For the purposes of this article, a person is not considered to hold a position of gain in the service of the Republic simply because he is the President, Prime Minister, Minister, Minister of State or Deputy Minister. If the office of the Chief Justice becomes vacant, or if the President is satisfied that the Chief Justice is unable by reason of absence, illness or any other cause to discharge the functions of his office, those functions shall, until another person fills that office has held, or until the Chief Justice has resumed his duties, as the case may be, shall be exercised by the second most senior judge of the Appellate Division. Notwithstanding the provisions of Article 94, if the President is satisfied that the number of the Judge of a Division of the Supreme Court should be provisionally increased, the President may appoint one or more duly qualified persons as Additional Judges of that Division. - a vision for a period of up to two years which he may determine himself, or, if he deems it necessary, he may require that a judge of the High Court Division sit for a temporary period in the Appellate Division as an ad hoc judge and such judge while so sitting shall exercise the same jurisdiction, powers and functions as a judge of the Appellate Division. The permanent seat of the Supreme Court shall be in the Capital, but sessions of the High Court Division may be held at such other place or places as the Chief Justice, with the approval of the President, may from time to time appoint.

A law declared by the Appellate Division is binding on the High Court Division, and a law declared by any of the Supreme Court Divisions is binding on all the courts subordinate to it. All authorities, executive and judicial, in the Republic work to assist the Supreme Court.

The High Court shall have superintendence and control over all courts 64 and tribunals subordinate to it. If the Supreme Court Division is convinced that a case pending in a Court subordinate to it involves a material question of law in relation to the interpretation of this Constitution, or on a point of general public interest, the determination of which is necessary for the disposal of the case, it shall withdraw the case from that court and may-. a) either dispose of the matter itself; or. b) determine the question of law and return the case to the court from which it was so withdrawn (or transfer it to another subordinate court) together with a copy of the judgment of the division on such question, and the court to which the case so returned or transferred, shall, on receipt thereof, proceed to dispose of the case in accordance with such judgment.

ELECTIONS

In the event of a vacancy in the office of President arising as a result of the expiration of his term of office, an election to fill the vacancy shall be held within the period of ninety to sixty days before the date of expiration of the term free:. The public accounts of the Republic shall be kept in such form and manner as the Auditor-General, with the approval of the President, may prescribe. The reports of the Auditor-General relating to the Reports of public accounts of the Republic shall be submitted to the President, who shall cause them to be submitted to Parliament.

Depending on the provisions of this Constitution, the Assembly may by law regulate the appointment and conditions of service of the person in the service of the Republic: With the exception of cases where this Constitution provides otherwise, every person in the service of the Republic shall hold office at the pleasure of the President.
