ITEM-1 CONFIRMATION OF MINUTES
RESOLUTION
The Minutes of the Development Assessment Unit Meeting of Council held on 24 March 2015 be confirmed.
ITEM-2 DA NO. 725/2015/HB - ANIMAL BOARDING ESTABLISHMENT FOR 60 DOGS - LOT 7 DP 32141 NO. 16 PITT TOWN ROAD, KENTHURST
RESOLUTION
The application is recommended for refusal on the following grounds:
1. The proposed development is inconsistent with the objectives of the RU6 Rural Transition zone under The Hills Local Environmental Plan 2012 resulting in a conflict with adjoining land uses (Section 79C(1)(a)(i) of the NSW Environmental Planning and Assessment Act, 1979).
2. The proposed development is inconsistent with the aims and objectives of The Hills DCP Part B Section 1 – Rural. The development is inappropriately located within close proximity to neighbouring dwellings and results in a conflict between land uses (Section 79C(1)(a)(iii) of the NSW Environmental Planning and Assessment Act, 1979).
PAGE 2 3. The proposal will result in adverse noise impacts and does not comply with the NSW Industrial Noise Policy. The noise emitted from barking dogs will not comply with the night time noise criteria of 30dB(A) for this site nor does the proposal meet the offensive noise test under the EPA Guide for Local Government (Section 79C 1(b) of the NSW Environmental Planning and Assessment Act, 1979).
4. The site is not suitable for a development of this scale and intensity due to its proximity to neighbouring dwellings (Section 79C 1(c) of the NSW Environmental Planning and Assessment Act 1979).
NB: A late submission from the owner was tabled at the meeting to reduce the number of dogs from 60 to 30 and to reduce the number of yards from four to two and to change their location.
The DAU considered that, even allowing for these amendments, it has not been substantiated that the treatment to the kennel is adequate to meet the Industrial Noise Policy criteria for night time or the offensive noise test. Further it is not demonstrated that the proposal will meet the offensive noise test with respect to noise from the dogs in the yards during the daytime.
ITEM-3 DA NO. 721/2015/MA - AN INGROUND SWIMMING POOL, DECK, RETAINING WALL AND PRIVACY SCREEN - LOT 49 DP 232705 - 9 ATTUNGA STREET, BAULKHAM HILLS
RESOLUTION
The application be approved subject to conditions as set out in the report.
NB: A further submission from an adjoining property owner was tabled and discussed at the meeting.

RESOLUTION
The application be approved subject to conditions as set out in the report with an additional condition provided as follows:
6A. Safety Fencing
Should the Applicant/Muirfield Golf Pty Ltd determine an alternate strategy to mitigate risk from mis-hit golf balls to their satisfaction and to the satisfaction of effected residents, then the Safety Fencing shall not be required.
