An Act to approve and ratify agreements between the Commonwealth and the States of Australia relating to the reconstruction o f the fruit-growing industry throughout Austra~ia

[ASSENTED TO 23 SEPTEMBER, 19773 BE ET E N A C T E ~ by the Queen’s Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:-- 1. Short title. This Act may be cited as the Fruit-growing Recon- s ~ r u ~ t i o n ~ u ~ ~ ~ e m e ~ t a ~ A g r e e ~ e n t s Act 1 977.

2. Approval of agreements. ( 1 ) The agreement set out in the sched- ule is approved and ratified.

(2) The agreement made by exchange of letters on behalf o f the Commonwealth and the State of Queens~and that the 1972-1974 Fruit- growing Reconstruction Agreement should have effect and be deemed to have had effect on and from 1 January 1976 as if varied in the following respects-

(a) in clause 7-omit the expression “the thirty-first day of December 1975” and subs~itute the expression “the thirty- first day of December 1976”;

(b) in paragraph 3.1 of the Schedule-omit the expression “30 June 1976” and substitute the expression “30 June 1977”, is approved and ratified.

(3) The agreement made by exchange of letters on behalf of the Commonwealth and the State that the 1972- 1976 Fruit-growing Recon- s ~ r ~ c t i o n Agreement be varied in the following respect-

a ~ e e m e n t set out in Schedule 2 to that Act and by the agreement set out in the schedule to this Act.

(2) In this Act the expression “the 1972-1976 Fruit-growing Recon- struction Agreement” means the agreement referred to in subsection (I}

as varied by the agreement approved and ratified in section 2 (2).

THIS A G ~ E E ~ E N T is made the Second day of December One thousand nine hundred and seventy-four between THE COMMON- WEALTH OF A U S T ~ ~ I A of the first part, THE STATE OF NEW S O ~ T H WALES of the second part, THE STATE OF VICTORIA of the third part, THE STATE OF QUEENSLAND of the fourth part, THE STATE OF SOUTH AUSTRALIA of the fifth part, THE STATE OF WESTERN AUSTRALIA of the sixth part, and THE STATE OF TASMANIA of the seventh part and is a further supplemental agreement to the agreement in relation to the provision of financial assistance for persons engaged in fmit-growing industries throughout Austra~ia known as the 1972- 1973 F~it-Growing Reconst~ction Agreement and con- stituted by the agreement that was approved by the States ant^ (Fruit-

~ c ~ n s t r u c t i o n ~ Act 1972 d was made the second day of N ~ v e m b e r 1972 as varied by the a ement that was approved by the

~ t u t ~ ~ ~ r ~ n t s ( F r u i t - g ~ ~ ~ i n g ~ ~ c ~ n s t r ~ ~ t i ~ n ) Act I973 and was made the twenty-fourth day of November 1973 (which agreements are in this agreement respectively referred to as “the Principal Agreement” and

“the First Supplemental Agreement” and together as “the Revised Agreement 99).

WHEREAS-

(A) the parties are desirous of extending further the financial assistance to be provided under the Revised Agreement and of varying certain of the provisions of the Revised Agree- ment; and

(€3) the Australian Parliament will be requested to approve this

agreement and to authorize the grant of financial assistance to the States in accordance with the provisions of the Revised Agreement as varied by this agreement:

NOW IT IS HEREBY AGREED as follows-

2. ~ o m m e n ~ e m e n t of A ~ ~ e e m e ~ t , Upon being approved by the Australian Parliament this agreement shall be deemed to have com- menced on the first day of July 1974 so that the Revised Agreement shall be regarded as having been varied on that date and as providing for and giving effect to acts done on and from that date as if it had been so varied.

The Revised Agreement as varied by this agreement shall be construed as if this agreement were incorporated in and formed part of the Revised Agreement and so that, except where the context otherwise requires, references in the Revised ~ g r e e m e n t to the Principal Agreement or to the Principal Agreement as varied by the First Supplemental Agreement were references to the Revised Agreement as varied by and incorporating the p r o v i ~ i ~ ~ s of this a ~ e e ~ e n t ,

~ ~ t e r ~ r e t a ~ ~ o n . Except where the contrary intention appears, expressions used in this agreement that are expressions to which mean- ings are attributed in the Principal Agreement have in this agreement the respect~ve meanings so attributed to them.

~greement as varied by the First Supplemental Agreement is varied by deleting the date “the thirtieth day of June, 1974” and inserting in its place the date “the thirty-first day of December, 1975”.

6. A ~ e n d m e ~ ~ s of Schedule. ( 1 ) The Schedule to the Principal Agreement is amended as follows:

(a) by deleting from ~ a r a g r a p ~ 3.1 as varied by the First Sup- plemental Agreement the date “3 1 October 1974” and insert- ing in its place the date “30 June 1976”;

(b) by deleting from p a r a g r a ~ ~ 3.1 the sentence that was added by paragraph (f) of sub-clause 5 (1) of the First Supplemental Agreement.

(2) The amendment made by paragraph (b) of sub-clause (1) of this clause shall be deemed to have taken effect on the fifth day of April

1974.

7. ~ o n ~ r ~ a t i o n and Title of Agreement. The Revised Agreement as varied by this agreement is confirmed and, as so varied, shall be known as ‘‘the 1972- 1974 Fruit-grow in^ Reconstru~tion Agreement”.
