GENERAL

AIJI'IDRITIES

OORATION

1. THIS MEMORANOOM expresses the understandings of the Cbverrunent of the Reµililic of Indonesia and the Cbvemment of Australia oonceming the resp:>nsibilities and oontrihltions respectively of the tw:J Governments in re:Jard to implementation of a pJ'."0<3'ram of in-country oourses for staff

training officers in Indonesia (hereinafter ref erred

to as the Project) located in Indonesia which is intended to improve the perf o:rrnance of training staff in Indonesian Cbvernment de:partments and

agencies as further described and detailed in Annex 1 to this Merrorandum.

2. The Executing Autlx:>rities for this Project will be :

For the Indonesian Government : The National Institute of Mrninistration (IAN) •

For the Australian Cbvernment : The Australian Developnent Assistance Bureau of the Department of Foreign Affairs (ADAB).

The Australian Developnent Assistance B.lreau may naninate suitably qualified agents to urrlertake any part of its functions on its behalf.

3. This Merrorandum will take effect frcm the date of its signature and the Project will be deemed to have cx:mnenced fran that date.

-The Australian contril::ution to the Project and

all undertakings given herein will cease three years after the date of signature of this

Merrorandum or on such other date as may subsequently be arranged between the セ@ Governments.

4. Resp:>nsibility for developnent and direction of the Project will be vested in the Training Developnent Crnuuittee, whose chainnan will be

appointed by the Indonesian Goverrurent fran arrong the staff of IAN. Membership of the Ccmnittee will include the Senior Australian Adviser who is to be appointed by the Australian Government and agreed by the Indonesian Government, and the Project Manager who will be appointed by the Chainnan of LAN. Manbers of the Training Developnent Ccmnittee for the Indonesian side will be app:>inted by the Indone-sian Government. The Training Developnent Ccmnittee will meet not less than twice each year.

5. Functions of the Training Developnent Canmittee will include :

(a) formulating the program p:>licy and making final decisions on the details of the curricula for the courses outlined in Annex l;

(b) co-ordinating the diSp:>sition of peroonnel attached to the project;

(c) selection of participants for the ca.irses outlined in Annex l;

(d) :reviewing and rep:>rting on project progress to the セ@ Governments; and

(e) recx:mnen.ding to the セ@ Governments changes in the program, b.ldget and future developnent •

-6. overall resp::msibility for this Project will rest with the Government of Indonesia.

Resµ:>nsibility for day to day operation and direction of the Project will rest jointly with the Senior Australian Adviser and Project Manager as ootlined in Annex 3.

7 • The oontrihltions of the Indonesian and Australian Governments are detailed in Annex 2 and are estimated to value Rp. 97 million and A$. 608, 650 respectively. Disbursement of the Indonesian and Australian

Governments' contributions will be subject to the nonnal parliamentary approval of annual appropriat-ions.

8. An evaluation of progress of the Project may be made at times arranged between and mutually

oonvenient to, the Indonesian and Australian

Governments. SU ch an evaluation セオャ、@ be undertaken by a joint investigation team app::iinted by the セ@

Governments and independent of staff involvErl in

the Project.

9. For the p..lrp::>ses of this Project, the Indonesian Government will, in acooroance with its laws and regulations, facilitate the employment by the Australian Government or its agent of personnel as required for the Project and established between the セ@ Governments by :

(a) granting exemption frcm incane or other taxes on project salaries and allowances;

(b) granting exemption fran im:i;:ort and other duties on personal and h:Juseh::>ld effects

subject to their re-ex:i;:ortation after cx:mpletion of the a ssignment;

-(c) granting to Australian project personnel all rights and entitlanents accorde:i to the aid personnel of any other donor country; and

(d) expediting the issue of all doetnnentation require:i for the entry of, and perfonnance of w::>rk by, project personnel.

10. (a) The Indonesian Goverrnnent will, in accordance with existing laws and regulations either exempt f ran imp::>rt duties and other taxes or pay such duties on all goods supplie:i by

Australia for the Project as set out in Annex 2;

(b) The Indonesian Government will facilitate movement of project equipnent and supplies by providing appropriate custans and wharf age facilities in the p::>rt closest to the project site and will be resp:msible for the expeditious clearance and tranSp::>rt of such equipnnet and supplies to the site; and

(c) The Senior Australian Adviser in consultation with the Indonesian Project Manager shall exercise administrative control over such supplies for the duration of the Project.

11. The Indonesian GDvernment will be reSp::>nsible for dealing with any claims which may be brought by

third parties against Australia and its experts, agents or Australian personnel and will hold hannless Australia and its experts, agents and personnel in case of any claims or liabilities resulting fran operations under this Mercorandum. This provision will not relieve any person f ran

liability for any criminal, grossly negligent or fraudulent act.

-12. The Indonesian Government will arrange for any protection deaned necessary to ensure the safety of Australian personnel, project and personnel equipnent l::x:>th at the project location, in transit and on any other official representational activity in Indonesia. The Australian Government will take reasonable precautions to ensure that Australian personnel have due regard for local traditions and custans.

13. Pmy disµites arising out of the interpretation or irnplenentation of the Me.Irorandum shall be settled amicably by oonsultation or negotiation between the two Govemnents.

14. Arrerrlments to this Memorandum may be made at any time by an Exchange of letters between the two Govern:nents.

ANNEXES 1, 2 and 3 to this Marorandum fonn an integral part of it.

PIAN OF OPERATICN

The overall goal of the program is to improve the perfonnance of training staff in the civil service training agencies in Indonesia in order to strengthen their institutional long tenn capacity.

The_ primary objective, therefore, is to increase the skills and knowledge of training staff to provide for better planning, organisation, management and procedures as well as improve the training curricula and materials.

This objective will be achieved through the implenentation of a 3 year training program which will be based on the four nodules as outlined below.

Q.lalif ications and :Experience

The Adviser will have appropriate qualifications in the areas of education and p.lblic administration and have extensive experience in training and the management of training in the p.lblic sector.

IDcation

The Adviser will be danicilerl in Jakarta, rut sane travel to

other cities in Indonesia will be necessary. Off ice aa:mrodation will be providerl by the National Institute of Administration (LAN) or other

G:>verrunent Deparbnents or Agency. IDcal transp::>rtation will be providerl.

App?intment :

The Adviser will be ap:p::>interl initially for one year with the :p::>ssibility of extension to three years.

Cu ties

1. Plan, in conjunction with the Training Developnent Ccrrmittee and the Project Manager, a program of training activities for Managers, Training Officers and Trainers, involving approximately 100 weeks of training and other learning experiences.

2. 'lb organise in ronsultation with the Project Manager and in

asoociation with Indonesian staff, a program of training courses.

3. Conduct the training courses referrerl to arove with the assistance of smrt tenn specialists fran Australia and Indonesian staff.

4. Provide consulting services to Indonesian Government Departments and Agencies on Training Activities.

6. Prepare oourse materials required for the training program and
