Minutes of the DEVELOPMENT ASSESSMENT UNIT MEETING HELD AT THE HILLS SHIRE COUNCIL ON TUESDAY 16 FEBRUARY 2021 The minutes of the Council's meeting of the Development Assessment Unit held on 9 February 2021 are confirmed. The proposed development has been assessed in accordance with the provisions of Part DCP B Section 2 Residential.

No, however, the applicant has proposed setbacks that provide adequate building separation given the slope of the site. Site coverage The DCP allows 30% of the site to be hard surface areas in the E4 environmental life zone. The development proposes a maximum of 2.3m of infill contained within a drop edge beam at the rear of the dwelling.

The applicant was requested to adapt the design to the sloping nature of the site and to minimize earthworks in order to meet the objectives of the E4 Environmental Zone Housing. The objectives of the DCP with regard to landscape and open space are as follows:.

Bushfire Requirements - BAL 40 & BAL FZ – Residential i) Asset Protection Zones

The tank must be located/designed so that the connection for fire fighting purposes is within the internal protection area (IPA) or on the non-hazardous side away from the building. The tank should be provided with a standard 65mm Storz metal outlet with gate or ball valve. The SWS marker should be obtained from the local RFS NSW and installed so that it is easily identifiable by fire personnel and other SWS users.

Markers should be fixed in a suitable location so that they are highly visible and placed next to the most suitable access for the static water supply. All above-ground water pipes outside the building must be metal, including and up to any faucets/outlets/fixtures. Gas must be installed and maintained as set out in the relevant Australian Standard and all piping outside the building must be metal, including and up to any taps/outlets/fittings.

Fixed gas cylinders must be kept at least 10 meters away from flammable materials and protected on the danger side. Cylinders near a building must have safety valves facing away from the building and be at least 2 meters away from combustible materials. iv) Landscaping Assessment.

Erosion and Sediment Control/ Soil and Water Management Plan

Grass areas, mowed lawns or ground cover plantings are provided in the vicinity of the building. Species that have coarse fibrous bark, or that keep/shed bark in long strips or retain dead material in their leaves are avoided. Combustible materials such as wood chips/mulch and flammable fuel are stored away from the building.

Combustible structures such as garden sheds, pergolas and materials such as wooden garden furniture are located away from the building. 1506/2014/LD for 16 Lomandra Circuit Castle Hill, under the provisions of section 4.63 of the Planning and Environmental Assessment Act 1979. Consent must be lodged with the Council in accordance with Planning and Environmental Assessment Regulation 200.

The Project Arborist must be on site to supervise all work near or within the conservation area trees (TPZ) of any trees to be retained on the site or any adjacent site. The Project Arborist must confirm the performance of the tasks at the seven (7) holding points as recommended on page 11 of the Arborist Report prepared by the Arboreport dated 12/11/20.

Control of the works must be certified by the Project Arborist and a copy of such certification must be submitted to the PCA within 14 days of completion of the works and quarterly inspections.

To allow for low-impact residential development in areas of special ecological, scientific or aesthetic value. The proposal is considered to be in line with the stated objectives of the zone, in that the proposal has a low impact and will not adversely affect the existing biodiversity in the vicinity of the site.

Compliance with the DCP Part B Section 2 – Residential

The Council's letter suggests that, as dwellings to the south of the site have extensive setbacks, a setback of 38m should be maintained. It is considered that the proposal is compatible with the streetscape of the area, bearing in mind that the development leads to the modernization of the existing house on the site. It is considered that the proposed front setback does not adversely affect privacy, views and the environmental amenity of the neighborhood and surrounding environment.

The proposal is considered to be consistent with the basic control objectives and results in an appropriate result taking into account the site context. Despite the numerical departure, the development is considered to be in accordance with the objectives of the clause as:. Ample private space has been provided on the site and will adequately provide for the passive and active recreational needs of the residents.

An extensive private open space is envisaged on the site which will adequately meet the passive and active recreation needs of the residents; Existing drainage and runoff management will continue to direct storm water through the proposed drainage system to the front of the site to ensure there is no increased runoff to adjacent properties. The proposal is consistent with the underlying objectives of the audit and is believed to result in an appropriate result given the context of the site.

Concerns regarding the size of the proposed cottage, including overshadowing, loss of sunlight and noise impacts. The application was referred to the Council's Development Monitoring Team (DMT) for examination of the works. Therefore, the scope and scale of the development has been reduced and is considered to have minimal impact on the streetscape.

It is considered that the proposed development will not have an unreasonable impact on the amenity of the adjoining residences, nor will it result in any unreasonable overshadowing and privacy impacts. The application has been referred to the Council's Development Monitoring Team for investigation into the works completed to date on the grant. Works have started around the pool area in the location of the proposed outdoor toilet/shower;.

The separation and recycling of the following waste materials is mandatory: metals, wood, masonry products and clean waste plasterboard. This can be done by source separation on location, i.e. a bin for metal waste, a bin for wood, a bin for bricks and so on. Receipts for all landfill/recycling must be kept on site at all times and presented in legible form to any authorized officer of the municipality who requests it.

The entire site area must be graded, collected and drained by pits and pipes to a suitable point of legal discharge. Earthworks and retaining walls are limited to the locations and heights indicated on the approved plans. Where earthworks are not shown on the approved plan, the topsoil within plots must not be disturbed.

Retaining walls between lots must be located on the high side lot being retained, except for the need for easements for support on the low side lot next door.

A sign must be posted in accordance with Article 98A(2) of the Spatial Planning and Assessment Regulations 2000. The sign must be prominently placed and show: a) the name, address and telephone number of the lead certifier for the work, .. b) the name and telephone number outside working hours of the main contractor/person responsible for the work.

Prior to the issuance of a pool/spa professional certificate, it must be registered on the NSW State Registry of Pools and Spas. To register the pool/spa, log on to www.swimmingpoolregister.nsw.gov.au and follow the instructions. A copy of the registration certificate must be submitted to the lead certifier to confirm registration.
