RESOLUTION

The Minutes of the Development Assessment Unit Meeting of Council held on 9 July 2019 be confirmed.

ITEM-2 DA 1267/2019/HA - PROPOSED BOARDING HOUSE UNDER SEPP (AFFORDABLE RENTAL HOUSING) 2009 - LOT 102 WINDSOR ROAD, KELLYVILLE

PUBLIC NOTIFICATION OF THE DETERMINATION PURSUANT TO ITEM 20(2)(c) AND (d) OF SCHEDULE 1 OF THE ENVIRONMNTAL PLANNING & ASSESSMENT AT, 1979 DECISION

The Development Application be refused for the following reasons:

PAGE 2 1. The proposal does not comply and is inconsistent with the relevant provisions of State

Environmental Planning Policy (Affordable Rental Housing) 2009.

(Section 4.15(1)(a)(i) of the Environmental Planning and Assessment Act 1979)

2. The proposal lacks adequate and necessary supporting documentation required by Schedule 1 of the Environmental Planning and Assessment Regulation 2000. As a result, the application is unable to demonstrate compliance and consistency with the applicable planning controls.

3. The proposal does not comply and is inconsistent with the relevant provisions of State Environmental Planning Policy No 55 – Remediation of Land.

4. The proposal does not meet the objectives of Clause 4.1 of The Hills Local Environmental Plan 2012.

5. The proposal does not comply and is inconsistent with the outcomes of The Hills Development Control Plan 2012 – Part D Section 7 – Balmoral Road Release Area – with regards to setbacks, road design, stormwater management and landscape corridors.

6. The proposal does not comply and is inconsistent with the outcomes of The Hills Development Control Plan 2012 – Part B Section 4 – Multi Dwelling Housing – with regards to waste management, landscaped area, acoustic privacy, building separation, car parking.

7. The proposal does not comply and is inconsistent with the outcomes of The Hills Development Control Plan 2012 – Part C Section 1 – Parking.

HOW COMMUNITY VIEWS WERE TAKEN INTO ACCOUNT IN MAKING THE DECISION The development application was notified and two (2) submissions were received. The issues raised were discussed in the report.
