ITEM 1: DA 992/2019/HC – CONSTRUCTION OF A BUS DEPOT – 4-6 MILE END ROAD AND DEVELOPMENT LOT 591-595 WITHERS ROAD, ROUSE HILL

COUNCIL OFFICER’S RECOMMENDATION:

The development application be approved subject to conditions in the report.

LOCAL PLANNING PANEL DECISION:

1. Whilst the Panel understands the desirability of providing a bus depot in a rapid growth area, the Panel is not satisfied that based on the material before it, the application is suitable for approval at this stage having regard to the potential:

 Traffic impacts.

 Impacts on pedestrian safety.

 Noise impacts (including from buses and other vehicles entering and leaving the site and entering and leaving the intersection of Withers Road and Rosario Place) particularly having regard to the application to conduct the depot use outside of the hours of 7am and 6pm referred to in Clause 2.11 of Part B Section 7 (Hours of Operation) of The Hills DCP 2012.

2. The Panel defers the application for determination at a future Panel meeting and requires the following additional information to be provided for such meeting:

a) An acoustic report be provided by an independent external acoustic engineer to be engaged by Council to peer review the applicant’s acoustic reports including the assumptions used in the modelling for those reports. Such assumptions to be based on the application as outlined in the applicant’s revised traffic report. (See (b) below). The acoustic report is to address the criteria in Clause 2.11 of Part B Section 7 (Hours of Operation) of The Hills DCP 2012 including buses entering and leaving at the intersection of Withers Road and Rosario Place.

b) The applicant is requested to update the traffic report to clarify the actual proposed operation of the depot and to specify for each hourly period inward and outward bound vehicle movements identified by category (i.e. bus, car etc). The traffic report should also address the impact of pedestrian safety in the vicinity of Commercial Road and Withers Road.

LOCAL PLANNING PANEL DECISION:

The development application is approved subject to the conditions in the report with the addition of “Prior to Occupation” at the end of the first sentence in Condition 4.

REASONS FOR THE DECISION:

The panel generally agrees with the Council officer’s report.
