Terms and Conditions 891 Spokes-People Cycling Team Promotion

This document sets out the terms of participation in 891 ABC Adelaide’s “891 Cycling Team”

competition (the “Competition”).

1. The promoter of this Competition is the Australian Broadcasting Corporation (the

Promoter”) (ABN 524 292 78345), 700 Harris Street, Ultimo, New South Wales, Australia.

2. Entry to the Competition is open to residents of South Australia. An entrant’s

residential postcode will determine whether the entrant resides in SA for the purposes of the Competition. An entrant must be an individual and not a company or

organisation. An Entrant must have their own mechanically sound bicycle and puncture kit and must have an adequate level of fitness to participate in the prize.

Employees of the Promoter and any person associated with the Competition, and any organisation or individual associated with the provision of the prize(s), are not eligible to enter.

3. If an entrant is under 18 years of age, they must get the permission of a parent or guardian before entering this Competition.

4. Each entry must be entered in accordance with these Terms and Conditions. By entering the Competition, each entrant agrees to be bound by these Terms and Conditions. The Promoter may in its discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions. All relevant instructions on the Promoter’s website (if any) form part of these Terms and Conditions.

5. Entry into the Competition is free.

6. The Competition opens at 6.00am CST on Wednesday 24 August 2011 and closes at 6.00pm CST on Friday 23 September 2011 (“Competition Period”). Any entry received after the expiry of the Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.

7. To enter the Competition, you must:

(i) tell us in 30 words or less, how you will benefit by taking part in the 891 cycling team promotion (“Work”); and

(ii) complete the entry form (available at

abc.net.au/adelaide/competitions (“Website”)); and

(iii) submit your Work accompanied by the entry form and your name, address, email address and telephone number via the Website or by post to:

8. Each entry must include your name, address, email and a daytime telephone contact number or it will be deemed invalid.

9. You must not enter the Competition more than once.

10. All entries become the property of the Promoter and will not be returned to the entrants.

11. By submitting your Work to the Promoter, you grant the Promoter and its licensees and assignees a non-exclusive licence to exercise all rights in perpetuity throughout the world in your Work and all other material provided by you to the Promoter pursuant to this Competition at any time.

12. Without limiting the rights granted to the Promoter under clause 11, you specifically agree that clause 11 grants to the Promoter the non-exclusive right to communicate your Work in whole or in part to the public throughout the world on any media

platform and you grant to the Promoter all associated rights necessary to exercise the above rights.

13. Your Work may be edited or adapted at any time by the Promoter in order to:

(i) meet the requirements of broadcasting authorities;

(ii) adhere to any requirements of the ABC Editorial Policies (available at www.abc.net.au/corp );

(iii) ensure your Work meets any legal or classification requirements or to avoid any breach of law;

(iv) use your Work for promotional purposes; and/or (v) use your Work on other ABC media platforms.

14. There will be seven prize winners. The seven entrants whose Works are judged by the Promoter’s panel of judges to be the best, most original and creative will each win the prize (“Prize Winner”). Chance plays no part in determining the Prize Winners.

15. Each Prize Winner will receive:

entry into the Tour Down Under Community Challenge ride on Friday 20 January 2012, valued between $80 and $145;

entry into Ride Like Crazy on Sunday 15 January 2012, valued at $110 entry into Amy’s Ride on Sunday 6 November 2011, valued between $15 and

Bicycle SA Membership (12 months) valued at $75

opportunity to join exclusive training rides in the lead up to the Ride Like Crazy and Community Challenge rides;

An 891 Spokes-People team cycling shirt; and .

16. No component of the prize can be transferred or redeemed for cash. In the event that any of the prizes become unavailable, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.

17. You warrant that:

(i) all details provided with your entry are true and accurate;

(ii) you have all necessary rights and licences to grant the rights set out in these Terms and Conditions;

(iii) your Work is your original work and has not been previously communicated to the public;

(iv) the exercise of the rights granted to the Promoter in these Terms and Conditions will not infringe the rights of any third parties;

and you will indemnify the Promoter against any loss or damage resulting from any breach of these warranties.

18. You acknowledge that the Promoter is under no obligation to exercise any of the rights granted to it by these Terms and Conditions and any communication of your Work to the public by the Promoter is at the complete discretion of the Promoter.

19. The Prize Winners are responsible for all costs associated with using the prize including all travel costs associated with your participation in the prize, costs with respect to food and beverages, medical costs, insurance costs, and spending money.

20. You acknowledge that to be eligible to win the prize, you must:

(i) have your own mechanically sound bicycle and puncture kit;

(ii) have an adequate level of fitness to participate in the prize;

(iii) agree to participate in interviews to be published on-air and online with 891 ABC Adelaide;

(iv) agree to write short diary entries when requested by the Promoter about your involvement in the prize, which will be published on the 891 ABC Adelaide website;

(v) agree to have your photograph published on the 891 ABC Adelaide website;

(vi) be available to participate in up to two training rides;

(vii) be available to participate in Amy’s Ride;

(viii) be available to participate in Ride Like Crazy;

(ix) be available to participate in the Tour Down Under Community Challenge Ride;

(x) register with the Cancer Council SA’s fundraising website; and (xi) sign a participant release form.

21. The Promoter reserves the right, in its absolute discretion, to disqualify any Prize Winner that does not comply with the requirements in Clause 19 or does not comply with any competition rules and regulations, road rules, training information,

instructions and decisions made or given by the Promoter or event organisers.

22. You agree that the Promoter may use your entry and any personal details provided to the Promoter for any promotional, marketing and publicity purposes of the Promoter in any media without notice and without any fee being paid to you, subject to the ABC’s Privacy Policy available at http://www.abc.net.au/privacy.htm.

23. Decisions of the Promoter and its panel of judges are final and will be binding on each person who enters the Competition and no correspondence will be entered into.

The name of each prize winner and the city/town/suburb in which he/she lives will be

announced on 891 ABC Adelaide on Wednesday 12 October 2011 and posted on the Website.

24. If there is any event that prevents or hinders the Promoter’s conduct of the

Competition or the Promoter’s ability to deliver the prize/s to the Prize Winner/s of the Competition, the Promoter may, in its discretion, cancel the Competition and

recommence it at another time under the same conditions or select another winner.

25. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of this

Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

26. To the full extent permitted by the law, the Promoter is not liable for any misadventure, death, accident, injury, damages, expenses, or loss whatsoever (whether direct or consequential) to persons or property as a result of any person entering into the Competition or accepting or using any prize, including without limitation non-receipt of any prize or damage to any prize in transit.
