WHEREAS, the Government of the Kingdom of the Netherlands

and

the

Export-Import Bank of Washington (hereinafter called ''Eximba11k''),

an

agency of the Government of the United States of America, executed a

Loan Agreement

on

October

28,

1948,

in the principal amount

of

not

exceed Fifteen Miilion Dollars ($15,000,000), for financing the

acquisition of certain commodities and services on behalf of Indonesia,

to be

ｲ･ｰ｡ｾ､＠

in accordance with the terms and conditions of said

Loan

Agreement and.

of

the promissory note executed ·therewith, and;

WHEREAS, the

Government of the Kingdom

of

the Netherlands and

•

Eximbank subsequently on December

22,

1949

executed an agreement,

amendatory of and supplementary ta the Loan Agreement of October

28,

1948,

referred to

in

paragraph

above, which increased the principal

amount

of said Loan Agreement

to

Seventeen Million Two Hundred Thousand

Dollars ($17,200,000), to be repaid in accordance with the terms and

conditions

of

the Loan Agreement

as amended,

and

of a

new promissory note executed

in

connection with the amendatory

agreement of

December 22,

1949,

and;

called the ''Borrower''), the Governmer1t of tt1e Kingdon1 of the N·etherlands,

and the Government of the United States oi") America or1 Feb1 .. uary

execl1ted an ａｧｲ･･ｭｾｮｴ＠ whereby, inter alia, the Borrower assumed all

responsibilities and obligations of the Government of the Kingdom of

the Netherlands with respect to the aforesaid Loan Agreement of

October

28, 1948,

as amended on December 22,

1949,

including the

-obligatior1 to r·epay in accor·dance with the terms and condi t .ions of tl1e

Ijoan Agreement, as amended , and of""' a new promissory note e:x:ec11ted by

t11e ｂｯＱｾｲｯｷ･ｲ＠ on Fe bruar·y J_l,

1952,

and;

WHEREAS, tl1e Borrower has made certain ｲ･ｰ｡ｾｲｭ･ｮｴ＠ pursuant to the

terms and conditions of aforesaid Loan Agreement, as amended, and of ' .

the promissory note executed on February

11, 1952,

and;

WHEREAS, the Borrower and the Government of the United States of

America have entered into a rescheduling agreement on certain debts

of the Government of the Republic of Indonesia in arrears or due

including the debt owing

on this Loan, all as effected by an AIDE MEMOIRE transmitted by the

Government of the 1Jnited States of America on May

19, 1967,

and

accepted by the Borrower on June

16, 1967,

(hereinafter called ''A. I.D. ''), an agency of the Gover·nn1er1:t of the

United States of America · and successor in interest

Eximbank for

purposes of this Loan Agreement, in accordance with the provisions

of paragraph

of said AIDE "MEMOIRE, desire to apply the general

·terms and conditions of said AIDE MEMOIRE to the debt 01.\fing under·

triis Loan Ag.r.eeme.nt,

as

amended;

\ifHEREAS, in accqrdance with the terms of said Loan Agreerne11t

and said AIDE IYIEMOIRE, the Consolidated Amount of payrnents of principal

and interest totals

$2,886,777.40

as set forth in Annexes A and B

attached here·t();

It is therefore agreed that the debt owing by the Borrower under

this Loan _f\.gr.e.e.ment, as amended, including both the debt in arrears

or due between J11ly 1,

1966

and De.cember

31, 1967

and the balance

due thereafter, shall be repaid in accordance with the terms and

conditions of said AIDE :MEMOIRE, and based_ on

said terms·:

and conditions,

shall be repaid as set forth in the Revised Schedule of Payments for

this Loan as set forth in Annex A;

It is further agreed that to the extent not amended herein or in

the said AIDE MEMOIRE, the terms and conditions of the Loan Agreement

of October

28,

1948,

as amended on December

22,

1949,

and of the

Agreement between th.e Borrower, the Government of the Kingdom of the

1.952,

and the terms and conditions of tl1e promissory note

executed by the Borrower on February ll ₇

1952,

including in said note

terms and condi·tions governing prepayment and ､･ｦ｡ｵ ｾ ｬｴＮ＠ and accelerat ion,

shall remain in full force and effect;

It

is further agreed

that,

ir1 consideration of the undertakings

of the Bor·rower lierein, inc.1.uding its obligation to repay in accord.ance

with the Revised Schedule of Payments attached hereto and the terms

ancl conditior1s set forth in th.e preceding paragraph, upon execution

of this Amendatory Agreement, A.I.D. shall surrender to the Borrower

its pr·orr1issory no·te executed on February 11,

1952.
