Government of Australia and the Government of

Indonesia have reached the following

understandings concerning Phase I of the

development of a depot l evel maintenance facility

for TNI-AL Nomad airc ra ft at Juanda, Surabaya,

I ndonesia.

"Service", that is, to test, adjust, align and verify

t he serviceability of ccimponents within the various

Phase III. The deve l opment of a capability to

undertake "Total Repair" and 110verhaul11

maintenance action on particular items of equipment.

This Memora n d um o f Un derstanding , however, ref e r s on l y to Phase I of

t h e pro posal and does not commit Australian assistance for the

-2. Phase I of the proposal will requlre t h e provision of

extensive facilities (including adequate reticulated electricity ,

air and water, workshop equipment, specialized test equipment a nd

tools), as well as a training program f o r maintenance personnel

and the provision of advisory assistance.

Facilities and Equipment

Fpr its part the Government of Indonesia will ensure that:

a. suitable workshop facilities with the necessary

electrical, compressed air and water supplies as well

as workbenches and standard tools are provided;

b .• suitably qualified and trained personnel for エセセ@

management and continued operation of the facilities

・ウエ。「ャャウエゥセ ᄋM セ、・イ@ this Memorandum of Understanding

are provided;

c. all items of equipment supplied by the Government of

Australia are maintained to the standards necessary

for aircraft maintenance work; and

d. vehicles for the transport of equipment and personnel

associated with activities at Juanda are provided by

the Indone si an Navy.

The Government of Australia will provide, from Defence

Co-operation Program funds, specialised test equipment and

special-to-typ& t?ols and associated publications assessed as

necessary to develop Phase I of the facility. It will also arrange

installation of the test equipment and provide assistance t o the

Indonesia Navy in the organization and ini t i al operation of the

facility.

Quality Control

5. The Government of Australia will ensure that all parts,

equipment and other items it provides pursuant to this Memorandum

of Understanding are in accordance with appropriate commercial

s tandards .

Advisory Assistance

7. The Government of Australia will provide for the

continuation of a Contractor Advisory Team in Indonesia in

accordance with the conditions set out in Addendum 1 to this .

B. The Governme nt of Aus tralia will provide technical training

within Austral ia, to a level consistent with the requirements of

Phase I activities, for up to 18 Indone sian Naval personnel. It

will meet all costs, excluding salary, associated with this

training from Defence Co-operation Program funds.

Importation of Goods into Indonesia

9. In relation to parts, equipment and personal property

imported into Indonesia pursuant to this Memorandum of Understanding

the Government of Indonesia will

other charges associated with the importation into

Indonesia of all parts and equipment supplied

pursuant to this セ・ュッイ。ョ、オ ュ@ of Understanding;

b. allow duty free entry of personal property of

contractors and personnel of the Government of

Australia, including tools and equipment required

to implement this Memorandum of Understanding;

-d . ensure that all parts, equipment and personal property referred to in this paragraph are cleared for

collection an d delivered to Juanda within the shortest possible ti me of arrival in Indonesia, provided the Government of Australia fulfills its obligations under paragraph 10.

10. In relation to parts and equipment imported into Indonesia pursuant to this Mem orandum of Understanding the Government of

Australia will :

Re s ponsibility for Loss or Damage

14 . The Government of Indonesia will release and indemnify

the Government of Australia, its employees, agents, contractors

a n d s u b-contractors, from and against all liab i li t ies, cl a im s ,

damag es, losses costs and expenses (including but not limit e d to

t ho s e in respect of death of or injury to persons or lo s s of or

d a ma g e to property), arising out of the performance by the Government

of Australia of its obligations under this Me mor a n dum o f Unders ta n d i ng

which ma y accrue against or b e s uf f ered by the Go vern ment of

Australia, its employees, agents, contractors or s ub-contractors,

Understanding except to the extent authorized in writing by the

Gove rnment of Aust ralia.

20. Mutually · acceptable-amendments, · may be effected at any time

by an exchange of Notes between the p。イエゥ・セN@

2 1. In the event that either Party wishes to terminate this

Memorandum of Understanding the other Party will be notified in

writing and will be given reasons. If, following consultation

between the Parties either still wishes to terminate the Memorandum

of Understanding the termination will be effective ninety days after

the consultation has concluded.

2. Australia will meet all costs from Defence Co-operation Program funds for the further continuation of the Contractor Advisory Team up to 30 June 1984.

3. The team comprises a resident Project Manager and other skilledstaff and will be responsible for oversighting and assisting

in the i mplementation of Phase I of the development of a depot level maintenance facility at Juanda, Surabaya, for continuing advisory assistance on the operation of the supply and maintenance systems for the Indonesian Navy Nomad aircraft and for locaL training of Indonesian personne l · in their operation. Advice may be provided outsi de the framework of the Nomad project provided this will not in the opinion of the resident Project Manager adversely affect the pro j set.

-There will be at least two vehicles provided for the

personal use of the Contractor Advisory Team during their stay in

Indonesia or if the Indonesian Navy is not able to provide the two

' カ・ィゥ」ャセウ@ for personal use of the Contractor Advisory Team, Indonesia

will allow purchase by Australia out of Defence Cooperation Program

funds of locally assembled vehicles, in accordance with the

regulations for project assistance personnel in Indonesia.

7 • For the purpose of technical support the Contractor

Advisory . Team may be イ・ァセゥイ・、@ to proceed to locations outside

Surabaya.

All costs

B. The members of the Conlractor a、カゥウッセケ@ Team 。ョセ@ their

accompanying dependants will be afforded the following privileges

and facilities :

a. They will not be ウオ「ェセ」エ@ to the jurisdiction of the

Indonesian courts, and in the case of a transgression,

consultations will take place immediately between

Indonesia and Australia.

b. They will be exempt from Indonesian taxation or other

fiscal charges on the salary and allowances paid to

them by Australia.

c. They will be immune from immigration restrictions and

registration formalities for foreigners. Stay Permits

will be issued for the duration of ther-r assignment ·

and Multiple Exit/Re-entry Visas will be issued for

periods of twelvE{ : IT.fo rifhs.

d. They will be given the same repatriation facilities

in time of international crisis as are accorded to

diplomatic envoys.

-e. They will be exempt from import a n d export duties

storage charges and other fiscal charges on their

f urniture, household and personal effects.

Indonesian driving .licences will be provided to Contractor

Advisory Team members and accompanying dependants upon the

presentation of a current Australian Driving Licence.

10. The Contractor Advisory Team may be continued after 30 June

1984, with Australia meeting all costs from Defence Co-operation

Program funds, if mutual ly arranged in writing by 「ッエセ@ parties.
