, B and D (East) have been reviewed and are considered acceptable.
Rouse Hill Station Precinct
Attachment 5 provides details of the proposed traffic facilities in the Rouse Hill station precinct which includes:
x Southern bus layover facility (south of White Hart Drive);
x Tempus Street;
x T-way including bus interchange; and
x Northern bus layover (north of Rouse Hill Drive).
Tempus Street is not currently dedicated to Council as a public road under the provisions of the Roads Act 1993. However it will be dedicated prior to the opening of the railway in PAGE 5

accordance with the Operations Trains and Systems (OTS) Interface Agreement between Council and TfNSW. Therefore Council’s approval of any changes to traffic facilities in Tempus Street is required.
The approval of regulatory signposting and linemarking in the bus layover facilities, T- Way and bus interchange are a matter for RMS and TfNSW.
Prior to the commencement of work associated with the Sydney Metro Northwest project, a marked pedestrian crossing was located in Tempus Street, immediately south of the Main Street intersection. In conjunction with roadworks in Tempus Street undertaken by the Surface and Viaduct Civil (SVC) contractor in early 2015, this existing marked pedestrian crossing was removed and replace by two marked pedestrian crossings – one to the south of Market Lane and one about 20m north of Main Street.
The OTS contractor is proposing to maintain the first crossing in its current position and relocate the second crossing in a southerly direction closer to the Main Street intersection.
To support the proposed relocation of the most northerly pedestrian crossing in Tempus Street, NRT has prepared a Technical Note (Attachment 6) that provides details of projected pedestrian and traffic volumes as well as a formalised risk assessment using a
‘Predicted Hazard Index’ that is based on an RMS Technical Direction 2001/04b.
The proposed changes to traffic facilities including signposting and linemarking in Tempus Street have been reviewed and are considered acceptable.
IMPACTS Financial
This matter has no direct financial impact upon Council's adopted budget or forward estimates.
The Hills Future - Community Strategic Plan
The recommendation in this report will demonstrate Council’s commitment of support to the Sydney Metro Northwest Project.
RECOMMENDATION
1. Council approve the proposed traffic facilities, including marked pedestrian crossings, regulatory signposting and linemarking, on existing and proposed public roads around the Norwest, Bella Vista and Rouse Hill station precincts, as detailed in Attachments 1, 4 and 5 to the report.
2. Northwest Rapid Transit and Transport for NSW be advised that Council’s approval does not extend to traffic facilities being provided:
a) in accordance with separate Works Authorisation Deeds entered into between Transport for NSW and Roads and Maritime Services, or;
b) on proposed roads within the Bella Vista station precinct that are to be managed by Northwest Rapid Transit on behalf of Transport for NSW, or;
c) on the North West T-Way or the southern and northern bus layover facilities in the Rouse Hill station precinct.
