An Act to amend the Bulk Handling of 'Grain Act, 1955-1969.

[Assented to 15th December, 1977]

BE IT ENACTED by the Governor of the State of South Australia, with the advice and consent of the Parliament thereof, as follows:

1. ⁽¹⁾This Act may be cited as the "Bulk Handling of Grain Act Amend- Short titles.

(2) The Bulk Handling of Grain Act, 1955-1969, is hereinafter referred to as "the principal Act" .

(3) The principal Act, as amended by this Act, may be cited as the "Bulk Handling of Grain Act, 1955-1977".

2. This Act shall come into operation on a day to be fixed by proclamation. ~

3. Section 2 of the principal Act is amended by striking out from the =r~r

definition of "warrant" the word "wheat" and inserting in lieu thereof the ^I.z-

word "grain". IDterpretatlOD.

4. Section 12 of the principal Act is amended- ::=,~-:::r

(a) by striking out from subsection (1) the passage "wheat and barley", Rishtor

twice occurring, and inserting in lieu thereof, in each case, the ~riD.

"wheat or barley", twice occurring, and inserting in lieu thereof, in each case, the word "grain";

(d) by striking out from paragraph (c) of subsection (2) the passage

"or flour" and inserting in lieu thereof the passage ", flour or oats";

"handling wheat" the passage "or oats";

(I) by striking out from paragraph (d) of subsection (2) the passage

(g) by striking out from paragraph ^(e)of subsection (2) the passage

(h) by striking out from paragraph (I) of subsection (2) the passage

(i) by inserting in paragraph (a) of subsection (3) after the word "barley", twice occurring, in each case, the passage "or oats";

(j) by striking out from paragraph ^(b)of subsection (3) the passage

"wheat or, as the case may be, barley" and inserting in lieu thereof the word "grain";

and

(k) by striking out from subsection (4) the passage "wheat or barley", twice occurring, and inserting in lieu thereof, in each case, the word "grain".

5. Section 14 of the principal Act is amended-

(a) by striking out from paragraph (b) of subsection (1) the passage

"wheat and barley" and inserting in lieu thereof the word

"grain" ;

(b) by inserting in subsection (3) thereof after the word "country"

the passage "or terminal";

and

(c) by striking out subsection (4).

6. Section 19 of the principal Act is amended-

(a) by striking out from subsection (1) the passage "wheat or barley"

and inserting in lieu thereof the word "grain";

(b) by striking out from subsection (2) the passage "wheat or barley"

and inserting in lieu thereof the word "grain";

(c) by striking out from subsection (2) the passage "or in the case of barley" and inserting in lieu thereof the passage "or, as the case maybe,";

and

(d) by striking out from subsection (3) the passage "wheat or barley", wherever it occurs, and inserting in lieu thereof, in each case, the word "grain".

7. Section 30 of the principal Act is amended by striking out the passage

"wheat or barley" and inserting in lieu thereof the word", grain".

~=o:- 8. The heading occurring before section 33 of the principal Act is amended

~~ Act. by striking out the passage "Wheat and Grain other than Wheat" and inserting in lieu thereof the word "Grain".

9. Section 33 of the principal Act is amended- Amendment of

principal Act,

(a) by striking out from subsection (1) the passage "wheat, or bagged ~y barley or oats in bulk" and inserting in lieu thereof the word ~~=~

"grain"; ^gnUn.

(b) by striking out from subsection (2) the word "wheat", wherever it occurs, and inserting in lieu thereof, in each case, the word

"grain";

and

(c) by striking out subsection (3).

10. Section 34 of the principal Act is amended by striking out from A~~dmena1 Act ,of

paragraph (1) of subsection (2) the passage "wheat, or bagged barley or of ^{s.34- .} oats in bulk" and inserting in lieu thereof the word "grain". RoaulatioDS.
