MINUTES of the duly convened Ordinary Meeting of The Hills Shire Council held in the Council Chambers on 13 March 2018. This is Page 10 of the Minutes of the Ordinary Meeting of The Hills Shire Council held on 13 March 2018. The press and public are excluded from the proceedings of Closed Council in respect of Items 14 and 15 in accordance with the relevant Clauses of Section 10A, Clause 2 of the Local Government Act, 1993, as detailed in the above table.

The Council withholds access to Items 14 and 15 in accordance with the above table and Section 11(2) of the Local Government Act. A Deed of Release and Request document notifying the Registrar General of the proposed acquisitions is authorized for execution under Seal.

ITEM-2 NOTICE OF MOTION – REVIEW OF THE CODE OF

This report recommends that Council support the establishment of a Hills Design Review Commission for the Bella Vista, Kellyville and Showground Station areas, in accordance with the draft terms of reference, and that the CEO be empowered to appoint members to the commission. It is further recommended that the Council refer the planning proposal to the Department of Planning and Environment to determine the transition to ensure that development in the areas does not require a plan review by two commissions. The establishment of the Design Review Board follows the completion of the Bella Vista, Kellyville and Showground Station sites in December 2017.

As part of the amendments to the Local Environment Plan 2012, a panel of three (3) or more people, approved by the NSW Government Architect, must review development taller than 21 meters or six (6) storeys. The Norwegian Architect's Office has indicated that it will support a Design Review Panel where the members have significant experience in a relevant design area such as architecture, urban design, landscape design or cultural heritage. These criteria, together with the specified issues for consideration and operational arrangements, are contained in the draft terms of reference.

The introduction of the new design review requirements for development in the Bella Vista, Kellyville and Showground station areas overlaps the existing Design Excellence requirements in the LEP 2012. The draft plan as recommended will ensure that a building proposed in the Bella Vista, Kellyville and Showground Precincts do not trigger referral to either panel.

RESULT: 5 A connected and supported community with access to a range of services and facilities that contribute to health and well-being. The purpose of this report is to appoint additional members to fill current vacancies in three (3) of the Board's Consultative Committees in accordance with their terms of reference. The report recommends accepting two additional members to the Bushland Conservation Committee, one additional member to the Heritage Park Advisory Committee and the two representatives of the Castle Hill & Hills District Agricultural Society to be appointed to the Castle Hill Showground Advisory Committee.

There are a number of vacancies on the Bushland Conservation Committee and two nominations have been received by the Council. Heather's submission comments on her passion for the bush and the environment and she resides in the Hills Shire. Heather's nomination has been supported by the Bushland Conservation Committee through meeting minutes and two additional letters of support from committee members.

Vicky lives in The Hills Shire, volunteers with the Bella Vista Bushcare Group and also comments on her passion for environmental protection. Vicky's appointment has been supported by the Bushland Conservation Committee through meeting minutes and two further letters of support from committee members.

The Council agrees to advance the $45,000 Grant contribution (if required) with payment based on a progression claim arrangement as approved by the General Manager, and the funding is returned to the Council when received by the Hills District Athletic Club. The City will not contribute any further funding to this project if variations arise, and such costs must be funded by the Hills District Athletic Club. A policy should be developed to deal with requests from sport organizations and/or associations with access to grants to upgrade or improve existing resources of the Council, with a report to be presented to the Council in March 2018.

CURRENT STATUS: The Draft Community Facilities Capital Investment Policy is currently being prepared and will be reported to Council in May 2018. SUBJECT: NOTICE OF TRAFFIC RESTRICTION RESTRICTING RIGHT TURN VEHICLE MOVEMENT WRIGHTS ROAD ONTO WINDSOR ROAD, KELLYVILLE. The General Manager investigates and prepares a report to Council on the restriction of right turn vehicular movement from Wrights Road to Windsor Road, Kellyville.

CURRENT STATUS: Traffic counts at the intersection have been conducted to enable the preparation of the Traffic Management Plan (TMP). The TMP has been submitted to the RMS for approval and the proposed right turn restriction has been referred to the Local Traffic Committee. Include a local provision, similar to that proposed for the Castle Hill North site, which provides a floor space ratio 'bonus' of 20% where key site outcomes are provided (site amalgamation, 7.5m setback rear to Garthowen Crescent, pedestrian link through site, sensitive response to neighboring heritage element and vehicular link through site for residents at basement level).

Council requests additional information from the proponent as required by Council and the gateway provision (overshadowing analysis, urban design concept plan, transport and access report/traffic analysis and heritage impact assessment). The Council undertakes discussions with the proponent in relation to the preparation of a draft Voluntary Planning Agreement which will decide how the proponent will address the increased demand for local infrastructure that the proposed increase in.

QUESTIONS WITHOUT NOTICE COMMUNITY FORUM

Mr Libbesson of North Rocks said he fully supported the Mayor's minutes on the IHAP and the Council's objection to it. He went on to comment on the previous statement that the Council is the custodian of the Shire and believes that landowners are the owners of the Shire, giving Councilors the ability to make decisions that suit all residents. Mr Libbesson, who has lived in the Shire for 40 years, has noticed a change in our visual appeal and has seen structures more suited to World War 2.

Why is the Council in exercising its retention rights and within the various plans unable to protect our visual facilities as this is important to our community. Mr Libbesson also objected to the proliferation of dual occupancy being built with incentive approaches where areas will end up in small enclaves where roads will become blocked and services will become congested. What is the Council doing to ensure that those who want to develop the potential of their land pay so that the rest of the community does not?

Mr. Libbesson further mentioned that he was satisfied with the Council's services but was disappointed when he filed a DA for the extension. He has been asked to prepare a floor plan for what he intends to do, but it appears that the other applicants must do so. Residents do not know what they are up against as there is no outline plan and have further asked if the council will take this as a planning request for applicants to provide full details of what they intend to do and to check whether the semi-detached houses will become four-sided or not occupied .

The General Manager advised that the visual amenity is included in the Council's development control plans. Many of the Council's controls are overridden by state policy and the state policy under the Metropolitan Plan is really to house several million people in the Sydney Basin over the next 20-30 years, so Council has development standards that are overridden by state development standards to increase density on us, to which the Council cannot object. The council can provide a plan and side drawings of the property, but residential floor plans are regulated and not a public document.
