An A c t to authorize the Granting of Leases for Mineral Purposes to certain Lessees whose Applications for Renewal have not been made within the time reqtcired by Law in that behaZA and far other purposes.

HEREAS
the lessees of the Crown mentioned in the Schedule Preamble.W
hereto have applied for renewals of the leases mentioned in the said Schedule and set opposite te their rcspcctive names, but such applications wcre not made within the time in that behalf limited by the Act and Regulations imder which such leases were issued ; but it is expedient, ncverthclcl;~, that renewed leases should be granted to such lessees in the same manner as if their applica- tions for renewal had been duly madc-l3e it therefore Enacted, by the Governor of the , Province of South Australia, by and with thc advice and consent of the Legislative Council and House of Assembly of the said Province, in this present Parliament asselnbled, as follows :1. The lessees of the Crown mentioned in the First Schedule plidationof applica- tlons for renewal ef
hereto, and their assigns, shall respectively be entitled to a renewal of the leases of the sections. respectively set opposite to their res- pective names in the First Schedulc hereto, upon the terms, and subject to the payment of the fines and rents, and to the observance and performance of the covenants and conditions affixed and per- taining thereto by law, in such and the like manncr as if the appli- cations heretofore made for such renewals had severally been made at the time and in manner prescribed by the Act and Regulations under which such leases were issued; and

to the acquisition of such renewed leases may be done and effected before the expiration of the several terms of such leases in such and the same manner as if such applications respectively had been duly made.

If the rent payable under any lease granted for mining purposespayment of rent.
(not being gold mining purposes) be not paid on or before the day whereon the same is made payable by such lease, a penalty of Ten Pounds per centurn shall be added to such rent; and if such rent continues unpaid for the space of one calendar month, a penalty of Twenty Pounds per centum shall be added; and if the said rent and penalty be not paid within one month after such first month, the same may be recoverable by the Commissioner of Crown Lands by action in any Court of competent jurisdiction, and the lease on which such rent and penalty continues unpaid shall be absolutely forfeited: Provided nevertheless, that it shall be lawful for the Governor in Council to waive such forfeiture upon payment of the rent and penalty, or upon such other terms as may be deemed expedient: Provided also, that nothing herein contained shall affect any lease of lands in the Northern Territory granted or here- after to be granted for mining purposes.
