'THE BUSINESS NAMES ACT O F 1962"

DIRECTION BY THE CROWN LAW OFFICER

WHEREAS subsection ( 1 ) of section 9 of "The Business Names Act of 1962"

provides that, except with the consent of the Crown Law Officer a business name shall not be registered under that Act if the business name 1s a name that is in the opinion of the Registrar of Business Names undes~rable o r is a name o r a name of a kind, that the Crown Law Officer has for the purposes of that Act directed the Registrar not t o accept for registration: Now, therefore, I, Leslie Edward Skinner, Acting Solicitor-General for Queensland and a Crown Law Officer within the meaning of section three of ,the said Act, do hereby direct the Registrar and Deputy Registrars of Business Names holding office under "The Busiwess Names Act of 1962", not t o accept for registration, without the consent of the Crown Law Officer generally or in a particular case, any of the names mentioned hereunder:-

( 1 ) Names suggesting connexion with members of the Royal family o r Royal patronage, e.g., names which include the words "Royal': "King", "Queen", or

"Crown".

(2) Names suggesting connexion with the Crown, the Commonwealth of Nations, ,the Government of the Commonwealth of Austral~a,or of a State o r of any other part of the Queen's dom~mons, possessions, or territories, e.g., names which include the words "Commonwealth", "Federal", "State", "Empire", "Imperial", or

"National".

( 3 ) Names suggesting connexion with the government of a foreign country o r with the United Nations.

(4) Names suggesting comexion with a government department, authority o r instrumentality o r a municipal or other local authority.

(5) Names containing the following words or any words of like import:-

"Trust", "Trustee", "Chamber of Commerce", 'Chamber of Manu- factures", "Chartered", "Stock Exchange", "Guarantee", "Co-operative",

"Building Society", "Starr Bowkett", "Bank", "Banker", "Banking", "Savings",

"Made in Australia".

(6) Names suggesting connexion with ex-servicemen's organizations or that its members are totally or partially incapacitated, e.g., names which include the words

"Anzac", "Ex-servicemen", "Returned Soldier", "Blind", or "Blinded".

( 7 ) Names that are misleading as to the nature, objects or purposes of the business in relation to which the business name is applied for or in any other manner.

( 8 ) Names that are blasphemous o r likely t o be offensive to members of the public.

( 9 ) Names that are likely t o be confused with o r mistaken for the name of an existing company, registered foreign company, registered association, firm, co-operative society o r building society or friendly society or a registered business

name.

(10) Names that are likely t o be confused with o r mistaken for the name reserved by or on behalf of a company, a registered foreign company, a proposed company, o r a company which it is proposed to register a s a foreign company.

1 . International Organizations Privileges and Immunities Act 1948-1960 of the Commonwealth, section four provides that except with the consent in writing of the Minister for the time being admin~stering that Act a penon shall not assume or use in comexion with any trade, business, calling, o r profession the name, official seal o r emblem of the United Nations or of any other prescribed international organization.

2. Protection of Word "Anzac" Regulations (Statutory Rules 1921, No. 2 and No. 216, Statutory Rules 1959, No. 29) of the Commonwealth provide that no person shall, without the anthority of the Govemor-General or of a Minister of State, assume o r use the word "Anzac" or any word resembling the word "Anzac" in connexion with any trade, business, calling, o r profession o r in wnnexion with any entertainment or any lottery or art union.

3. Defence (Prohibited Words and Letters) Regulations (Statutory Rules 1957, No. 15). of the Commonwealth, prohibit the use in connexion with a trade, business, calling, or profession o r by an organization o r body or persons of the words and letters set out therein without the consent in writing of the Minister for the time being administering the Defence Act.

provides, that except with the consent of the Crown Law Officer, a business name shall not he registered under that Act if the business name is a name that is in the opinion of the Registrar of Business Names undesirable or is a name o r a name of a kind that the Crown Law Officer has for the purposes of that Act directed the Registrar not to accept for registration: Now, therefore, I, WILLIAM EDMOND RYAN, Solicitor-General for Queensland and a Crown Law Officer within the meaning of section three of the said Act, d o hereby direct the Registrar and Deputy Registrars of Business Names not t o accept for registration without the wnsent of the Crown Law Officer a busiqess name which includes the word "Scientology" or a business name which includes the word "Executor".
