REAL PROPERTY (COMMONWEALTH DEFENCE NOTIFICATION) ACT 1929-1974

An Act to Provide for the Registration, in the Registry of Titles and on the Certificate of Title concerned, of Notifications pursuant to tlie Provisions of the Commonwealth · Defence Acts and Proclamations thereunder

[Assented to 22 October, 1929]

BE IT ENACTED by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:-

1. Short title and construction. This Act may be cited as The Real Property (Commonwealth Defence Notification) Act of 1929, and shall be read as one with The Real Property Acts, 1861 to 1887, and The Real Property (Commonwealth Titles) Act of 1924.

Collective title conferred by Act of 1974, No. 72, s. 17 Sch.

2. Definitions. In this Act, unless the context otherwise requires, the following terms have the meanings respectively assigned to them, that is to say:-

"Defence Act" means the Commonwealth Defence Act 1903-1927 and any Act in amendment or substitution therefor;

"Defence Proclamation" means any Proclamation now or hereafter made or purporting to be made under the provisions of section one hundred and twenty-four of the Defence Act;

"Title" means any deed of grant, certificate of title, or other instrument of title to land under The Real Property Acts,

1861 to 1924.

3. (1) Registrar of Titles to register notification. The Registrar of Titles may register in the register book concerned, and on the title to any land affected by a Defence Proclamation, a notification of such Proclamation, in the form set out in the Schedule hereto or to the like effect. .

(2) Power of Registrar to call for and enforce production of title.

The Registrar of Titles may, by notice under his hand, call for and enforce the production to him by the registered proprietor or other person having control thereof of any title, for the purpose of endorsing such notification thereon.

Penalty for non-compliance with notice. Any person who, having received the notice as aforesaid of the Registrar of Titles, neglects or fails to produce to the Registrar of Titles the title concerned, shall be guilty of an offence and shall be liable to a penalty not exceeding $40.00.

4. Recovery of penalties. All penalties for offences against this Act may be recovered by complaint in a summary way under The Justices Acts, 1886 to 1924.
