34;certification certificate" any certificate in the prescribed form issued by an inspector in respect of any weight, measure, weighing instrument or measuring instrument exempted by the regulations from being stamped with a certification stamp due to the impracticability of stamping the same. , for the purpose of indicating that the weight, measure, weighing instrument or measuring instrument has been found on inspection to comply in all respects with the requirements of this Act: 34; "certifying stamp" means any stamp prescribed for use by an inspector for the stamp under this Act any weight, measure, weighing instrument or measuring instrument for the purpose of indicating that the weight, measure, weighing instrument or measuring instrument has been found on inspection to comply in every respect with the requirements of this Act:. Except as otherwise provided in this section, the provisions of Part XIX of the Local Government Act do not apply to any scheme entered into under this Act. The local administration must include-. a) verification, re-verification, inspection and stamping of all types of weights, measures, scales and measuring instruments used in trade, except for those which according to this Act belong to the central administration. 15 such standards shall, for the purposes of this Act, be deemed to be inspectors' standards determined under this section.

For the purposes of this article, the finalist may exercise all the powers of the council and may appoint any inspector or other person necessary to enforce the provisions of this law as aforesaid.

PART IV

IS (b) inspect any weight, measure, weighing instrument or measuring instrument in the possession of any person having a package, basket or other container containing goods for sale. Any weight, measure, weighing instrument or measure :er ~ta. a) is not sealed as required by or according to this law;. It will be seized and stopped by an inspector. Every weight, measure, weighing instrument and measuring instrument used for trade and every public scale shall be stamped with a verification mark as prescribed.

Every weight, measure, weighing instrument and measuring instrument used for trade shall, as prescribed, be submitted for inspection at least once in every two years for verification and stamp: Provided that the Governor by regulations-. a) subject to the conditions prescribed, wholly or partly exempt from the operation of this Part, the classes of weights, measures, weighing instruments or measuring instruments prescribed. IS (3) Any person who contravenes or fails to comply with any specification in any such notice applicable to him shall be guilty of an offense and liable to a fine not exceeding two hundred dollars. Each council must arrange for an inspector to visit and inspect at least once every two years every place of business within its jurisdiction where weights, measures, weighing instruments or measuring instruments are used for trade, or where goods are kept or exposed for sale. .

N_O_,_IS authorized by this Act to be used: Provided that this paragraph shall not apply in connection with the importation or exportation of goods from or to a place outside the State where other than the standard weights or measures established in accordance this Act was used;.

PART V

As to those in the metric system, and the table may be lawfully used in the calculation and expression of weights or. measures of the metric system in terms of weights of the aVOIrdupois system or those measures of capacity as the case may be. This subsection shall not apply to any article weighed, measured or counted in the presence of the purchaser or to any article exempted by regulation from the requirements of this subsection. In any prosecution or legal proceeding under this Act, no evidence shall be required, unless evidence to the contrary is given, of the appointment of the Guardian of Standards or any other officer purporting to be appointed under this Act. a) specified weights or measures in one's possession. the inspector is the Standards of Inspectors; or. b) such weights or measures have been verified or re-verified within the specified period;

It shall be a sufficient defense in any action under this Act if the accused proves to the court that the offense was due to a bona fide mistake or an accident or any other cause beyond his control and despite all reasonable precautions being taken and all due care exercised by him to prevent the commission of the offense or was due to the act of a person over whom the defendant had no control. Law recovered on appeal from an inspector or officer of a council shall be payable to that council. All other fines and penalties must be paid into the state's general revenue. All weights, measures, scales or measuring instruments and goods forfeited under this Act shall become the property of the Council or (where the prosecution was brought by the Warden of Standards or the Crown) of the Crown and (except where other measures are taken by or after this Act) may be disposed of as the Council or (as the case may be) the Minister thinks fit.

The Governor may from time to time make regulations Regu]atloDB. provide for all or any purpose, whether general or meet. special cases which may be convenient for the administration of this Act, or which may be necessary or expedient to carry out the objects and purposes of this Act, and without limiting the generality of the foregoing provisions of this section, rules may be issued for or in respect of all or any of the following purposes, matters and things:-. IS (23) Regulation and control of the size of the packaging by reference to the volume of the packaging and its contents respectively, and, where the packaging containing an object is packed in an outer packaging or container, regulation and control of the size of the outer packaging or container with reference to the volume of the outer packaging or container and of the article respectively.
