End-User License Agreement

This is a lic ense agree-ment ( “Agreeagree-ment”) between yo u and IDG Bo o ks Wo rldwide, Inc . ( “IDGB”) . By o pening the ac c o mpanying so ftware pac ket( s) , yo u ac kno wledge that yo u have read and ac c ept the fo llo wing terms and c o nditio ns. If yo u do no t agree and do no t want to be bo und by suc h terms and c o nditio ns, pro mptly return the Bo o k and the uno pened so ftware pac ket( s) to the plac e yo u o btained them fo r a full refund.
1. Lice nse Grant.IDGB grants to yo u ( either an individual o r entity) a no nexc lu-sive lic ense to use o ne c o py o f the enc lo sed so ftware pro gram( s) ( c o llec tively, the “So ftware”) so lely fo r yo ur o wn perso nal o r business purpo ses o n a single c o mputer ( whether a standard c o mputer o r a wo rkstatio n c o mpo nent o f a multiuser netwo rk) . The So ftware is in use o n a c o mputer when it is lo aded into tempo rary memo ry ( RAM) o r installed into permanent memo ry ( hard disk, CD-ROM, o r o ther sto rage devic e) . IDGB reserves all rights no t expressly granted herein.
2. Owne rship.IDGB is the o wner o f all right, title, and interest, inc luding c o py-right, in and to the c o mpilatio n o f the So ftware rec o rded o n the disk( s) o r CD-ROM ( “So ftware Media”) . Co pyright to the individual pro grams rec o rded o n the So ftware Media is o wned by the autho r o r o ther autho rized c o pyright o wner o f eac h pro gram. Ownership o f the So ftware and all pro prietary rights relating thereto remain with IDGB and its lic ensers.
3. Re strictions On Use and Transfe r.
(a) Yo u may o nly ( i) make o ne c o py o f the So ftware fo r bac kup o r arc hival purpo ses, o r ( ii) transfer the So ftware to a single hard disk, pro vided that yo u keep the o riginal fo r bac kup o r arc hival purpo ses. Yo u may no t ( i) rent o r lease the So ftware, ( ii) c o py o r repro duc e the So ftware thro ugh a LAN o r o ther netwo rk system o r thro ugh any c o mputer sub-sc riber system o r bulletin-bo ard system, o r ( iii) mo dify, adapt, o r c reate derivative wo rks based o n the So ftware.
4. Re strictions on Use of Individual Programs.Yo u must fo llo w the individual requirements and restric tio ns detailed fo r eac h individual pro gram in the Appendix o f this Bo o k. These limitatio ns are also c o ntained in the individual lic ense agreements rec o rded o n the So ftware Media. These limitatio ns may inc lude a requirement that after using the pro gram fo r a spec ified perio d o f time, the user must pay a registratio n fee o r disc o ntinue use. By o pening the So ftware pac ket( s) , yo u will be agreeing to abide by the lic enses and restric -tio ns fo r these individual pro grams that are detailed in the Appendix and o n the So ftware Media. No ne o f the material o n this So ftware Media o r listed in this Bo o k may ever be redistributed, in o riginal o r mo dified fo rm, fo r c o mmer-c ial purpo ses.
5. Limite d Warranty.
(a) IDGB warrants that the So ftware and So ftware Media are free fro m defec ts in materials and wo rkmanship under no rmal use fo r a perio d o f sixty ( 60) days fro m the date o f purc hase o f this Bo o k. If IDGB rec eives no tific atio n within the warranty perio d o f defec ts in materials o r wo rk-manship, IDGB will replac e the defec tive So ftware Media.
(b) IDGB AND THE AUTHOR OF THE BOOK DISCLAIM ALL OTHER WAR-RANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE, THE PROGRAMS, THE SOURCE CODE CONTAINED THEREIN, AND/ OR THE TECHNIQUES DESCRIBED IN THIS BOOK. IDGB DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFT-WARE WILL BE ERROR FREE.
(c) This limited warranty gives yo u spec ific legal rights, and yo u may have o ther rights that vary fro m jurisdic tio n to jurisdic tio n.
6. Re me die s.
(b) In no event shall IDGB o r the autho r be liable fo r any damages whatso ever (inc luding witho ut limitatio n damages fo r lo ss o f business pro fits, busi-ness interruptio n, lo ss o f busibusi-ness info rmatio n, o r any o ther pec uniary lo ss) arising fro m the use o f o r inability to use the Bo o k o r the So ftware, even if IDGB has been advised o f the po ssibility o f suc h damages.
(c) Bec ause so me jurisdic tio ns do no t allo w the exc lusio n o r limitatio n o f liability fo r c o nsequential o r inc idental damages, the abo ve limitatio n o r exc lusio n may no t apply to yo u.
7. U.S. Gove rnme nt Re stricte d Rights.Use, duplic atio n, o r disc lo sure o f the So ftware by the U.S. Go vernment is subjec t to restric tio ns stated in paragraph ( c ) ( 1) ( ii) o f the Rights in Tec hnic al Data and Co mputer So ftware c lause o f DFARS 252.227-7013, and in subparagraphs ( a) thro ugh ( d) o f the Co mmerc ial Co mputer — Restric ted Rights c lause at FAR 52.227-19, and in similar c lauses in the NASA FAR supplement, when applic able.
