ITEM 1 - MINUTES OF LAST MEETING

The minutes of the Local Planning Panel of 20 June 2018 have been confirmed by the Panel Chair Julie Walsh by way of tabled email dated 17 July 2018.

PAGE 2 ITEM 2 DA 1860/2018/HA – CONSTRUCTION OF A 16 ROOM BOARDING HOUSE IN ACCORDANCE WITH SEPP (AFFORDABLE RENTAL HOUSING) 2009 – LOT 2 DP 125228, NO. 511 WINDSOR ROAD, BAULKHAM HILLS

DECISION & REASONS

The DA be refused on the following ground:

1. The proposal does not comply with the parking provisions under Clause 29(2)(e)(iia) of the State Environmental Planning Policy (Affordable Rental Housing) 2009 as the development is deficient by five (5) parking spaces. The development fails to provide adequate parking for future residents or to ensure parking needs are accommodated on the development site.

DECISION AND REASONS

The Panel resolved to adopt the recommendation of the Council Officer’s report and grant consent to the Development Application subject to the recommended conditions.

The reasons for the Panel’s decision are as follows:

1. The Development Application has been assessed against the relevant heads of consideration under Section 4.15 of the Environmental Planning and Assessment Act, 1979, State Environmental Planning Policy (Educational Establishments and Child Care Facilities) 2017, The Hills Local Environmental Plan 2012 and The Hills Development Control Plan 2012 and is considered satisfactory.

2. Submissions received during the notification period have been considered in the assessment of the Development Application and issues raised do not warrant refusal of the application.

3. The Development Application has been assessed taking into consideration the public interest.

DECISIONS AND REASONS
