SUMMARY OF REPORT:

At its meeting held on 18 May 2017, Council received a report relating to the repair of the Anchorage Island Boardwalk, and it was noted that a grant application had been submitted to the State Government for $685,000 to replace the boardwalk with a composite fibre superstructure.

In August 2017, Council received confirmation from Roads and Maritime Services that the funding had been approved and Council has been preparing the necessary documentation and approvals for the works to commence.

The boardwalk is located on Crown land, and a licence application has been lodged with the NSW Department of Industry, Lands and Forestry (DILF) for the proposed works. As part of the boardwalk is within Crown Reserve 98040 for Public Recreation, being Lot 2 DP 820682, administered by the Tweed Reserves Trust, DILF are seeking concurrence from the Tweed Reserves Trust to the granting of a licence for the proposed works.

To allow the repair works to proceed with the State Government funding, it is recommended that the Trust approves the granting of a licence by DILF to Council for the proposed works.

That the Tweed Reserves Trust provides concurrence to the granting of a licence to Tweed Shire Council for the repair works of the Anchorage Island Boardwalk within Lot 2 DP 820682 being Crown Reserve 98040 for Public Recreation.

REPORT:

At its meeting held on 18 May 2017, Council received a report relating to the repair of the Anchorage Island Boardwalk, and it was noted that a grant application had been submitted to the State Government for $685,000 to replace the boardwalk with a composite fibre superstructure.

Part of the boardwalk is within Lot 696 DP 47059, Crown administered Crown land and part of the boardwalk is within Crown Reserve 98040 for Public Recreation, being Lot 2 DP 820682, administered by the Tweed Reserves Trust. DILF are seeking concurrence from the Trust to the granting of a licence for the proposed works within Lot 2, Crown Reserve 98040.

1. To provide concurrence to the granting of a licence from NSW Department of Industry, Lands and Forestry to Council to occupy the Crown land for the proposed repair works to the Anchorage Island Boardwalk.

2. To not provide concurrence to the granting of a licence from NSW Department of Industry, Lands and Forestry to Council to occupy the Crown land for the proposed repair works to the Anchorage Island Boardwalk.

CONCLUSION:

As Council has obtained the funds for the proposed works, it is recommended that the Trust provides concurrence for the granting of a licence to Council to occupy the affected Crown land for the proposed works.

COUNCIL IMPLICATIONS:

a. Policy:

Corporate Policy Not Applicable.

b. Budget/Long Term Financial Plan:

No direct financial implications arise, as the proposed works are funded by Active Transport Funding 2017/2018.

c. Legal:

This report satisfies the legal implications of the granting of the licence by DILF.

There is no necessity for community engagement as this report relates to a statutory requirement for the occupation of Crown Land for the provision of public infrastructure.

3 [CNR-RT] Car Park Upgrade - Ray Pascoe Park, Tweed Heads

SUMMARY OF REPORT:

Tweed Shire Council is proposing to undertake maintenance works at the Kennedy Drive boat ramp car park located at Ray Pascoe Park, Tweed Heads. The land on which the works are proposed is described as Lot 7044 DP 93975 which forms part of the Tweed Reserve R89958.

The existing car park is currently in a dilapidated state having a generally poor surface condition with large areas of standing water as a result of insufficient drainage. This car park is heavily used in association with the boat ramp. As such, funds have been made available by the NSW Roads and Maritime Services to upgrade the site.

The proposed works would enhance the efficiency of operation at the Kennedy Drive boat ramp as well as provide minor improvements to public safety at the site, principally at the intersection of the boat ramp approach and cycleway. Additionally, the proposed works would also upgrade the stormwater drainage to prevent ponding of surface water and resurface a significant area of the site where the condition of the surface is considered to be poor/very poor.

The subject site is identified as Council administered Crown Land which is managed by the Tweed Reserves Trust. Accordingly, the proposed works necessitate approval from the Trust to issue a licence for temporary access onto the site for undertaking the proposed works. It is therefore recommended that the Tweed Reserves Trust provide approval to issue a licence for temporary access onto Lot 7044 DP 93975 to undertake the proposed

That the Tweed Reserves Trust approve issuing a licence for temporary access onto Lot 7044 DP 93975 as manager of the land to undertake the proposed car park upgrade works.

In summary, the proposed works would involve:

• Relocate existing parking bollards

• Relocate existing bin

• Box out and re-profile degraded car park area

• Construct new field inlet pit to collect surface water runoff and connect to existing stormwater line

• Construct compacted gravel trailer parking spaces

• Install cycleway chicanes at intersection with boat ramp

• Undertake line marking

• Stabilise all disturbed surfaces.

The subject site is identified as Council administered Crown Land which is managed by the Tweed Reserves Trust. Accordingly, the proposed works necessitate approval from the trust to issue a licence for temporary access onto the site for undertaking the proposed works.

The works have been assessed as Exempt Development under Part 3, Division 12 (Parks and other public reserves), Clause 66 (Exempt development) of the State Environmental Planning Policy (Infrastructure) 2007 (ISEPP). An environmental assessment of the proposal has been prepared by Council’s Design Unit Environmental Scientists.

At present, Council is required to complete the works in December, conflicting with the peak recreational boating season and school holidays. This is obviously not considered to be ideal, however, it is a requirement of the funding program that works be completed prior to January 2018. Council, however, has requested an extension of time variation from the funding body (RMS) to enable the works to be completed following the school holidays in February of 2018. A decision upon this request is yet to be confirmed.

A community engagement program is proposed leading up to and during construction which would advise the public of the upcoming car park and boat ramp closure. In addition, onsite signage would also be utilised during the construction phase to inform visitors of the works and the location of alternate boat ramps which can be used during the closure period.

As the subject site is identified as being managed by the Tweed Reserves Trust, the proposed works necessitate an approval from the Trust for a licence to undertake the works at the site.

It is therefore recommended that the Tweed Reserves Trust provide approval to issue a licence for temporary access onto Lot 7044 DP 93975 to undertake the proposed car park upgrade works.

OPTIONS:

The options for consideration of the Tweed Reserves Trust are:

1. Provide approval as the manager and operator of Lot 7044 DP 93975 for issuing a licence for temporary access to the site to undertake the proposed works.

CONCLUSION:

This report provides an outline of a proposed project by Tweed Shire Council requesting an approval as the manager of Lot 7044 DP 93975 to issue a licence for temporary access to the site to undertake the proposed works.

b. Budget/Long Term Financial Plan:

The proposed works are being conducted under the Waterways Program and will be fully funded by an RMS grant.

Community engagement during the project would include notification in the Tweed Link, media releases, social media releases, onsite signage and letters to identified key stakeholders.
