CHARGES IN RESPECT OF NURSING HOMES AND HOSTELS REGULATIONS 1988

Department of Health Brisbane, 23rd June, 1988 HIS Excellency the Governor, acting by and with the advice of the Executive Council and in pursuance of the provisions of the Hospitals Act 1936-1988, has been pleased to make the following regulations.

LEISHA HARVEY

1. Short title. These regulations may be cited as the Charges in Respect of Nursing Homes and Hostels Regulations 1988.

2. Repeal. The regulations (untitled) made under the Hospitals Act 1936-1971 and published in the Queensland Government Gazette on 27th January, 1973 at page 363, and in force under the Hospitals Act 1936-1988 are repealed.

3. Charges in respect of nursing homes and hostels. ( 1) A resident of a nursing home or a hostel under the control of a Board constituted pursuant to the Hospitals Act 1936-1988 shall pay a maintenance charge for accommodation and nursing attention based on the relevant percentages, set out in the Schedule hereto, of the amounts prescribed from time to time under the provisions of the Social Security Act 1947 (Commonwealth), or any Act amending or in substitution for the said Act.

(2) Where a person has been a continuous resident of a nursing home or hostel since before 1st January, 1981 and is in receipt of a pension equal to or greater than the basic pension provided under the Social Security Act 1947 (Commonwealth), the maintenance charge for accommodation and nursing attention shall be that pension less that fraction of that pension which was the fraction of pension retained for personal use by the resident under the arrangements operating at 31st December, 1980.

(3) Where a person has not been a continuous resident of a nursing home or hostel since before 1st January, 1981 or is not in receipt of a pension equal to or greater then the basic pension, the maintenance cha,rge for accommodation and nursing attention shall be the relevant

percentage, set out in the Schedule hereto, of the pension payable to that resident together with, where an allowance is paid to the resident by waY. of supplementary assistance pursuant to the Social Security Act 1947 (Commonwealth), that allowance:

Provided that the minimum charge payable shall be the relevant percentage, set out in the Schedule hereto, of the standard aged or mvalid pension under the Social Security Act 1947 (Commonwealth).

Schedule

The relevant percentages shall be as follows:- (a) in respect of nursing home residents-87112%;

(b) in respect of hostel residents-66213%.
