DECREE OF THE MINISTER OF FORESTRY NO. 13.1/KPTS-II/2000 DATED NOVEMBER 6, 2000 CRITERIA AND STANDARDS FOR THE DISTRIBUTION AND

MARKETING OF FOREST PRODUCTS THE MINISTER OF FORESTRY,

Considering :

a. That article 2 paragraph (3) of government regulation no. 25/2000 stipulates that criteria and standards for the distribution and marketing of forest products are the authority of the government;

b. That in relation to the matter in point a above, it is necessary to stipulate a decree of the minister of forestry on criteria and standards for the distribution and marketing of forest products;

In view of :

1. Law no.5/1990 on the Conservation of biological resources and ecosystem 2. Law no.20/1997 on non-tax state revenue;

3. Law no. 23/1999 on the environmental management; 4. Law no. 22/1999 on the regional administration 5. Law no. 41/1999 on the forestry affairs;

6. Government Regulation no. 25/2000 on the authority of the central government and the authority of provinces as autonomous regions;

7. Presidential Decree no. 136/1999 on the status, task, organizational structures and working arrangements of ministries;

8. Presidential Decree no. 234/m/2000 on the establishment of the cabinet for the 1999-2004 period jo. Presidential Decree no. 289/M/2000;

To stipulate :

THE DECREE OF THE MINISTER OF FORESTRY ON CRITERIA AND STANDARDS FOR THE DISTRIBUTION AND MARKETING OF FOREST PRODUCTS

FIRSTLY :

Criteria and standards for the distribution and marketing of forest products shall be contained in the attachment to this decree.

SECONDLY:

The criteria and standards for the distribution and marketing of forest products as meant in first dictum shall : a. become guidelines of governors and regents /mayors in stipulating regional regulations;

b. constitute guidelines which must be executed by holders of licenses to utilize forest product, collect forest products and forest products processing industries in distributing and marketing forest products.

THIRDLY :

This decree shall come into force as from the of stipulation.

ATTACHMENT CRITERIA AND STANDARDS FOR THE DISTRIBUTION AND

MARKETING OF FOREST PRODUCTS

1 Report on cruising Results (LHC)

1. Timber cruising is executed before trees are felled 2. Timber cruising is

executed by corporate personnel qualified for and capable of identifying kids of trees and undertaking the measurement

1. Being executed not later than 2 years before trees are felled 2. The year of Annual Working Plans (RKT), tree numbers, kinds of trees, free height branches, diameter and volume are mentioned in LHC.

3. Executor of timber cruising are cruisers already passing timber cruising courses

4. Using LHC form of DKP.A.101 model

2 Making out of measuring book

1. Trees already felled are chopped into trunks and must be measured and tested

2. Regality seals and trunks numbers must be put on trees already felled

3. The measuring and test are executed by corporate personnel qualified for or capable of carrying out the measuring and test

1. Trunk number, block number, kid of timber , diameter, length and seal of corporate identity (TPP) are put every trunk

1. Timber trunk already measured and tested must be recorded in the measuring book which is made in the felling block

2. The measuring and test are done by personnel of PPKBRI

3 Making out of report on production (LHP)

1. The number of trunk, kinds and volume of timber production are mentioned

2. Timber having LHP comes from legitimate felling

3. LHP is made out by corporate personnel qualified for or capable of executing the measuring and tests

4. Standard model of LHP is

1. Being made for every ten-day period (1st up to 10th, 11th up to 20th and 21st up to 30th)

2. Being validated by officials validating LHP (P2LHP)

3. LHP form is registered by local fishery service

4. Using LHP form of DKP.A.102 model

1. The quantity of timber produced, used/carried/ sold and the remainder of timber stock are mentioned 2. Timber production is

based on legitimate LHP already approved, the transportation is based on transportation document issued

2. LMBK is made in forest base camps

5 Transportation of logs 1. Every log which is carried must be accompanied by certificates of legitimacy of forest products

(SKSHH)

2. Logs which are carried come from legitimate felling

3. logs to be carried must be checked by officers qualified or undertaking the measuring and test of logs

4. transportation of logs is not limited to territories of regencies/mayoralties/ provinces

1. SKSHH form is printed by Perum Peruri

2. SKSHH form consists of six sheets, the first and second sheets accompany timber which is carried

3. The validity period of SKSHH is 15 days at the maximum

4. Timber which is checked must be furnished by account of checking (BAP) as the basis for the issuance of SKSHH

5. SKSHH is issued by forestry officers having qualification as PPKBRI

6. SKSHH is valid nationwide

6. Transportation of processed timber

1. Every kind of processed timber which is carried must be accompanied by SKSHH

2. Processed timber to be carried must be checked by officers having

qualification as examiners or capable of undertaking the measuring and test of processed timber

3. Transportation of logs is not limited to territories of regencies/mayoralties/ provinces

1. SKSHH form is printed by Perum Peruri

2. Using SKSHH form printed by Perum Peruri

3. The checking of processed timber must be completed with BAP as the basis for the issuance of SKSHH

4. SKSHH is issued by forestry officers having qualification as PPKBRI

5. SKSHH form consists six-sheets, the first and second sheets accompany timber which is carried

6. SKSHH is valid for 15 days at the maximum

7 Monthly report on mutation of timber (LMK)

1. Every holder of license to process timber is obliged to make out LMK

2. Quantities of raw materials produced, production, used/carried/sold and the remainder of stocks of raw material and processed timber are mentioned. 3. The quantity of raw

materials received is based on legitimate carriage & transportation documents and the transportation is based on the issuance of legitimate transport documents

1. LMK is made at the end of months

2. Being reported to CDK/forestry services of regencies/

mayoralties

3. The receipt of raw materials must be accompanied by legitimate SKSHH

8. Distribution of non-timber forest products

1. Non-timber forest

products consist of rattan, roots, essential oil, fowl nests, animal and

vegetables coming from state forests

2. Forests royalties (PSDH) are paid

3. Legitimate transport documents must be used in the transportation of the products

1. Having licenses to collect non-timber forest products from CDK/forestry service of regencies/mayoralties

2. SKSHH is issued after paying PSDH

3. SKSHH is issued by forestry officers having qualification and experience in measuring/ testing non-timber forest products

9. Export of log 1. Having valid forest

concession (HPH)/licenses to utilize timber (IPK) 2. Not having arrears of

reforestation funds (DR)/ PSDH

3. HPH have already executed environmental impact analysis (AMDAL) 4. Logs to be exported must

be checked by officers qualified for or capable of undertaking the

measuring/test of logs 5. Legitimate transport

documents must be used in the transportation of the

1. Securing recommendation on the export of logs

2. The tolerable export volume is 17.05 & of the total RKT/IPK 3. Logs which are checked must

be completed with BAP as the basis for the issuance of SKSHH

10. Export of sawn timber 1. Having legitimate industrial licenses

2. Processing raw materials legally

3. Sawn timber to be checked by officers qualified for or capable of undertaking the measuring/test of sawn timber

4. Legitimate transport documents must be used in the transportation of the sawn timber

1. Securing recommendation the export of sawn timber

2. The tolerable export volume is equal to the installed capacity at the maximum

3. Sawn timber which is checked must be completed with BAP as the basis for the issuance of SKSHH

4. SKSHH is issued by forestry officers having qualification as PPKBRI

11. Export of rattan 1. Having licenses to collect rattan from CDK/forestry service of regencies/ mayoralties

2. Paying PSDH 3. Round rattan to be

exported must be checked by officers qualified for or capable of undertaking the measuring/test of round rattan

4. Legitimate transport documents must be used in the transportation of the round rattan

1. Securing recommendations on the export of rattan

2. The tolerable volume is equal to the available rattan stock

3. Rattan which is checked must be completed with BAP as the basis for the issuance of SKSHH

4. SKSHH is issued by forestry officers qualified for testing round rattan . Transportation document which is used is SKSHH

12 Distribution of

smallholder/plantation timber

1. Timber comes from smallholder forests/ plantations

2. Smallholder forests/ plantations constitute forest rights/rights to use land for business purposes (HGU)

3. The ownership of forest rights / HGU is legally legitimate

4. Legitimate transport documents of timber coming from smallholder forests/plantations

5. Before the timber is carried , it must be checked by officers

1. Kids of timber planted by smallholders are sengon, mindi, mahogany, sungkai, hardwood, nangka, durian, kecapi, cempedak, magosteen, sawo , rubber tree and asam jawa

2. Forest ownership is proven by certificate or traditional documents and HGU of plantations

3. Transportation of smallholder and plantation timber must use SKKM issued by security officers

capable of measuring and testing timber

5. SKKM is issued on the basis of BAP
