FILE NO: DA04/1547 Pt1 SUMMARY OF REPORT:
The Cudgen Headland Surf Life Saving Club ("the Surf Club") has lodged a Development Application for additions and alterations to the Surf Club building at Marine Parade, Kingscliff. The building is constructed on an area leased by the Surf Club from the Crown, comprising Lots 459 and 471 in DP 755701, known as Crown Reserve 93876.
At a Council Reserves Trust meeting held on 9 March 2005, the Trust resolved to advise the Department of Lands that it supported the granting of consent to the lodgement of the application by the Surf Club.
The report received on 9 March referred to an encroachment by part of the existing Surf Club building onto the adjoining Crown Reserve 1001008, reserved for Public Recreation and Coastal Environment Protection. This encroachment has raised concerns with the Department of Lands as the encroaching area is outside the area leased by the Surf Club and is used as licensed premises.
The Crown Lands Act precludes the use of land reserved for Public Recreation and Coastal Environment Protection to be leased for licensed premises.
RECOMMENDATION:
That the Tweed Coast Reserves Trust approves:-
1. The excision of that part of Crown Reserve 1001008 where there are existing encroachments by the Cudgen Headland Surf Life Saving Club building, and

2. The revocation of the excised land from Crown Reserve 1001008 as being reserved for Public Recreation and Coastal Environment Protection; and
3. The reservation of the excised land from Crown Reserve 1001008 as being for Future Public Requirements.

REPORT:
The reservation of Crown Land for "Future Public Requirements" enables the Crown to enter into tenure agreements with sporting clubs, such as the Cudgen Headland Surf Life Saving Club, where the Clubs are able to include licensed premises in their club buildings.
The Department of Lands has been given Ministerial approval to excise part of Crown Reserve 1001008 where the Surf Club's building encroaches and to revoke its reservation for Public Recreation and Coastal Environment Protection, with a subsequent reservation for Future Public Requirements.
The excised land will then form part of the area leased by the Surf Club from the Crown.
Attached to this report is a letter from the Chairman of the Surf Club enclosing a letter to Neville Newell discussing the excision and revocation of the area encroached by the Surf Club's building, together with the report received by the Trust on 9 March 2005.
It is to be noted that a letter has been sent to the Club advising that the Development Application requires owner’s consent from the Crown and the lease held by them is with the Crown and not Tweed Shire Council.
