The Community of Islanders resident in Bamaga shall, for the purposes of this Act, be deemed to be resident in Torres Strait. A person who, on the commencement of this Act, holds an appointment for the purposes of the Torres Strait Islanders Act 1971 (or that Act as subsequently amended) shall, subject to the conditions of his appointment, continue to hold the appointment for the purposes of that Act, if the employment is essential for the purposes of this Act. 7) An administration of property belonging to a person which was undertaken when he was an assisted islander in the sense of the aborigines.
-laws made by an island council may adopt, in whole or in part, regulations drawn up by a local government within the meaning of the Municipalities Act 1936-1985 or by another island council or other authority or the provisions of any law or regulation on the basis of any act also. 4. When, after having duly considered all objections to the adoption, it submits the regulation to the Minister for the approval of the Governor in Council.

The provisions of and shall be observed in the preparation of estimates of receipts and disbursements in all other funds established and maintained by an insular council in accordance with the prescribed provisions: Provided that in respect of a corporate fund nothing in this section shall prevent or be taken to prevent the transfer of surplus or deficit as laid down in the prescribed regulations. The Island Council must keep proper accounts to record receipts and payments to and from each of the council's funds, including such accounts as the Minister may direct. At the request of the Director-General or such authorized person, a person managing the accounts on behalf of an Island Council shall produce the minutes in accordance with the request.
Each Island Council must as soon as practicable after 30 July before 31 August in each year, in respect of the year ended on the 30th of June, prepare annual financial statements in a form as prescribed and submit such statements to the auditor appointed for that council. under this Act. When an officer of the Department of the Auditor-General is appointed to be the auditor for an Island Council, the amount will be determined if his or her remuneration is paid by the Island Council to the Auditor-General. A member of the Police Force of to enter and to enter an area-. a) for the purpose of fulfilling or exercising a function, duty or power imposed or granted to him by law; or. b) for the purpose of performing any act or thing which he is authorized by this Act to perform in terms of an authorization or requirement of a by-law of an Island Council.
18 s.41 COMMUNITY SERVICES (TORRE STRAIT) ACT s. 2) An island court will be established-. (a) by two justices of the peace, each of whom is an islander in his area and is a person who is not unlawful by subsection (3) to sit as a member of the court in the said case;.
CO-ORDINATING COUNCIL
To enable it to exercise its duties and powers under this Act, the Island Coordination Council may borrow money in such amount, against security (if any) and on such terms and conditions as the nister approves. .
PART V-ISLAND INDUSTRIES
0 finance any business specified OR referred to in paragraph (a) of this subsection and, for that purpose, raise money on loan from the Treasurer of Queensland, the Corporation, the Agricultural Bank Corporation, or any bank, financial institution, or person and bond or transfer by way of security property of the Council (including the rights of the Council under contracts made with Islanders or other persons in connection with any such business). No part of the profits of the Council shall be paid into Consolidated Revenue, but shall be used for the general welfare of Islanders in such manner as the Council may from time to time prescribe with the approval of the Governor in Council. The Council pays a fee for such audit in an amount to be determined (2) The Auditor-General must report at least once in each year to.
A COPY of such report and recommendation will be provided to the chairman of the Council who will submit the report a. The Minister's decision is final and binding and is implemented by the Council and all persons involved.
PART VI-ENTRY UPON AREAS
(1) Where, on the commencement of this Act, property, being money, of an Islander is administered under the Torres Strait Islanders Act 1971-1979, the Director-General shall have the power to continue that administration.
Investment of moneys by banker. (1) Moneys from time to time forming part of the trust fund or a trust fund referred to in section 70
COMMUNITY SERVICES (TORRES STRAIT) ACT. drawn by the banker, and may be deposited by himself or through the Treasurer of Queensland-. a) with any authorized short-term money market dealer with lines of credit established with the Reserve Bank of Australia as a lender of last resort; or b) in such securities, investments or financial arrangements as may be recommended by the Treasurer and approved by the Governor in Council. In the absence of a testamentary document duly drawn up by an Islander who has died or is presumed to have died, and if it proves to be impracticable to determine the person or persons who are entitled by law to inherit the property of the Islander or any part of the Islander may the Director-General shall determine which person or persons are entitled to such succession or whether any person is entitled to it. The person or persons determined by the Director-General to be entitled to the inheritance of the estate or any part thereof shall be the only person or persons entitled by law to the inheritance of the estate or, as the case may be, the part and, if more than one is so determined as one person, to succeed in the order and shares determined by the general manager.
In proceedings to enforce a sentence for a (a) allegation in the complaint that a person named therein is part of the community residing in an area, this shall be conclusive evidence until the contrary is proven; The Governor may, in accordance with this Act, make regulations relating to: the functions, duties and powers of the Director-General and officers of the department, and the manner in which those functions, powers and authorities are exercised or exercised; the extent and manner of exercising the jurisdiction of island courts and their procedures; the manner in which decisions of island courts are implemented; the self-management and good governance of islanders; the development of skills, training and employment for islanders; the composition of island councils; the qualification of candidates for membership of these councils; the right to vote for the elections of those councils and the conduct of those elections; the appointment, powers and duties of officers for those elections; filling temporary vacancies in the membership of these councils; the election of the chairman and deputy chairman of island councils and the island coordination council; the appointment of a clerk of an island council; inspecting the administration of an island council by or on behalf of the director general; the composition of the island police forces and the working conditions of the island police; providing assistance to islanders; the conditions under which aid can be granted; the obligations of persons to whom support is provided; the management and supervision of the funds of island councils, so-called island funds, or of the island-wide council; the deposits into and disbursements from these funds; to establish, maintain, manage and control such trust funds and accounts as are necessary or desirable for the care of Islanders' monies deposited with the Director General or the Island Industries Board or for the administration of Islanders' estates or for the disposition of unclaimed funds; to establish, maintain, administer and control funds to indemnify islanders against loss of or damage to vessels, equipment or machinery, and to compensate islanders and members of their families for death or personal injury sustained by any person in the course of his duties in cases. where no compensation is due under The Workers'. Compensation Provides the basis on which such indemnity or compensation is payable; Island Industries Board meetings and participation therein; the accounts and documents that must be kept by the board, either in general or in relation to a specific matter of the board of directors; the manner in which such accounts and documents are kept and how the activities of the Board are carried out; the functions, powers and duties of the officers, clerks and employees of the Council; the security and protection of the board's property; the forms to be used under this law and the purposes for which they are to be used; the procedure to be followed in relation to any application made under this Act; the compensation payable under this law and the purposes for which it is paid; ,. fines for violations of the regulations not to exceed $200 in any event. all matters that must or may be prescribed under this law and for which the limitation period is not otherwise regulated; And. all matters and matters for which it is necessary or convenient to ensure the proper administration of this Act or to achieve the objectives of this Act.
Regulations may be made to apply throughout the country or to the part or parts of the country specified in them.
