ABSTRAK
Pers bukanlah pranata yang bebas dari persoalan. Ada kalanya berita-berita pers tidak menyenangkan bagi suatu pihak, yang disebabkan oleh analisis wartawan yang tidak luput dari kelemahan dan kesalahan. Hal inilah kemudian yang memicu sebagian pihak untuk membawa persoalan tersebut kedalam ranah hukum dengan dalih, bahwa apa yang diberitakan oleh pers telah menimbulkan suatu kerugian. Dalam kasus yang dijadikan sebagai objek penelitian ini, merupakan suatu kasus yang mirip dengan apa yang dinamakan Libel Tourism Case yang menurut penulis baru pertama kalinya terjadi di Indonesia.
Dalam perkara ini, Richard Bruce Ness yang berkewarganegaraan Amerika telah mengajukan gugatan di Pengadilan Negeri Jakarta Pusat terhadap Jane Perlez yang merupakan Warga Negara Australia, The New York Times yang merupakan media pers yang berkantor di New York Amerika Serikat, dan Evelyn Rusli serta Muktita Suhartono yang berkewarganegaraan Indonesia dan berperan sebagai jurnalis/wartawan dari The New York Times yang membantu Jane Perlez. Gugatan tersebut didasari oleh karena pemberitaan yang telah ditulis oleh JP dan diterbitkan oleh The New York Times, dirasakan oleh Richard Bruce Ness bersifat memojokkan, mendiskreditkan, menyalahkan dan mencemarkan nama baiknya. Atas pemberitaan tersebut, RBN merasa dirugikan secara materiil dan immateriil.
Terhadap gugatan tersebut, Pengadilan Negeri Jakarta Pusat menolak gugatan yang diajukan oleh RBN oleh karena para Tergugat secara hukum tidak terbukti melakukan perbuatan melanggar hukum. Putusan tersebut didasarkan pada kode etik jurnalistik yang berlaku secara universal. Dalam hal ini, ditinjau dari Hukum Acara Perdata, khususnya mengenai kewenangan mengadili, Pengadilan Negeri Jakarta Pusat secara hukum berwenang memeriksa dan mengadili perkara ini dengan menerapkan hak choice of jurisdiction atau choice of court .Sedangkan mengenai penggunaan kode etik jurnalistik yang berlaku secara universal sebagai dasar untuk memutus perkara ini telah sesuai dan memenuhi amanat dari Undang-Undang No. 40 Tahun 1999 tentang Pers.

ABSTRACT
Institution of the press is not free of problems. There are times when news releases are no fun for a party, which is caused by the analysis of journalists who are not free of weaknesses and mistakes. It is then that triggers some parties to bring the issue into the realm of law on the pretext, that what is reported by the press have led to a loss. In cases that serve as the object of this study, is a case similar to the so-called libel Tourism Case by author for the first time that happened in Indonesia.
In this case, Richard Bruce Ness the American citizen has filed a lawsuit in the Central Jakarta District Court against Jane Perlez is a citizen of Australia, The New York Times that the news media offices in New York the United States, and Evelyn Rush and the Muktita Suhartono citizen of Indonesia and served as a journalist / reporter from The New York Times that helps Jane Perlez. The lawsuit is based on the due proclamation was written by JP and published by The New York Times, Richard Bruce Ness is felt by nature discredit, discredit, blame and defame his good name. On the news, RBN feel disadvantaged in material and immaterial.
Against the lawsuit, the Central Jakarta District Court rejected a lawsuit filed by the Defendants RBN therefore is not legally guilty of any crime. This decision was based on journalistic code of ethics that are universal. In this case, in terms of Civil Procedure, particularly regarding the authority of the judge, the Central Jakarta District Court is legally authorized to investigate and prosecute this case by applying the right choice of jurisdiction or choice of court. As for the use of journalistic ethics that are universal as the basis for deciding the case has been appropriate and fulfill the mandate of the Act No. 40 of 1999 on the Press.
