A plan of the land so surveyed or projected shall be exhibited in the office of the wardens. The value of the improvements stated in the notice shall be the value determined by the trustee under subsection (3). In the case of a separate lease to be sold and sold by auction,. one ~ thirtieth of the purchase price;. land as per the notification relating to such land.

For each period of the next ten years, the value of the capital shall be determined by the administrator on behalf of the tenant or minister at least six months before the end of the current period. 5) (a) If the Minister approves the application, a lease deed shall be issued for each subdivision in the name of the lessee. When the document is issued, the original document has no validity or effect and is revoked by the Minister.

The memorandum must be in duplicate and one original must be registered in the office of the director. in the case of multiple mortgages on the same miner's home or sublease, they will take effect based on the priority of such registration. In the event of a sale pursuant to the power of sale hereby granted, the mortgagee may convey such lease or sublease to the purchaser in the manner hereinabove described, and the conveyance shall be registered in the office of the manager upon payment of the prescribed fee. Upon the issuance of the provisional instrument, the original instrument shall no longer have any force and shall be deemed revoked.

Forfeitures must be notified in the "Gazette". Every forfeiture of land under this Act for any cause shall be notified by the Minister in the Government Gazette, and shall take effect from the date of the notification. The decision of the Land Court is final and binding on all parties to such reference. For the purposes of said laws, the lessee is considered the owner, and the grant of the lease is considered a disposal of the land.

THE MINERS' HOMESTEAD LEASES ACT 1913-1979

Applications for the lease of lands which have been offered at auction and which have not been sold are open for lease at a reduced price and shall be filed in such number of copies as required by the administrator in form no. 5 of the second appendix to this regulation. The prescribed form for filing a notice of objection under sections 12A and 19A of this Act is Form 25 of the Second Schedule to this Act. Superseded by regulations published in the Official Gazette on June 3, 1978, p. A notice under section 21 of the Act approving an application or purchase must be in Form no. 12 of the second appendix to this document.

Wherever, under the Act, land is let subject to the condition of residence, and the applicant, buyer or tenant does not intend that such condition will be carried out by the residence thereon of himself, he must give notice to the Custodian of the name of the qualified person he has appointed to live on the land in accordance with the Act. When an applicant or purchaser wishes to give notice to the Custodian under section 21 of the Act that he has entered upon the occupied land applied for or purchased, or that he has fenced the land or made improvements in the manner prescribed, must give the notice in Form No. 14 of the Second Schedule hereto. 21 or 22 of the Second Schedule hereto as applicable, with the changes therein as the circumstances of any particular case require.

The Mining District I hereby surrender and convey to Her Sovereign Majesty Queen Elizabeth the Second for all my estate and interests in and of the area as shown on Plan Cat. which is part of the mentioned homestead. FOREVER PROVIDED and hereby reserved to us, our heirs and successors, all gold and minerals (the term "minerals" has the same meaning as in the Mining Act and all petroleum (the term "petroleum" has the same meaning as in The Petroleum Acts, 1923 to 1967 ) and all helium found in association with petroleum on or under the surface of said land.
