48 THE UNIVERSITY ACT, 1616
A University is hereby declared to have been, to consist of established on the eleventh day of April One-

If any member of the council resigns his office in writing addressed to the Chancellor of the University, or if he is declared by commission or otherwise to be of unsound mind, or if he becomes insolvent or if he is convicted of any felony or offence, or if he is absent without special leave previously granted by the council. Subject to such regulations as the senate by its standing order may from time to time provide its standing order, it shall be lawful for members of the senate to cast their votes at elections by ballot.
No member of the Board shall be entitled to vote in the Board or in any committee, to vote in the Board or in any committee thereof, on any subject in which he has a direct pecuniary interest, and the vote of any member interested is not allowed. The council annually or whenever a vacancy arises elects two of its own members as Chancellor and Vice-Chancellor respectively. I cannot discover in the Act of Incorporation any provision investing the Council and Senate with. But the legislative powers vested in the senate are not co-ordinate with those of the council: for it is for the council to frame and initiate .. any statute, while the power of the senate is limited to the acceptance or rejection, as they may think fit, of those statutes .. which may be submitted to them by the Council.'. The Senate may amend any by-law or by-laws submitted by the Council for their approval.
All the foregoing statutes and regulations shall be reduced to writing, and the common {jygJJveiTror tha shall be reduced to writing, and the common {jygJJveiTror jscal of the University attached thereto. Victoria to direct that there be issued and paid out of the general revenue the sum of nine thousand pounds sterling annually as a fund for the maintenance of the university and for defraying such salaries as may be appointed to be paid to certain professors officers and servants to be appointed by this University, and for defraying the expenses of such scholarships, scholarship prizes, and exhibitions as are given for the encouragement of students - in the University, and for providing a library for the same and for discharging all necessary charges connected with their management.
The manner or manner in which University Approval proposes to fulfill the conditions imposed by 2mbi.or l a . this section 'shall be subject to the previous approval of the Governor in Council. Said annual payments shall be paid and created in a special fund by the council and no payment shall be made out of said fund. It concludes the consent of a commission appointed by the council, whose member is the Minister of Agriculture at the moment.
25. Subject to the statutes and regulations of wiiatde-
The provisions of this Act shall extend to both sexes, and every person who has fulfilled the
57 bert> of the council or persons acting as aforesaid, or that they or any of them were unable to be members of the council, be as valid as if any suoh person had been duly elected or appointed and was able to be a member of the council. This section shall be and shall be deemed to have come into force on the commencement of the Act of the Legislative Assembly of Victoria passed in the sixteenth year of Her Majesty Queen Victoria and numbered 31 as ". The Governor of Victoria shall for the time being be Visitor at said University, and.
