Tenders for PlIllA 2 &I persons whose tenders for runs have been dready received
liXhl0 to l'ene ancl opeiiecl by the Governnient of New South Wales or the Govern- ment of Queensland under the 12th ancl 13th sections of the hereinbefore recited orcler in Council d a h d 9th March 1547 relating to runs i n the Colony of Queensland and of which such persons shall be entitled t o a lease under the said 12th section of such Orcler in Council shall be liable until such lease shall have been granted t o pay and shall pay rent on such tenclers as if such lease had been graiitcd such rent t o be the same and t o be payable at the same time and manner specified in this Act for leases ancl shall be subject t o forfeiture for non-payment of rent in manner mentioned in the Unoccqiecl Crown Lancls Occqiiltion Act of 1860 not- withstanding t,hat such tenclers may not have been finally reported on but no such party shall be called upon t o pay more than one year's rent for eaclirun till the said tenders shall have been accepted and reported on Provided always t h t in the event of its appearing that any such tender comprises land leased or uncler proinise of lease or applied for under any previous ten- der ailcl that such tender has ultimately-been declined then and in every such case ihe rent paid on such land as doresaid shall be returned i o the parties or party whose tenders or tender shall have been so declined
