Permanent structures or other physical modifications such as land disturbance can alter the natural character either within the coastal marine zone or on coastal land. Adjacent coastal land use can affect the natural character of the coastal marine area, particularly through access to shore or sea. The dominant landscape of the coastal seascape is the surface seascape (coastal water spaces) together with the coastline of beaches, tidal flats or reefs.

The naturalness of the seascape is an essential element of landscape value in the coastal sea area. Public access, including the use of vessels, can lead to an intensity of use of the coastal sea area, which has negative effects on the safety of navigation or on natural values. The coastal marine area itself may be regarded by Māori as a valued resource or taonga.

Use or development in the coastal marine area, including structures, habitation and disturbance, may adversely affect the natural character of the coastal environment. Physical changes to the marine coastal area due to disturbances, constructions, land reclamation or other activities can negatively affect the natural character of the marine coastal area and the adjacent coastal area. New Zealand law and coastal policy statement require the conservation of the natural character of the coastal environment, including the coastal marine area, as a matter of national importance.

To enable instruments and materials to be deployed in the marine coastal area for scientific investigations, subject to any adverse effects being avoided, corrected or mitigated.

The materials used are similar or the same as those previously used for the structure;. iv) Where the maintenance, repair or replacement of a structure is within 20 meters of a network utility, the location of the network utility must be determined by, and the work under the supervision of, a suitably competent person in civil or network utility engineering. f) The owner of the structure provides the Council with their name and contact details. g). The structure is kept free of any biosecurity risk organism that is the subject of any declaration, small-scale management plan, or regional pest management plan under the Biosecurity Act 1993. The structure is not located in any area identified in Schedule 25D, except:. ii) within 100 meters of the quays, jetties, boat ramps or slipways at Port Mapua, Port Motueka, Waitapu, Collingwood or Mangarakau as they existed on 31 December 2002;. iii) within 75 meters of the public quay at Torrent Bay/Rākauroa, as it existed on 31 December 2002;.

Permission may be refused or conditions may be imposed to manage any consequences of the activity. The Board's assessment of an application may include, but is not limited to, the following: Any structure for any of the purposes specified in rule 25.1.2.3, which does not comply with the conditions of that rule, is a non-conforming activity .

Any disturbance or occupation of the marine coastal area for the installation, use, maintenance or replacement of submarine lines or cables is a permitted activity that may be undertaken without the consent of the resources, if it meets the following conditions: A). The activity avoids further restrictions in terms of tidal wash and fish passage. f) Vehicle movements in the marine coastal area are avoided where possible and otherwise:. ii) passes through hard substrate where possible; iii) avoid native vegetation where possible. g) Within seven days of completion of the work, the natural levels of the foreshore and seabed shall be restored as close as possible to those existing before the commencement of the activity. h) That disruptions or work within a radius of 20 meters from a network line do not affect the network facility and that the installation of the structure is supervised by a civil or network manager who has determined the position of that network facility; Any disturbance to the coastal marine area by or in connection with the removal of a structure from the coastal marine area is a permitted activity that may be undertaken without resource consent if it meets the following conditions: A).

Any disturbance or occupation of the marine coastal area by or in connection with the use, maintenance, repair, replacement or removal of a pipeline, drainage structure, navigation aid, overhead line or with the modernization of an overhead line is a controlled activity. , if it meets the following conditions:. A). With respect to navigation aids, the following additional matters: a) any loss of functionality due to the location, type and use of the navigation aid; With regard to structures for the purpose of combating coastal erosion or flooding, the following additional matters apply: a) the design and appearance of the structure, including the profile;

Those existing unauthorized structures that have no adverse effects have been granted permitted activity status, subject to a condition relating to their structural integrity and providing the owners name and contact details to the Council. The council may also remove some derelict structures where the structure is considered to be of minimal value and the owner cannot be found. The activity does not take place in any area identified in Schedule 25D except:. ii) within 100 meters of wharves, wharves, boat platforms or slipways at Port Mapua, Port Motueka, Waitapu, Collingwood or Mangarakau as they existed on 31 December 2002;. iii) within 75 meters of the public harbor at Torrent Bay/Rākauroa as it existed on 31 December 2002;.

Existing moorings 61(a), (c), (e) and (t) missing from this sequence are located outside the mapped boundary of the Mapua mooring area. The Mapua Mooring Area includes that part of the marine coastal area bounded by a mean low water line adjoining Mapua and a line extending due south from the general line of the western shoreline of the Tahi Street/Grossi Point Peninsula, and in continuing generally east and north for a distance of 100 meters from mean high tides to a point south-east of Grossi Point, then generally northwards to join the center line of the channel between Mapua and Rabbit Island/Moturoa and continuing along the center line of that channel to its intersection with a straight line between points 185947 and 188947 (New Zealand map grid), then westward to mark the low-water mark.
