Department of Forestry Brisbane, 18th June, 1987 HIS Excellency the Governor, acting by and with the advice of·the Executive Council and in pursuance of the provisions of the Timber Utilization and Marketing Act 1987, has been pleased to make the following regulations.

PART I-PRELIMINARY

1. Short title. These regulations may be cited as the Timber Utilization and Marketing Regulations 1987.

2. Commencement. These regulations shall commence on the first day of July, 1987.

3. Repeal. "The Timber Users' Protection Regulations of 1949"

are repealed.

4. Arrangement: These regulations are arranged as follows- PART I-PRELIMINARY (regs. 1-8);

PART II-PRESCRIBED ARTICLES AND CLASSES OF TIMBER (regs:"9-11);

PART III-MOISTURE CONTENT OF TIMBER (regs. 12-13);

5. Interpretation. In these regulations unless the contrary intention appears-

" Act" means the Timber Utilization and Marketing Act 1987;

"Australian Standard" means a standard rule, code or specification of the Standards Association of Australia.

6. Forms. (1) The forms set forth in Schedule 1 hereto shall be used for the purposes for which they are respectively applicable.

(2) A form prescribed by these regulations shall be completed in accordance with such directions as are specified in the prescribed form.

(3) The following forms shall be used for the purposes set out against them respectively:-

(a) Form !-Application for Approval of Preservative Treatment(s);

(b)

Form 2-Application for Authorization to Use Approved Preservative Treatment(s) and Registration of Brand;

(c) Form 3-Application for Registration of Brand (Imported Timber);

(d) Form 4-Application for Registration of Brand (Remilled Timber);

(e) Form 5-Application for Renewal of Authorization(s) and Registration of Brand(s);

(f)

Form 6-Application for Transfer of Authorization(s) and Registration of Brand(s);

(g) Form ?-Application for Recognition of Brand(s);

(h) Form 8-Notice of Seizure of Timber or Article.

7. Fees. The fees set forth in Schedule 2 hereto shall be the fees payable in respect of the matters specified therein.

8. Adoption and proof of standards.

A reference in these

regulations to any standard rule, code or specification shall be taken to

be a reference to any document that supersedes that document or to

any document that supersedes a previous superseding document.

(2) A certificate purporting to be under the hand of the person for the time being occupying the position of Director, Division ofTechnical Services (Research and Utilization) Department of Forestry or a person for the time being performing the duties of that person stating that a standard rule, code or specification was in force on a particular date or during a particular period shall be prima facie evidence of the matters stated in the certificate and, in the absence of evidence to the contrary, shall be conclusive evidence of those matters.

PART II-PRESCRIBED ARTICLES AND CLASSES OF TIMBER 9. Prescribed articles. For the purposes of section 11 (3) and section 13 (3) of the Act, the articles set forth in Schedule 3 hereto shall be the prescribed articles or the articles of a prescribed class or description.

10. Moisture content of prescribed classes of milled timber. For the purposes of section 34 (3) of the Act, the classes of milled timber set forth in Schedule 4 hereto shall be the prescribed classes of milled timber.

11. Timber not included in definition of framing timber. For the purposes of the definition of "framing timber" in section 6 (1) of the Act, the classes of timber set forth in Schedule 5 hereto shall be the prescribed classes of timber which are not included in the definition.

PART III-MOISTURE CONTENT OF TIMBER

12. Method of determining moisture content of timber. For the purposes of Part V of the Act, the prescribed manner for determining moisture content of timber shall be-

( a) in the case of veneer, plywood or blackboard-the oven- drying method for determining moisture content specified in Australian Standard 2098.1-1977, Moisture Content of Veneer and Plywood;

(b) in the case of particleboard-the method for determining moisture content specified in Australian Standard 1859- 1976, Flat Pressed Particleboard;

(c) in the case of timber which contains volatile preservatives or residual non-aqueous preservative solvent-the distillation method (method c) specified in the American Society for Testing and Materials standard method D2016-65, Standard

(d) in all other cases either-

(i) the oven-drying method for determining moisture content specified in Australian Standard 1080, Part 1-1972, Methods of Test for Timber Moisture Content;

or, except in the case of timber which contains electrically conductive preservative or fire retardent chemicals- (ii) by electrical moisture meter specified in Australian

Standard 1080, Part 1-1972, Methods ofTest for Timber

Moisture Content.

13. Standards for moisture content of timber. For the purposes of- (a) section

33 (1)

of the Act, the standards set forth in Schedule 6 shall be the prescribed standards specifying moisture content.

PART IV-APPEAL

14. Time and manner of appeal. For the purposes of section 37

(1)

of the Act, an appeal to the Minister shall-

( a) be in writing;

(b) set out the reasons for the appeal;

and

(c) be lodged with the Conservator of Forests within

days of the notice of refusal, cancellation or suspension as the case may be or of the imposition of the condition.

PART V-MISCELLANEOUS

15. H levels.

(1)

The H levels assigned by the Conservator of Forests under the Act to timber treated by means of an approved preservative treatment shall be-

(a)

H1;

(b) H3;

(c)

H5;

and (d) H6.

(2) In respect of each H level, the conditions set forth in Schedule

7 shall be the conditions in which it is appropriate to use timber to

which the relevant H level has been assigned.
