ELECTRONIC FOREIGN EXCHANGE CONFIRMATION(S) AND ELECTRONIC MTM REPORT(S)
SYARAT DAN KETENTUAN DARI
KONFIRMASI(-KONFIRMASI) PERTUKARAN MATA UANG ASING ELEKTRONIK DAN LAPORAN(-LAPORAN) MTM ELEKTRONIK
Unless otherwise defined herein, the terms used and defined in the Application shall have the same meaning ascribed to each of them therein when used in this Terms and Conditions for Electronic Foreign Exchange Confirmation(s) and Electronic MTM Report(s) (“Terms and Conditions”). In the event of any inconsistency between any provisions under the Application and any provisions those mentioned in the Terms and Conditions, the provision in the Application shall prevail. Any alteration to any Registered Electronic Mail Address(es) and/or name of the owner of the email shall be made by using form provided by or acceptable to the Bank. The Bank shall only rely on and shall not be obliged to conduct a further verification on the latest information on the Registered Electronic Mail Address(es) and/or names of the owner of the email provided by the Applicant.
Kecuali didefinisikan lain di sini, istilah yang digunakan dan didefinisikan dalam Permohonan memiliki arti yang sama dengan yang digunakan di Syarat dan Ketentuan dari Konfirmasi(-Konfirmasi) Pertukaran Mata Uang Asing Elektronik dan Laporan(-Laporan) MTM Elektronik (“Syarat dan Ketentuan”) ini. Dalam hal terjadi ketidaksesuaian antara suatu ketentuan dari Permohonan dan suatu ketentuan dari Syarat dan Ketentuan, ketentuan dari Permohonan yang akan berlaku. Setiap perubahan terhadap Alamat(-alamat) Surat Elektronik Yang Terdaftar dan/atau nama(-nama) pemilik surat elektronik tersebut harus dilakukan dengan menggunakan aplikasi yang disediakan atau dapat diterima oleh Bank. Bank hanya akan mengandalkan dan tidak berkewajiban untuk melakukan verifikasi lebih lanjut terhadap informasi terkini atas Alamat(-alamat) Surat Elektronik Yang Terdaftar dan/atau nama(-nama) pemilik surat elektronik tersebut yang disediakan oleh Pemohon.
1. The Applicant understood that the Bank will maintain in its books a record of the details of the transactions to which the Electronic Foreign Exchange Confirmation(s) and Electronic MTM Report(s) relate (the Electronic Foreign Exchange Confirmation(s) and the Electronic MTM Report(s) are collectively referred to as “E-Documents”). In the event of inconsistency between the particular of any of the E-Documents and of the Bank's book and record, the latter will prevail. Unless the Bank determines otherwise, any of E-Documents will be available to the Applicant at no cost and will allow the Applicant to view any of the E-Documents.
Pemohon memahami bahwa Bank akan mengelola dalam pembukuannya catatan atas rincian transaksi-transaksi sehubungan dengan Konfirmasi(-Konfirmasi) Pertukaran Mata Uang Asing Elektronik dan Laporan(-Laporan) MTM Elektronik (Konfirmasi(-Konfirmasi) Pertukaran Mata Uang Asing Elektronik dan Laporan (-Laporan) MTM Elektronik akan secara bersama-sama disebut "Dokumen-Dokumen Elektronik"). Dalam hal terdapat ketidaksesuaian antara keterangan di dalam setiap Dokumen-Dokumen Ekektronik dan di dalam pembukuan dan catatan Bank, keterangan dalam pembukuan dan catatan Bank yang akan berlaku. Kecuali ditentukan secara lain oleh Bank, setiap Dokumen-Dokumen Elektronik akan disediakan kepada Pemohon tanpa biaya dan Pemohon diperkenankan untuk melihat setiap Dokumen-Dokumen Elektronik.
2. The Applicant understands that the Applicant may inquire the Bank on whether its enrollment in the Documents is approved, suspended or rejected by the Bank. Upon approval by the Bank in the E-Documents, the paper based foreign exchange confirmation and MTM report will cease to be provided and sent by the Bank (unless specifically agreed otherwise by the Bank and the Applicant) to its address as registered in the Bank and the Bank will instead generate and send the E-Documents electronically on
each relevant date and the Applicant agrees to accept and view the E-Documents in a timely manner. The Applicant agrees and understands that the availability of E-Documents is subject to the following conditions:
Pemohon memahami bahwa Pemohon dapat meminta keterangan kepada Bank mengenai pendaftarannya atas Dokumen-Dokumen Elektronik disetujui, ditunda atau ditolak oleh Bank. Setelah mendapat persetujuan dari Bank atas Dokumen-Dokumen Elektronik, konfirmasi pertukaran mata uang asing dan laporan MTM dalam bentuk tercetak tidak akan lagi diberikan dan dikirimkan oleh Bank (kecuali disepakati lain secara khusus oleh Bank dan Pemohon) ke alamat Pemohon yang terdaftar di Bank dan Bank akan memproduksi dan mengirimkan Dokumen-Dokumen Elektronik secara elektronik pada masing-masing tanggal yang relevan dan Pemohon setuju untuk menerima dan melihat Dokumen-Dokumen Elektronik secara tepat waktu. Pemohon menyetujui dan memahami bahwa ketersediaan Dokumen-Dokumen Elektronik tunduk pada ketentuan-ketentuan berikut:
(i) The provision of the E-Documents by the Bank will only be effective upon the receipt of the duly completed Application from the Applicant.
Penyediaan Dokumen-Dokumen Elektronik oleh Bank hanya akan berlaku setelah penerimaan Permohonan yang telah dilengkapi dari Pemohon.
(ii)The provision of the E-Documents by the Bank is to commence 5 (five) Business Days from the date on which the Bank receives the duly completed Application.
Penyediaan Dokumen-Dokumen Elektronik oleh Bank akan dimulai 5 (lima) Hari Kerja setelah tanggal dimana Bank menerima Permohonan yang telah dilengkapi secara patut.
For the purpose of this Terms and Conditions, “Business Day” means a day (other than Saturday, Sunday or a public holiday) on which banks are open for general banking business in Jakarta.
Untuk kepentingan Syarat dan Ketentuan ini, “Hari Kerja” berarti suatu hari (selain Hari Sabtu, Hari Minggu atau sutu hari libur nasional) dimana bank-bank beroperasi menjalankan usaha perbankan secara umum di Jakarta.
3. The Applicant understands that any of E-Documents might, as attached in the e-mail, contain data, information, record or document with respect to accounts and/or relevant transaction(s). The E-Documents are, for security purposes, encrypted with a unique and unchanged password notified by the Bank from time to time and may only be accessed by the authorized person of the Applicant. The Applicant agrees that the Applicant shall maintain such password in appropriate manner in order to avoid the access to any of E-Documents by any unauthorized person.
Pemohon memahami bahwa setiap Dokumen-Dokumen Elektronik dapat, sebagaimana terlampir pada surat elektronik, berisi data, informasi, catatan atau dokumen mengenai rekening dan/atau transaksi(-transaksi) terkait. Dokumen-Dokumen Eletronik, untuk tujuan keamanan, dienkripsi dengan suatu kata sandi yang unik dan tidak dapat diubah yang diberitahukan oleh Bank dari waktu ke waktu dan hanya dapat diakses oleh orang yang berwenang dari Pemohon. Pemohon setuju bahwa Pemohon harus mengelola kata sandi tersebut dengan cara yang tepat untuk menghindari akses ke Dokumen-Dokumen Elektronik oleh orang yang tidak berwenang.
4. The Applicant understands that the E-Documents will be generated by system and electronically sent to the email address(es) which have been registered at the Bank through the Application (“Registered Email”) after the settlement date of any relevant transactions. The Applicant agrees that the Bank shall not be liable for any change, addition or deletion on any information related to any Registered Emails unless the Bank has been notified in writing by the Applicant in the manner prescribed by the Bank. Pemohon memahami bahwa Dokumen-Dokumen Elektronik akan dihasilkan oleh sistem dan dikirim secara elektronik ke alamat(-alamat) surat elektronik yang telah didaftarkan kepada Bank melalui Permohonan (“Surat Elektronik Terdaftar”) setelah tanggal penyelesaian dari setiap transaksi-transaksi yang relevan.
Pemohon setuju bahwa Bank tidak bertanggung jawab atas setiap perubahan, penambahan atau penghapusan dari setiap informasi yang terkait dengan dengan setiap Surat Elektronik Terdaftar kecuali Bank telah diberitahukan secara tertulis oleh Pemohon dengan cara yang ditentukan oleh Bank.
5. The use and storage of any information in relation to the E-Documents and any other information that being made available to the device for viewing the E-Documents are at the sole responsibility of the Applicant and any of its authorized person.
Penggunaan dan penyimpanan atas setiap informasi berkenaan dengan Dokumen-Dokumen Elektronik dan setiap informasi lainnya yang diberikan ke perangkat untuk menampilkan Dokumen-Dokumen Elektronik semata-mata merupakan tanggung jawab Pemohon dan setiap orang yang berwenang darinya. 6. The Applicant is aware of all security risks including the risk of the content of E-Document becoming known to third parties. The Applicant agrees that the Applicant shall not hold the Bank being liable in any way for the same and agree that the same shall not constitute as a breach by the Bank toward customer secrecy. Pemohon mengetahui akan seluruh risiko keamanan termasuk risiko dapat diketahuinya isi dari Dokumen Elektronik oleh pihak ketiga. Pemohon menyetujui bahwa Pemohon tidak akan meminta pertanggungjawaban dari Bank dengan cara apapun atas terjadinya risiko keamanan tersebut dan menyetujui bahwa terjadinya risiko keamanan tersebut bukan merupakan pelaggaran Bank terhadap kerahasiaan nasabah.
7. The Applicant understands that the Bank, upon giving 30 (thirty) Business Days’ prior written notice, may modify, restrict, withdraw, cancel, suspend or discontinue the provision of the E-Documents. After the lapse of such period, provided that no objection expressed by the Applicant during such period, it shall be deemed that the Applicant agrees to comply with any latest modification or change as informed by the Bank.
Pemohon memahami bahwa Bank, dengan memberikan pemberitahuan secara tertulis 30 (tiga puluh) Hari Kerja sebelumnya, dapat mengubah, membatasi, menarik, membatalkan, menangguhkan atau menghentikan penyelenggaraan Dokumen-Dokumen Elektronik. Setelah lewatnya jangka waktu tersebut, apabila tidak ada keberatan yang diberikan oleh Pemohon, maka Pemohon dianggap menyetujui untuk tunduk pada modifikasi atau perubahan yang terakhir sebagaimana diberitahukan oleh Bank.
8. The availability of any E-Documents shall be deemed to be the date of delivery of such E-Documents whereby such E-Documents will be deemed to have been sent to and received by the Applicant. However, in some circumstances or upon the occurrence of certain events as reasonably determined by the Bank, the Bank may send to the Applicant the paper based of the foreign exchange confirmation and the MTM report to the address as registered in the Bank.
Ketersediaan setiap Dokumen Elektronik akan dianggap sebagai tanggal pengiriman Dokumen-Dokumen Elektronik tersebut dimana Dokumen-Dokumen-Dokumen-Dokumen Eletronik tersebut akan dianggap telah dikirim kepada dan diterima oleh Pemohon. Namun, dalam beberapa keadaan atau atas kejadian tertentu sebagaimana ditetapkan oleh Bank secara wajar, Bank dapat mengirimkan kepada Pemohon konfirmasi-konfirmasi pertukaran mata uang asing dan laporan-laporan MTM dalam bentuk tercetak ke alamat Pemohon yang terdaftar di Bank.
9. Cancellation or termination of the use of the E-Documents may at any time be affected by either party hereto by giving 30 (thirty) Business Days' prior written notice to the other party. In some circumstances or upon the occurrence of certain events as reasonably determined by the Bank, the Bank reserves the rights to cancel or terminate the provision of E-Documents, by giving 30 (thirty) Business Days’ prior written notice. After the lapse of such period, provided that no objection expressed by the Applicant during such period, it shall be deemed that the Applicant agrees to such cancellation or termination as informed by the Bank. Upon such cancellation or termination, the Bank will thereafter generate and send
the paper based on the foreign exchange confirmation and the MTM report to the Applicant’s address as registered in the Bank.
Pembatalan atau pengakhiran penggunaan Dokumen-Dokumen Elektronik dapat setiap saat diberlakukan oleh salah satu pihak dalam Permohonan ini dengan memberikan pemberitahuan secara tertulis 30 (tiga puluh) Hari Kerja sebelumnya kepada pihak yang lain. Dalam keadaan tertentu atau atas terjadinya suatu peristiwa tertentu sebagaimana ditentukan secara wajar oleh Bank, Bank berhak untuk membatalkan atau mengakhiri penyelenggaraan Dokumen-Dokumen Elektronik, dengan memberikan pemberitahuan secara tertulis 30 (tiga puluh) Hari Kerja sebelumnya. Setelah lewatnya jangka waktu tersebut, apabila tidak ada keberatan yang diberikan oleh Pemohon, maka Pemohon dianggap menyetujui pembatalan atau pengakhiran yang diberitahukan oleh Bank. Atas pembatalan atau pengakhiran tersebut, Bank akan selanjutnya memproduksi dan mengirimkan konfirmasi pertukaran mata uang asing dan laporan MTM dalam bentuk tercetak ke alamat Pemohon yang terdaftar di Bank. 10. Subject to approval of the Bank, the Applicant may request the Bank to re-issue any E-Document which
has been sent to the Applicant ("Issued E-Document") and re-send the Issued E-Document to the Registered Email, provided that such request must be received by the Bank within 1 (one) month after the date of the relevant Issued E-Document, or otherwise the Bank will instead generate and deliver the paper based of the relevant Issued E-Document to the Applicant's address as registered in the Bank. The Applicant agrees to bear any official charge(s) applicable to the re-issuance of the Issued E-Document and authorizes the Bank to debit the same toward the Applicant's account with the Bank. Tunduk pada persetujuan dari Bank, Pemohon dapat meminta Bank untuk menerbitkan kembali Dokumen-Dokumen Elektronik yang telah dikirimkan ke Pemohon (“Dokumen Elektronik Yang Telah Diterbitkan”) dan mengirimkan kembali Dokumen Elektronik Yang Telah Diterbitkan ke Surat Elektronik Terdaftar, dengan ketentuan bahwa permintaan tersebut harus telah diterima oleh Bank dalam waktu 1 (satu) bulan setelah tanggal Dokumen Elektronik Yang Telah Diterbitkan, atau jika tidak maka Bank akan memproduksi dan menyerahkan Dokumen Elektronik Yang Telah Diterbitkan yang relevan dalam bentuk tercetak ke alamat Pemohon yang terdaftar di Bank. Pemohon setuju untuk menanggung setiap biaya(-biaya) resmi yang berlaku atas penerbitan ulang dari Dokumen Elektronik Yang Telah Diterbitkan dan memberikan kewenangan kepada Bank untuk mendebet rekening Pemohon yang dibuka di Bank sejumlah biaya tersebut.
11.The Applicant acknowledges and agrees that the Bank shall not be liable for: (i) any access to the Registered Email or E-Documents by any unauthorized person, the security or confidentiality of any information transmitted through any applicable internet provider, information or communication network provider, network system or such other equivalent system in any jurisdiction in relation to the transmission of any E-Documents even if the Bank has used all reasonable efforts to ensure that the provision of E-Documents is secure and cannot be accessed by unauthorized person, (ii) any incompatibility between the system in the Applicant and the system in the Bank for purposes of using, accessing and/or operating the E-Documents, (iii) any errors, viruses, delay, inaccuracy, losses, damages whatsoever arising from or in connection with the use of the E-Documents (including but not limited to any interception, modification or amendment, disruption, interruption, delay or inaccuracy of emails or internet transmission or other communication equipment or facilities), and (iv) any machine, system or communications breakdown, interruption, malfunction or failure, failure or fault of any internet or electronic mail service providers, telecommunications or any other service providers or operators, or other circumstances that are beyond the Bank’s control which leads to the delay in the delivery of the Documents or delay in the delivery of any information and/or data made available under the E-Documents, or disruption or suspension of the E-Documents (whether partially or wholly), or to the non-receipt, interception of or unauthorized access to the E-Document or any information and/or data made available under the E-Documents.
Pemohon mengakui dan setuju bahwa Bank tidak akan bertanggung jawab terhadap: (i) setiap akses ke Surat Elektronik Terdaftar atau Dokumen-Dokumen Elektronik oleh setiap orang yang tidak berwenang,
keamanan atau kerahasiaan dari setiap informasi yang dikirimkan melalui setiap penyedia internet yang berlaku, penyedia jaringan informasi atau komunikasi, sistem jaringan atau sistem sejenis lainnya manapun di jurisdiksi manapun sehubungan dengan pengiriman setiap Dokumen-Dokumen Elektronik meskipun apabila Bank telah menggunakan segala upaya yang wajar untuk memastikan bahwa penyelenggaraan Dokumen-Dokumen Elektronik aman dan tidak dapat diakses oleh orang yang tidak berwenang, (ii) setiap ketidaksesuaian antara sistem di Pemohon dan sistem di Bank untuk tujuan penggunaan, melakukan akses dan/atau pengoperasian Dokumen-Dokumen Elektronik, (iii) setiap kesalahan, virus, penundaan, ketidakakuratan, kehilangan, kerugian dalam bentuk apapun yang timbul dari atau sehubungan dengan penggunaan Dokumen-Dokumen Elektronik (termasuk namun tidak terbatas pada setiap gangguan, modifikasi atau perubahan, interupsi, penundaan atau ketidakakuratan dari surat elektronik atau transmisi internet atau perangkat atau fasilitas komunikasi lainnya), dan (iv) setiap kerusakan, gannguan, tidak berfungsinya atau kegagalan dari mesin, sistem atau komunikasi, kegagalan atau kesalahan dari setiap penyedia jasa internet atau surat elektronik, operator atau penyedia telekomunikasi atau lainnya, atau keadaan lain yang diluar kendali Bank yang mengakibatkan keterlambatan pengiriman Dokumen-Dokumen Elektronik atau keterlambatan pengiriman dari setiap informasi dan/atau data yang tersedia berdasarkan Dokumen-Dokumen Elektronik, atau gangguan atau penundaan dari Dokumen-Dokumen Elektronik (baik sebagian atau seluruhnya), atau tidak diterimanya, gangguan dari atau akses yang tidak berwenang kepada Dokumen-Dokumen Elektronik atau setiap informasi dan/atau data yang dibuat berdasarkan Dokumen-Dokumen Elektronik.
12. If there is delay or failure in the delivery of the E-Documents ("Non-receipt") or there is any error, irregularity, discrepancies, claims or unauthorized debits or items ("Error") appearing in the E-Documents, the Applicant shall notify the Bank immediately and such communication shall contain the following information: (a) name and account number; (b) details of the error; (c) transaction reference and (d) such other information as required by the Bank. If any Non-receipt or Error is not reported to the Bank within 14 (fourteen) Business Days after the delivery date, the Applicant confirms the acceptance of the E-Documents and agrees all particulars contained therein is true, accurate and correct in all respects.
Apabila terjadi keterlambatan atau kegagalan dalam pengiriman Dokumen-Dokumen Elektronik (“Tidak Ada Penerimaan”) atau terdapat kesalahan, penyimpangan, perbedaan, tuntutan atau pendebitan atau hal yang tidak sah (“Kesalahan”) tercantum pada Dokumen-Dokumen Elektronik, Pemohon harus segera memberitahukan Bank dan pemberitahuan tersebut harus mencakup informasi sebagai berikut: (a) nama dan nomor rekening; (b) rincian kesalahan; (c) referensi transaksi; dan (d) informasi lainnya yang diminta oleh Bank. Apabila setiap Tidak Ada Penerimaan atau Kesalahan tidak diberitahukan kepada Bank dalam waktu 14 (empat belas) Hari Kerja, Pemohon menegaskan penerimaan Dokumen-Dokumen Elektronik dan setuju bahwa segala sesuatu yang tercantum di dalam Dokumen-Dokumen Elektronik adalah benar, akurat, dan tepat dalam segala hal.
13. Under no circumstances, including negligence, shall the Bank or anyone involved in creating, producing, delivering or managing the E-Documents herein, be liable for any direct, indirect, incidental, special or consequential damages that may result from the use or inability to use the E-Documents. Dalam keadaan apa pun, termasuk kelalaian, Bank atau siapa pun yang terlibat dalam menciptakan, memproduksi, mengirimkan atau mengelola Dokumen-Dokumen Elektronik berdasarkan Permohonan ini, tidak bertanggung jawab untuk segala kerugian baik secara langsung, tidak langsung, insidentil, khusus atau turunan yang timbul dari penggunaan atau ketidakmampuan penggunaan Dokumen-Dokumen Elektronik.
14. The Applicant and the Bank hereby waive the applicability of the provision of Article 1266 of the Indonesian Civil Code (Kitab Undang-Undang Hukum Perdata) to the extent a judicial pronouncement or a court decision is required for the cancellation or termination of this Application and/or the provision of E-Documents.
Pemohon dan Bank dengan ini mengesampingkan penerapan ketentuan Pasal 1266 Kitab Undang-Undang Hukum Perdata, sepanjang suatu penetapan pengadilan atau suatu putusan pengadilan dipersyaratkan untuk pembatalan atau pengakhiran dari Permohonan ini dan/atau penyelenggaraan Dokumen-Dokumen Elektronik.
15. To the extent permitted by any applicable law, the Bank shall not be liable for any damage(s), claim(s), loss(es), cost(s) and/or expense(s) which the Applicant may sustain or incur due to the Bank’s failure to perform the provision of E-Documents in relation to the occurrence of any events beyond the reasonable control of the Bank, including but not limited to any acts of God, war, civil disturbance, sabotage, strike, government policy and power failure.
Sepanjang diizinkan oleh hukum yang berlaku, Bank tidak bertanggung jawab atas segala kerugian, tuntutan, kehilangan, biaya dan/atau pengeluaran yang mungkin diderita atau dikenakan kepada Pemohon karena kegagalan Bank dalam menyediakan Dokumen-Dokumen Elektronik sehubungan dengan terjadinya peristiwa-peristiwa di luar kendali yang wajar Bank, termasuk namun tidak terbatas pada bencana alam, peperangan, kerusuhan, sabotase, pemohokan, kebijakan pemerintah dan ketidaktersediaan daya listrik.
16. All power of attorney conferred hereunder by the Applicant to the Bank are irrevocable and unconditional and may not be terminated by the Applicant pursuant to Articles 1813, 1814 and 1816 of the Indonesian Civil Code (Kitab Undang-Undang Hukum Perdata) for whatsoever reason to the extent permitted by any applicable laws and regulations.
Semua kuasa yang diberikan di sini oleh Pemohon kepada Bank tidak dapat dibatalkan dan tanpa syarat dan tidak dapat diakhiri oleh Pemohon berdasarkan Pasal-pasal 1813, 1814 dan 1816 Kitab Undang-Undang Hukum Perdata untuk alasan apa pun sepanjang diizinkan oleh peraturan perundang-undangan yang berlaku.
17. The Bank may, by giving 30 (thirty) Business Days’ prior written notice, amend, supplement and/or modify this Terms and Conditions. After the lapse of such period, provided that no objection expressed by the Applicant during such period, the Applicant shall be deemed to have agreed to comply with and accept such amendments, supplements and/or modifications as lastly informed in writing by the Bank. Further, the Bank will not provide any service that can automatically incur additional fee without written consent from the Applicant.
Bank dapat, dengan memberikan pemberitahuan secara tertulis 30 (tiga puluh) Hari Kerja sebelumnya, mengubah, menambah, dan/atau memodifikasi Syarat dan Ketentuan ini. Setelah lewatnya jangka waktu tersebut, apabila tidak ada keberatan yang diberikan oleh Pemohon, maka Pemohon dianggap setuju untuk tunduk pada dan menerima perubahan, tambahan, dan/atau modifikasi yang terakhir diberitahukan secara tertulis oleh Bank. Lebih lanjut, Bank tidak akan menyediakan layanan yang dapat secara otomatis membebankan biaya tanpa persetujuan tertulis dari Pemohon.
18. The Applicant agrees to release the Bank from any and all responsibility and liability arising from any misuse and further agree to hold the Bank free and harmless from all losses, costs, charges, damages and expenses that may be suffered by the Applicant due to any errors, delays or problems in transmission unauthorized or illegal interception, alteration, manipulation of electronic data or otherwise caused by using E-Documents, except for any gross negligence or willful misconduct of the Bank. Pemohon setuju untuk membebaskan Bank dari segala dan seluruh tanggung jawab dan kewajiban yang timbul dari segala penyalahgunaan dan juga setuju untuk membebaskan Bank dari seluruh kerugian, beban, biaya, kerusakan, dan pengeluaran yang mungkin diderita oleh Pemohon yang dikarenakan kerusakan, keterlambatan, atau masalah di pengiriman atau intersepsi yang tidak sah atau ilegal, perubahan, manipulasi data elektronik atau yang disebabkan oleh penggunaan Dokumen-Dokumen Elektronik, kecuali atas kelalaian yang nyata atau kesalahan yang disengaja dari Bank.
19. The Application and this Terms and Conditions are drawn up in English and Indonesian language, and in the event of inconsistency or conflict between the two versions, the Indonesian text will prevail. Permohonan ini dan Syarat dan Ketentuan ini dibuat dalam Bahasa Inggris dan Bahasa Indonesia, dan dalam hal terdapat ketidaksesuaian atau pertentangan antara kedua versi tersebut, versi Bahasa Indonesia akan berlaku.
20. The Application and this Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Indonesia. The Applicant agrees to submit any dispute arising from or in connection with the Application and this Terms and Conditions to the non-exclusive jurisdiction of district court of Central Jakarta (Pengadilan Negeri Jakarta Pusat) in Jakarta.
Permohonan dan Syarat dan Ketentuan ini diatur oleh dan ditafsirkan sesuai dengan Hukum Republik Indonesia. Pemohon setuju untuk mengajukan sengketa yang timbul dari atau sehubungan dengan Permohonan dan Syarat dan Ketentuan ini kepada yurisdiksi non-ekslusif Pengadilan Negeri Jakarta Pusat di Jakarta.
21. The Applicant hereby states that the Bank has given sufficient explanation and information on the characteristic of E-Documents, this Application and the Terms and Conditions and the Applicant has understood and comprehend all the consequences resulted from the utilization of E-Documents, including the benefit, risk, and other costs adhere to related to the E-Documents. Pemohon dengan ini menyatakan bahwa Bank telah memberikan penjelasan dan informasi yang memadai atas karakteristik dari Dokumen-Dokumen Elektronik, Permohonan dan Syarat dan Ketentuan ini dan Pemohon telah mengerti dan memahami seluruh konsekuensi yang diakibatkan dari penggunaan Dokumen-Dokumen Elektronik, termasuk keuntungan, risiko dan biaya-biaya lainnya yang harus dipatuhi terkait dengan Dokumen-Dokumen Elektronik.
22. The Applicant hereby represents and warrants to the Bank that the Applicant has provided the Bank with the true, correct and accurate information and/or documents on the date of the Application or as at the date on which those are stated or delivered.
Pemohon dengan ini menyatakan dan menjamin kepada Bank bahwa Pemohon telah memberikan informasi dan/atau dokumen-dokumen yang benar, tepat dan akurat kepada Bank pada tanggal Permohonan atau pada tanggal informasi atau dokumen tersebut dinyatakan atau diberikan.
23. Should there be any inquiry with respect to the Bank’s product and/or service, the Applicant may visit the Bank’s office and/or directly contact the Bank’s officer for assistance.
Jika terdapat pertanyaan sehubungan dengan produk dan/atau layanan Bank, Pemohon dapat mengunjungi kantor Bank dan/atau langsung menghubungi pegawai Bank untuk bantuan.
24. All provisions under the Application and this Terms and Conditions have been adjusted with the prevailing laws and regulations, including the provision of regulation of Otoritas Jasa Keuangan. Seluruh ketentuan-ketentuan dalam Permohonan dan Syarat dan Ketentuan ini telah disesuaikan dengan peraturan perundang-undangan yang berlaku, termasuk ketentuan peraturan Otoritas Jasa Keuangan. 25. The Applicant agrees that by using the E-Documents, the Applicant accepts and agrees to be bound by the
relevant terms and conditions as generally applied by the Bank, including without limitation to this Terms and Conditions. The Applicant agrees to be bound by any and all laws, rules, regulations and official issuances applicable to the E-Documents, now existing or which may hereinafter be enacted, issued or enforced, as well as such other terms and conditions governing the use of other facilities, benefits or E-Documents that the Bank may from time to time make available to the Applicant in connection with the E-Documents.
Pemohon setuju bahwa dengan menggunakan Dokumen-Dokumen Elektronik, Pemohon menerima dan setuju untuk terikat dengan syarat dan ketentuan yang terkait yang secara umum berlaku di Bank,
termasuk namun tidak terbatas pada Syarat dan Ketentuan ini. Pemohon setuju untuk terikat dengan setiap dan seluruh hukum, aturan, peraturan, dan penerbitan resmi yang berlaku untuk Dokumen-Dokumen Elektronik, yang sekarang telah ada atau yang mungkin selanjutnya akan diberlakukan, diterbitkan atau dilaksanakan, serta persyaratan dan ketentuan lain yang mengatur penggunaan fasilitas, manfaat, atau Dokumen-Dokumen Elektronik lainnya yang dari waktu ke waktu akan disediakan oleh Bank kepada Pemohon sehubungan dengan Dokumen-Dokumen Elektronik
