Part 1

DISEASE CONTROL

3. In this Part, unless the context otherwise indicates, the following term shall have the meaning set against it, that is to say:-

"Place of Entry" Brisbane (including South Brisbane Railway Station and Archerfield and Eagle Farm Aerodromes), Cairns, Townsville, Mackay, Rockhampton, Coolangatta, Killarney, Wallangarra.

4. No person shall travel or remove any poultry or fittings into, within, or out of any place which is subject to an order of quarantine by an inspector, except as hereafter provided, unless and until the quarantine has been removed by the Minister.

5. Every person desiring to move poultry and/or fittings within or out of an infected area shall make application to an inspector for a permit so to do. Such application shall contain the following particulars:-

(a) The name and place of abode of the owner of such poultry and/ or fittings;

(b) The holding on which such poultry and/ or fittings are located;

(c) The number and description of such poultry and/ or fittings;

(d) The date on which it is desired to move such poultry and/or fittings;

(e) The place to which it is desired to move such poultry and/ or fittings;

(f) The route and the means of transport by which such poultry and/ or fittings are to be moved.

If the inspector is satisfied that such a movement of poultry and/ or fittings is not likely to spread infection or disease he may grant a permit authorising such movement upon such conditions as he may impose and embody in the permit.

6. No person shall move any poultry and/or fittings within or out of an infected area-

( a) Unless he is the holder of a permit from an inspector author- ising such movement;

(b) In contravention of any condition embodied in a permit authorising such movement.

7. No person other than an inspector shall make any alteration in or addition to any permit granted by an inspector.

8. No person shall remove any animal infested with Stickfast Flea from an infected area or move any such animal so infested from any holding within an infected area.

9. Every person desiring to move any dog or cat within or out of an infected area shall make application to an inspector for a permit so to do. Such application shall contain the following particulars:-

(a) The name and place of abode of the owner of such animal;

(b) The holding on which such animal is located;

(c) The date on which it is desired to move such animal;

(d) The place to which it is desired to move such animal;

(e) The route and the means of transport by which it is desired to move such animal.

If the inspector is satisfied that such a movement is not likely to spread infection or disease he may grant a permit authorising such move- ment upon such conditions as he may impose and embody in the permit.

10. No person shall move any dog or cat within or out of an infected area-

( a) Unless he is the holder of a permit from an inspector authoris- ing such movement;

(b) In contravention of any condition embodied in a permit authoTising such movement.

11. Every owner of a holding in an infected area on which any disease affecting poultry is found by an inspector or on which any such disease has been so found within the last preceding three months shall treat all animals on such holding to the satisfaction of an inspector in such manner and for such period as the inspector shall by notice in writing direct.

12. Every owner of poultry kept on a holding in an infected area shall isolate such poultry on such holding by confining such poultry in such a manner as to prevent such poultry from straying or flying from such holding.

. 13. No poultry shall be taken into any place which is subject to an order of quarantine except for the purpose of immediate slaughter.

14. When an area is put under quarantine, so much of the surround- ing country as is considered necessary by the inspector making the quar- antine order may be declared a buffer area, and no poultry or fittings shall be removed from such area without written permission of an inspector, who shall inspect such poultry and fittings before granting such permission.

15. Every owner of a holding shall at all times keep and maintain such holding free of all rubbish and litter in, on or near the fittings on such holding by burning or otherwise destroying such rubbish and litter to the satisfaction of an inspector.

16. Any inspector may before entering upon a holding to inspect poultry give at least twenty-four hours' notice in writing to the owner of such holding requiring him to confine all poultry on such holding or such poultry thereon as the inspector may specify in such notice in such a manner as will permit such inspector readily to inspect the same.

17. All diseased poultry shall be isolated by the person in charge thereof from healthy poultry, and all infected poultry shall be treated by the person in charge thereof to the satisfaction of the inspector, or shall be placed by the person in charge thereof in quarantine for such period as an inspector may direct.

18. Every owner of infected poultry kept on a holding shall isolate such poultry on such holding by confining such poultry to the satisfaction of an inspector in such manner and for such period as the inspector shall by notice in writing direct.

19. When any poultry or fittings or any article or thing used in connection with poultry has been ordered to be destroyed, the inspector to whom the order has been directed by the Minister shall, before ordering the destruction thereof, give notice of the order to the owner thereof (if known), either personally or by letter addressed to him through the Post Office at his place of business, or, if he has no known place of business, at his last known place of abode.

20. In the event of it being considered necessary by an inspector, for the purpose of combating an outbreak of disease, to have diseased poultry destroyed, the carcasses of such poultry and all fittings or other things used in connection with such poultry, or which have been in contact with such poultry, shall be disposed of by burning or other means by the person in charge thereof, to the satisfaction of the inspector.

20A. ( 1) Where any holding placed in quarantine is infected with the disease of avian pneumoencephalitis the Chief Inspector shall give written notice that the holding is so infected to the occupier or if there is no occupier the owner either by serving him with the notice personally or by registered post.

Any occupier or owner so served with a notice who, except with the permission in writing of the Chief Inspector, shall move or send or cause or permit or allow to be moved or sent from the holding during the period the holding is placed in quarantine any poultry, animal, carcass, eggs, manure, fittings, or any other thing whereby the said disease may be spread, shall be guilty of an offence.

(2) The Minister may order the destruction or disposal of any poultry, animal, carcass, eggs, manure, fittings, or other thing in an infected area which area is infected with the disease of avian pneumoencephalitis when-

ever such destruction or disposal would tend to prevent the spread of the said disease of avian pneumoencephalitis.

Any poultry, animal, carcass, eggs, manure, fittings, or other thing so ordered to be destroyed or disposed of shall be destroyed or disposed of in such manner as the Minister directs in his order or failing such direction in such manner as the Chief Inspector directs.

Regulation 19 shall not apply in respect of any order made under this subregulation but a copy of such order shall be served either personally or by registered post upon the owner of anything ordered to be destroyed or disposed of by the Minister under this subregulation before the order is executed.

(3) The Minister may upon the recommendation of the Advisory Board make a levy upon organisations representative of or engaged in the poultry industry and in that event may cause the proceeds of such levy to be applied in paying such compensation as the Advisory Board shall recommend to owners of poultry, animals, carcasses, eggs, manure, fittings, or other things in an infected area as aforesaid destroyed or disposed of under this regulation.

Except as aforesaid no compensation shall be paid to owners of poultry, animals, carcasses, eggs, manure, fittings, or other things in an infected area as aforesaid destroyed or disposed of pursuant to an order made under this regulation.

21. Any building or fittings, or place where diseased poultry have been kept, shall be treated by the person in charge thereof, by burning, disinfecting, or otherwise, to the satisfaction of the inspector.

22. No person shall send or cause to be sent on any aeroplane, railway, road, river or ship within the territorial waters of Queensland any infected poultry, fittings, or other thing likely to cause the spread of disease from any holding or place where diseased poultry have been kept.

22A. No person who is not a stock supplier shall supply, send or forward fowl eggs for hatching to a stock supplier except with the written permission of an inspector.

23. No person shall use or render down or otherwise prepare for use for food any poultry affected with disease, or any part of such poultry, or

any blood or offal obtained from such poultry.

24. Poultry shall not be fed with meat, offal, or blood, unless such meat, offal, or blood has first been thoroughly cooked or desiccated.

25. No person shall, without previous notice in writing to an inspector, and the receipt thereafter from the inspector of a permit in writing so to do, kill or cause to be killed any infected poultry, the flesh of which is intended for sale for the food of man.

26. No person shall sell or expose for sale, or cause or permit to be exposed for sale, any infected poultry, until such person has received written permission from an inspector so to do.

27. No person shall introduce any poultry into Queensland at any place other than a place of entry.

28. No person shall introduce any fowls into Queensland unless such fowls are accompanied by a declaration and certificate in or to the effect of the form in the First Schedule hereto in the case of day-old chickens and in or to the effect of the form in the Second Schedule hereto in the case of fowls other than day-old chickens:

Provided that in the case of fowls other than day-old chickens- ( a) If snch fowls having been taken out of Queensland for

exhibition at a fowls exhibition or fowls show in another State of the Commonwealth are being reintroduced into Queensland direct from and immediately after such exhibition such fowls may be exempted from the agglutination test for pullorum disease if the person who exhibited such fowls at such exhibition or show gave notice in writing to the Under Secretary, Department of Agriculture and Stock, Brisbane, of his intention to so exhibit such fowls and gave in such notice particulars of such fowls, the dates of intended departure from and return to Queensland, the route or routes by which such fowls were to be travelled to and from such exhibition or show, the name of such exhibition or show, and the place where such exhibition or show was to be held, and thereupon obtained from the said Under Secretary a certificate of exemption from such test. Such certificate of exemption shall be produced to the Chief Veterinary Surgeon, the District Veterinary Officer, or the Inspector of Stock to whom application is made for a certificate in the form in the Second Schedule, and such Chief Veterinary Surgeon, District Veterinary Officer, or Inspector of Stock, as the case may be, shall, before he issues such certificate, strike out and initial that portion of the certificate which relates to the agglutination test for pullorum disease and endorse the certificate "Special Exemption. Exhibited fowls only."

(b) If such fowls are being introduced into Queensland from another State of the Commonwealth solely for the purpose of exhibition at a fowls exhibition or fowls show in Queensland, such fowls may be exempted from the agglutination test for pullorum disease, provided that such fowls are to be returned to such State direct from and immediately after such exhibition.

In the event of such fowls being exempted from such test the Chief Veterinary Surgeon, the District Veterinary Officer, or the Inspector of Stock, to whom application is made for a certificate in the form in the Second Schedule shall, before he issues such certificate, strike out and initial that portion of the certificate which relates to the agglutination test for pullorum disease and endorse the certificate "Special exemption.

Exhibited fowls only."

(c) If such fowls are being introduced into Queensland from New South Wales solely for the purpose of slaughter, such fowls may be exempted from the agglutination test for pullorum disease. In the event of such fowls being exempted from such test the Chief Veterinary Surgeon, the District Veterinary Officer, or the Inspector of Stock to whom the application is made for a certificate in the form in the Second Schedule shall, before he issues such certificate, strike out and initial that portion of the certificate which relates to the agglutination test for pullorum disease and endorse the certificate, "Special Exemption-Fowls for Slaughter only."

28A. No person shall introduce fowl eggs for hatching into Queensland unless such eggs are accompanied by a declaration and certificate in or to the effect of the form in the Eighth Schedule hereto.

28B. No person shall introduce ducks, turkeys, geese, guinea fowl, or pigeons into Queensland unless such ducks, turkeys, geese, guinea fowl, or pigeons, as the case may be, are accompanied by a declaration and certificate in or to the effect of the form in the Ninth Schedule hereto.

29. All poultry which are to be introduced into Queensland shall be examined by an inspector at a place of entry, and upon such inspector being satisfied that such poultry are not infected poultry he shall permit such poultry to be so introduced.

30. If an inspector is doubtful whether any poultry introduced by sea are or are not infected, he may temporarily detain them on board ship and cause them to be treated to his satisfaction, or may cause them to be removed to some other ship or to some safe place, at the risk and expense of the owner, there to be quarantined and treated to the satisfaction of the inspector.

31. No carcass of, or fitting or other matter or thing used in connection with, introduced poultry which arrive by ship and which are infected poultry, shall be removed by any person from the ship in which it arrives, except by the written permission and under the supervision of an inspector, and then only to a place to be named by the inspector, there to be dealt with or disposed of as the inspector directs.

32. Every person shall, not less than four nor more than fourteen days, before he introduces any poultry into Queensland, give notice in writing of the proposed introduction of such poultry to the Under Secretary, Department of Agriculture and Stock, Brisbane. He shall set out in such notice the manner in which such poultry are to be introduced, whether by road, railway, sea, or air, and the proposed place of entry.

33. Any inspector may at any time inspect any poultry on any run, holding, saleroom, road, or place.

34. Where an inspector is of opinion that any poultry are infested with poultry lice, poultry ticks, or stickfast fleas he may serve on the owner or person in charge of such poultry a notice in the form of the Third Schedule hereto, requiring him to dip such poultry within the period specified in such notice. Thereupon such poultry shall be dipped by the owner or person in charge in accordance with such notice.

35. The dip shall be a dip approved by the inspector. In any case where the inspector is not satisfied with the dip, he may order such alteration to be effected as he may consider necessary, and such alterations shall be made forthwith.

36. The preparation to be used for the dipping of the poultry shall be one of the recognised proprietary dips to be used of a strength of 1 to 200 parts water, or such other preparation as may be directed by the inspector.

37. The poultry shall be thoroughly immersed in the bath for a sufficient length of time to allow of a complete wetting of the feathers and skin.

38. If in the opinion of the inspector it is desirable to spray or disin- fect any fittings, yards, shed, or other buildings where poultry are or have been found to be infested with poultry lice, poultry tick, or stickfast flea, or infected with disease he may order the owner or person in charge of the poultry to carry out such spraying or disinfection of such yards or build- ings, with an approved spray or disinfectant, in such manner as he may direct, and the owner or person in charge shall carry out sucb disinfection accordingly.

Part 2

STOCK SUPPLIERS

Definitions

39. In this Part the following terms have the meanings set against them respectively, that is to say:-

"Stock Supplier"-Any person who carries on, either alone or in connection with any other business, the business of- (i) Hatching chickens for sale; or

(ii) Supplying fowl eggs for hatching; or (iii) A poultry dealer,

or all or any two of such businesses.

"Chicken"-The young of any fowl.

42 Regs. 40,41 REGULATIONS Accommodation and equipment

40. No stock supplier shall keep or cause or allow to be kept any fowls on the holding or premises on which he carries on his business of a stock supplier unless such fowls are provided with accommodation in accordance with the following provisions:-

(a) For fowls over twenty-four weeks of age the fowl-house shall provide a minimum floor area of two square feet per fowl when such fowls are kept in a house with an adjoining run and the fowlhouse shall provide a minimum floor area of three and one-half square feet per fowl when such fowls are kept in a fowlhouse which is not provided with an adjoining run.

(b) For fowls over sixteen weeks of age and under twenty-four weeks of age the fowlhouse shall provide a minimum floor area of one and two-thirds square feet per fowl in fowlhouses when such fowls are kept in a house with an adjoining run, and the fowlhouse shall provide a minimum floor area of three square feet per fowl when such fowls are kept in a fowlhouse which is not provided with an adjoining run.

(c) For fowls over ten weeks of age and under sixteen weeks of age the fowlhouse shall provide a minimum floor area of one and one-third square feet per fowl in fowlhouses when such fowls are kept in a fowlhouse with an adjoining run, and the fowlhouse shall provide a minimum floor area of two and two-thirds square feet per fowl when such fowls are kept in a fowlhouse which is not provided with an adjoining run.

(d) For fowls over six weeks of age and under ten weeks of age the fowlhouse shall provide a minimum floor area of one square foot per fowl when such fowls are kept in a fowlhouse with an adjoining run, and the fowlhouse shall provide a minimum floor area of two square feet per fowl when such fowls are kept in a fowlhouse which is not provided with an adjoining run.

(e) For fowls from six days of age to six weeks of age the fowl- house shall provide a minimum floor area of one-third square foot per fowl in fowlhouses when such fowls are kept in a house with an adjoining run, and the fowlhouse shall provide a minimum floor area of one-third square foot per fowl when such fowls are kept in a fowlhouse which is not provided with an adjoining run.

(f) Fowls less than six days old shall be kept in an incubator, incubator room, brooder, or in such other place as an inspector is satisfied provides adequate safeguards against overheating and/ or chilling of such fowls.

41. A stock supplier shall not maintain chickens in a battery brooder unless such brooder provides a minimum accommodation for the chickens kept therein in accordance with the following provisions:-

(a) For chickens from one to six days of age the brooder shall provide a floor area of not less than orie square foot for every twelve chickens accommodated in such brooder;
