IN pursuance of the powers and authorities in me vested under the provisions of the Electricity Act 1976, I, Sir COLIN THOMAS HANNAH, the Governor aforesaid, acting by and with the advice of the Executive Council, do by this my Proclamation:-

(a) Fix Friday, 1 July, 1977, as the day of commencement of the Electricity Act 19'76;

(b) Fix Tuesday, 1 February, 1977, as the day to be so fixed for the purpose of an election by an officer of the Public Service of Queensland employed in the Department of Electricity Supply or in the office of The Electrical Workers and Con- tractors Board to continue to be an officer of the Public Service after the commencement of the Electricity Act 1976.

Given under my Hand and Seal at Government House, Brisbane, this twenty-third day of December in the year of our Lord one thousand nine hundred and seventy-six and in the twenty-fifth year of Her Majesty's reign.

(ii) Prescribe as follows in respect of the nomination of nominated members:-

(A) Prescribed manner of nomination-

1. In respect of a nominated member assigned to a Local Authority-by the lodging with the Commission of a copy of the Resolution appointing the nominee, which Resolution shall have been passed at a duly constituted meeting of such Local Authority.

2. In respect of a nominated member assigned to a group of Local Authorities-by the lodging with the Commission of a copy of the Resolution appointing the nominee, which Resolution shall have been passed at a duly constituted meeting of a Committee composed of representatives of the Local Authorities in the Group. Each Local Authority shall be entitled to appoint one representative who shall be a member of one of the Local Authorities in the group.

For the purposes of compliance with these provisions by a group of Local Authorities:-

(i) The Commissioner shall direct the Clerk of one of the Local Authorities to convene a meeting of the Committee;

(ji) The Clerk so directed shall chair such meeting but shall not vote; .

(iii) The members of the Committee shall determine the pro- cedure to be adopted at the meeting for the election of the nominee; and

(iv) In the exercise of voting rights the Council of the City of Mount Isa shall have three votes and every other Local Authority shall have one vote.

(B) Prescribed time for the lodging of a nomination-

1. In respect of the nominated members assigned pursuant to this Order in Council--on or before the Fifth day of February, 1977;

2. In respect of a nominated member whose term of office is due to expire by the effluxion of time-not later than one calendar month prior to the due date of expiration of such term of office; and

3. In respect of a nominated member whose position becomes vacant other than by reason of the effluxion of time-within 42 days of the date on which such position became vacant.

And the Honourable the Minister for Mines and Energy is to give the necessary directions herein accordingly.

ORDER IN COUNCIL

At the Executive Building, Brisbane, the eighth day of September, 1977 Present:

The Deputy Governor, for and on behalf of His Excellency the Governor in Council

THE Deputy Governor, for and on behalf of His Excellency the Governor, acting by and with the advice of the Executive Council and in pursuance of the provisions of the Electricity Act 1976 hereby authorises the Electricity Authorities set out in the Schedule hereto, to borrow money from time to time by way of debentures on and from the first day of September, 1977, for the purpose of enabling each of them to exercise and perform their functions subject to the following terms and conditions:-

(b) Before proceeding to borrow money the Electricity Authority shall, at a duly convened meeting of the EI,ectricity Authority, pass a resolution to boI"fOW that money and subsequently a further resolution of the Electricity Authority is required approving of the issue of such debentur,e or debentures.

(b) Before proceeding to borrow money the Electricity Authority shall at a duly convened meeting of the Electricity Authority, pass a resolution to borrow that money and subsequently a further resolution of the Electricity Authority is required approving of the issue of such debenture

or debentures. .

(c) (i) Every such debenture shall be issued under the official seal of the Electricity Authority and when so sealed be deemed to have been duly issued and the holder thereof shall not be bound to enquire whether such issue was in fact duly authorised.

(ii) Every such debenture shall specify the place and time where and when the principal and interest are payable and other terms and conditions as sanctioned or imposed by the Treasurer in accordance with paragraph (a) of this Order in Council.

(iii) Debentures shall be issued without coupons.

(iv) The lender or, in the event of the transfer of a debenture at any time or from time to time, the transferee for the time being shall, subject to this paragraph, be entitled to receive payments from the Electricity Authority in respect of principal or interest, or both, in accordance with the terms and conditions of the debenture.

A transferee with respect to whom the Electricity Authority has not been given notice herein provided shall not be entitled to receive, and the Electricity Authority shall not be liable to make to such a transferee, any payment in respect of such debenture (except under attachment by process of law and then only to the extent of moneys due and payable to such transferee under the debenture and unpaid by the Electricity Authority to the lender or a prior transferee).

In this paragraph the expression "notice as prescribed" means a notice in writing signed by the transferor and transferee and verified to the satisfaction of the Electricity Authority.

(d) An Electricity Authority authorised by this Order in Council to borrow money shall not enter into negotiations .with a prospective lender except with the prior approval of The State Electricity Commission of Queensland.

(e) Where the terms of redemption of any debenture issued pursuant to an Order in Council authorising such debenture, prescribe that there shall be in respect of the loan a sinking fund, that sinking fund shall be managed by The State Electricity Commission of Queensland in accordance with Division VI of Part II of the Act.

And the Honourable the Minister for Mines and Energy is to give the necessary directions accordingly.

HIS Excellency the Governor, acting by and with the advice of the Executive Council, pursuant to the provisions of the Electricity Act 1976, has determined that the positions and classes of positions set out in the Schedule hereto be positions and classes of positions to which section 351 of such Act does not apply and the vacancies in such positions need not be advertised in manner provided.
