EXTRACTS FROM THE AGRICULTURAL EDUCATION ACT, 1958

As amended by the Agricultural Education (Amendment) Act, 1959

3. (1) In addition to any sums which by the University Act 1958 or any other Act may be paid out of the Consolidated Revenue to the University of Melbourne there shall be issued and applied out of the Consolidated Revenue (which is hereby to the necessary extent appropriated accordingly) and be paid to the University in the financial year beginning on the first day of July One thousand nine hundred and fifty-nine and also in each of the two subsequent financial years such sum not being less than Thirty-five thousand pounds as the Treasurer of Victoria thinks necessary to be applied by the University for the purposes of agricultural education and research in agricultural science.

(2) The conditions on which the said annual payments shall be made are as follows:

(a) That the University maintains a school of agricultural science (including a faculty) for the teaching of, and the conducting of research in, agricultural science in the University and that at least one-half of the members for the time being of the said faculty shall be members nominated by the Govemor in Council;

(b) That the staff of the department of the said school which conducts research in agricultural science shall upon such terms and conditions as are agreed upon between the Minister of Agriculture and the University make and report to the Minister the result of any investigation in agricultural matters which he requires to be so made and reported upon;

(c) That courses approved by the Council of work done at agricultural colleges are recognized for the purpose of fulfilling conditions for obtaining University degrees in agricultural science or diplomas of agriculture; and

(d) That the University shall in each year and from year to year provide free places admitting to full courses for degrees or diplomas in agricultural science, and the Minister of Agriculture shall determine the number of free places to be so provided each year and shall nominate persons to occupy such free places.

(3) The said annual payments shall be paid into and kept in a separate fund by the Council and no payment out of that fund shall be made without the consent of a committee appointed by the Council of which committee the Minister of Agriculture for the time being or some person specified in writing by him in that behalf shall be a member.

(4) The Council shall in every year include in their annual report to the Govemor a full and separate account of the income and expenditure of the said annual payments.

(5) Expressions in this section unless inconsistent with the context or subject- matter bear the same meaning as in the University Act 1958.

4. (1) There shall be issued and applied out of the Consolidated Revenue (which is hereby to the necessary extent appropriated accordingly) in the financial year beginning on the first day of July One thousand nine hundred and fifty-nine and also in each of the two subsequent financial years the sum of Six thousand five hundred pounds for the purposes of carrying on investigations and educational work in relation to irrigation.

(2) The sums provided for in this section shall be applied in such manner as the Govemor in Council (on the recommendation of the Minister) thinks fit for the purposes aforesaid.

5. (1) During the period of thirteen years after the commencement of the Agricultural Education Act 1949 there may be engaged by special contract fifty persons holding degrees of the University of Melbourne in agricultural science to be officers of the departments to which this section applies, for such periods and at such salaries (not being less than Four hundred pounds per annum) as the Govemor in Council determines, to carry out such duties (for which the training of such persons specially qualifies them) as the Govemor in Council thinks fit:

AGRICULTURAL EDUCATION ACT Provided that—

(a) not more than six persons shall be engaged as aforesaid in any one year unless less than six were so engaged in any previous year during the operation of this section in which case so long as the total number engaged as aforesaid during the operation of this section does not exceed fifty and so long as the average yearly number previously engaged during the operation of this section does not exceed six, additional persons may be engaged as aforesaid;

(b) any other persons qualified as aforesaid may be engaged as aforesaid to fill any vacancy caused by any person engaged as aforesaid or under any corresponding previous enactment ceasing to be so engaged; and

(c) nothing in this section shall affect any other power to appoint or engage as officers of any department any persons whether holding such degrees or otherwise:

Provided further that where by arrangement between the Minister and the Council of the University any person is appointed by the Council for the purposes of the conducting of research in agricultural science and his services were remunerated by the Council out of moneys paid to the University pursuant to this Act or any corresponding previous enactment for the purposes aforesaid and such person is subsequently engaged by special contract pursuant to this section to be an officer of a department to which this section applies, such person shall, as on from and after the date of his appointment by special contract as aforesaid, be in the like position with respect to salary and increments and otherwise as he would have been at the said date if his services under the Council of the University for the purposes aforesaid had been service in a department to which this section applies under an engagement by special contract pursuant to this section, and the special contract shall make provision accordingly.

(2) The departments to which this section apphes are the Education Department the Department of Agriculture and the Water Supply Department.
