REGARDING

EXCHANGE OF DOCUMENT/DATA BETWEEN DIRECTOR GENERAL OF FOREIGN TRADE, DIRECTOR GENERAL OF DOMESTIC TRADE, DIRECTOR GENERAL OF CUSTOM AND

EXCISE, AND DIRECTORATE GENERAL OF TAXES

DIRECTOR GENERAL OF FOREIGN TRADE MINISTRY OF INDUSTRY AND TRADE, DIRECTOR GENERAL OF DOMESTIC TRADE MINISTRY OF INDUSTRY AND TRADE,

DIRECTOR GENERAL OF CUSTOM AND EXCISE MINISTRY OF FINANCE AND DIRECTORATE GENERAL OF TAXES MINISTER OF FINANCE,

Considering:

a. that in the framework of supporting the implementation of foreign trade policy, particularly in export and import area, it is deemed necessary to improve security of export-import document and speed up flow of goods as well as improve service to the business sector.

b. That to achieve the stated goals, it is deemed necessary to establish an integrated and efficient export-import information system between Directorate General of Foreign Trade Ministry of Industry and Trade, Directorate General of Domestic Trade Ministry of Industry and Trade, Directorate General of Custom and Excise Ministry of Finance and Directorate General of Taxes Ministry of Finance trough the exchange of electronic data (E-Government)

c. Considering the above mentioned point a and b, it is deemed necessary to facilitate exchange of data trough electronic system between Directorate General of Foreign Trade Ministry of Industry and Trade, Directorate General of Domestic Trade Ministry of Industry and Trade, Directorate General of Custom and Excise Ministry of Finance and Directorate General of Taxes, Ministry of Finance

In view of:

1. Bedrijfsreglementerins Ordonnantie 1934 (Staatsblad Year 1938 Number 86);

2. Law Number 3 Year 1982 regarding Company Registry Requirement (State Gazette Year 1982 Number 7, Amendment of State Gazette Number 3214);

3. Law Number 6 Year 1983 regarding General Provision of Tax (State Gazette Year 1983 Number 49 Supplement to State Gazette Number 3262) as amended several times and lastly amended with Law No. 16 Year 2000 (State Gazette Year 2000 Number 126, Supplement to State Gazette Number 3984)

4. Law Number 7 Year 1983 on Income Tax (State Gazette Year 1983 Number 50 supplement to State Gazette Number 3263) as amended several times and lastly amended with law number 17 Year 2000 (State Gazette Year 2000 Number 127 Supplement to State Gazette Number 3985);

and Responsibility of Minister of Industry and Trade on Foreign Trade Issues;

16. Decree of Minister of Finance Number 453/KMK.04/2002 on Custom Procedure of Import as amended several times and lastly amended with Decree of Minister of Finance Number 112/KMK.04/2003;

18. Joint Decree of Minister of Industry and Trade and Minister of Finance Number 527/KMK.0/2002 and Number 819/MPP/Kep/XII/2002 regarding Administrative Procedure for Importer;

19. Decree of Minister of Industry and Trade Number 40/MPP/Kep/1/2003 regarding Importer Identity Number (API);

20. Decree of Minister of Industry and Trade Number 141/MPP/Kep/3/2003 regarding Special Identity Number for Importer (NPIK)

In View of:

1. Presidential Instruction Number 3 Year 2003 regarding National Policy and Strategy on Development of E-Government

2. Memorandum of Understanding between Minister of Finance and Minister of Industry and Trade Number 194/MK/2002 and Number 712/MPP/XII/2002 regarding Coordination on Identification, Evaluation and Settlement of Problems Related to Each of Ministry’s Duties;

DECIDE

Stipulate:

FIRST:

Director General of Foreign Trade Ministry of Industry and Trade, Director General of Domestic Trade Ministry of Industry and Trade, Director General of Taxes Ministry of Finance, Director General of Custom and Excise Ministry of Finance hereby have agreed to conduct electronic data /document interchange.

SECOND:

For the implementation of electronic data interchange referred to in the first dictum of this decree, it is deemed necessary to establish a team hereinafter called “ELECTRONIC DOCUMENT/ DATA INTERCHANGE TEAM” whose members are stated in this decree

THIRD:

The team shall have the following duties:

a. Design and formulate system and procedures for the implementation electronic date interchange which includes:

1. Exchange of electronic data/document between government institutions which is aimed at speeding up monitoring of business entity as well as increasing coordination among government institutions

2. Exchange of non interactive electronic data/document which means that the electronic data which is exchanged between government institutions cannot be used automatically. The institution which receives the non interactive data must reprocess it manually before using it.

3. Exchange of interactive data which means that the electronic data which is exchanged between government institutions can be used automatically by the government institutions.

4. Online is a network that connects a computer system of a government institution with other computer system of other government institutions trough a leased/telephone line.

b. Discuss and determine export-import document to be exchanged; c. Coordinate development of export-import interchange system;

d. Conduct testing and evaluation of performance of export-import electronic data interchange system;

e. Report result of their work to the Director General of Foreign Trade Ministry of Industry and Trade, Director General of Domestic Trade Ministry of Industry and Trade, Directorate General of Custom and Excise Ministry of Finance and Directorate General of Taxes Ministry of Finance

FOURTH:

The electronic data to be interchanged among government institutions must be relevant with the duties of the respected institutions. Below is the list of the data to be interchanged among government institution:

FIFTH:

a. The document to be interchanged by government institutions referred to in dictum FOURTH should only be used for internal purpose of Directorate General of Foreign Trade, Directorate General of Domestic Trade, Director General of Custom and Excise and Director General of Taxes,

b. In any case the data to be interchanged is secret in nature and can not be revealed to the public without consent of the respected institutions, Directorate General of Foreign Trade, Directorate General of Domestic Trade, Director General of Custom and Excise, Director General of Taxes shall maintain the secrecy of the document/ data thereof.

SIXTH:

For the continuity of work performance Chairman of “ELECTRONIC DOCUMENT/ DATA INTERCHANGE TEAM“ may establish a technical team

SEVENTH:

Members of the team shall receive honorarium/payment for their work in an amount governed by regulation.

EIGTH:

Any costs arising from operational activities of “ELECTRONIC DOCUMENT/ DATA INTERCHANGE TEAM” shall be burdened to the budget of Directorate General of Foreign Trade Ministry of Industry and Trade.

NINTH:

The team shall operate for the period of 6 months starting from the date of the stipulation of this decree.
