DECREE OF MINISTER OF AGRICULTURE NO.176/KPTS/TP.310/3/2003 DATED MARCH 12, 2003
THE HIGHEST RETAIL PRICE (HET) OF SUBSIDIZED FERILIZERS FOR AGRICULTURAL SECTOR IN THE FISCAL YEAR 2003
THE MINISTER OF AGRICULTURE, Considering :
a. that in the framework of increasing of the production of agricultural commodities toward national food independence by virtue of Decree of the Minister of Agriculture No.08/Kpts/Tp.260/2003, has been stipulated Requirement of Subsidized Fertilizers for Agricultural Sector;
b. that pursuant to Article 10 paragraph (4) of Decree of the Minister of Trade and Industry No.70/MPP/Kep/2/2003 on Procurement and Distribution of Subsidized Fertilizers for the Agricultural Sector, the designation of HET of subsidized fertilizers has become the duty of the Minister of Agriculture;
c. that based on the foregoing matters, it is necessary to stipulate HET of subsidized fertilizers for the agricultural sector for the budget year 2003 by Decree of Minister of Agriculture.
In view of :
1. Law No.12/1992 on Plant Cultivation System; 2. Law No.8/1999 on Consumer Protection;
3. Government Regulation No.8/2001 on Plant Cultivation Fertilizers;
4. Presidential Decree No.228/M/2001 on Establishment of Gotong Royong (Mutual Cooperation) Cabinet;
5. Presidential Decree No.102/2001 on Status, Duties, Functions, Authorities, and Organizational Structure of Departments;
6. Presidential Decree No.109/2001 on Organizational Units and Duties of Departmental Echelons I; 7. Decree of Minister of Trade and Industry No.634/MPP/Kep/9/2003 on Provisions and Procedure of
Supervision of Goods and/or Services Circulating in the Market;
8. Decree of Minister of Agriculture No.08/Kpts/TP.260/1/2003 on Requirement of Subsidized Fertilizers for Agricultural Sector for the Budget Year 2003;
9. Decree of Minister of Agriculture No.09/Kpts/TP.260/1/2003 on Conditions and Procedure of Registration of un organic Fertilizers;
10. Decree of Minister of Trade and Industry No.70/MPP/Kep/2/2003 on Procurement and Distribution of Subsidized Fertilizers for Agricultural Sector.

The Agreement between the Government and the House of Representatives’ Budgetary Committee. D E C I D E S :
To stipulate : FIRST :
To determine Highest Retail Price (HET) of subsidized fertilizers for agricultural sector in the fiscal year 2003.
SECOND :
The subsidized fertilizers as set forth in the FIRST dictum, includes urea-based fertilizer, SP-36, ZA, and NPK with composition of N:P:K = 15:15:15 and 20:10:10, which are provided by producers of fertilizers for agriculture, which include food plant, horticulture plants, public plantations, and/or greenery for animals.

FOURTH :
HET as mentioned in the THIRD dictum is determined as follows : a. Urea-based fertilizer = IDR 1,150.00/kg;
b. SP-36 = IDR 1,500.00/kg; c. ZA = IDR 1,000.00/kg; d. NPK=IDR 1,750.00/kg FIFTH :
Producers, distributors, and retailers of the subsidized fertilizers as mentioned in the FIRST dictum must consider the HET as mentioned in the FOURTH dictum.
SIXTH :
The retailers as mentioned in the FIFTH dictum must write down HET of subsidized fertilizers as mentioned in the FOURTH dictum on the price board, which is easily be seen and read by the buyers. SEVENTH :
The retailers as mentioned in the FIFTH dictum, who sell subsidized fertilizers as mentioned in the FOURTH dictum, their retailer certification will be withdrawn.
EIGTH :
The Provincial and Regency/Mayoralty Fertilizers Supervisory Commission shall monitor and supervise the distribution, use, and implementation of HET of subsidized fertilizers by producers, distributors, and retailers as mentioned in the FIFTH dictum.
NINTH :
The decree comes into full force and effect as from the date of stipulation Stipulated in Jakarta
