IN DONE SIA DAN AUSTRALIA,
Sadar akan kepentingan untuk mempunyai garis batas yang tetap secara pol itis don fisik antara Indonesia don Papua New Guinea,
Menimbang perlunya ditetapkan secara lebih tepat, dalam hal-hal tertentu, garis batas darat di pulau Irion (New Guinea) sebagaimana tercantum dalam Pasal-pasal I, II, Ill don IV dari Konvensi antara lngge-ris don Nederland tertanggal enam belas bulan Mei tahun seribu delapan ratus sembilan puluh limo,
Memperhatikan langkah-langkah yang telah diambil semenjak itu berkenaan dengan penetapan garis-garis batas darat di pulau Irion (New Guinea),
Memperhatikan khususnya dengan penghargaan, hasil pekerjaan Survey Bersama oleh Pejabat Survey Indonesia don Australia (dalam Per-janjian ini disebut "Survey Bersama ") tentang survey garis batas di Pulau Irion (New Guinea) seperti yang telah diuraikan dalam laporan terakhir tertanggal duo belas Pebruari seribu sembilan ratus tujuh puluh,
Mengingat bahwa dalam Persetujuan antara Pemerintah Indonesia don Australia tertanggal delapan belas Mei seribu sembilan ratus tujuh pu-luh satu (d:ilam Perjanjian ini disebut "Persetujuan Dasar Laut 1971 ") ke-dua Pemerintah telah menunda untuk dibahas kemudian masalah gariS batas dasar lout antara titik 9° 241

Bujur Timur (titik Bl tertera pada peta terlampir pada Perjanjian ini don dalam peta "A" terlampir pada Persetujuan Dasar Laut 1971) don titik dimana garis batas darat antara Irion Barat don Territory Papua berpotongan de-ngan pantai Selatan pulau Irion (New Guinea),
Sebagai tetangga-tetangga baik don dalam semangat persahabatan serta kerjasama,
TELAH MENYETUJUI SEBA GAi BERi KUT:
PASAL 1
Garis batas antara Indonesia don Papua New Guinea di pulau Irion (New Guinea) ditetapkan secara lebih tepat sebagai berikut :

-(a) Disebelah Utara Garis batasnya adalah 141° Bujur Timur meng-aroh ke Selatan clari titik perpotongan meridian tersebut dengan garis air rendah rota-rota pada pantai Utara, yang terletak pada 2° 35' 37" Lintang Selatan, sampai pada titik perpotongan paling Utara dengan alur pelayaran (Thalweg) Sungai Fly don meridian itu dinyatakan terl etak sepanjang garis-garis geodetis yang bertu-rut-turut menghubungkan tanda-tanda MM1, MM2, MM3, MM4, MM5, MM6, MM7, MM8, MM9, MM10 yang telah ditempatkan oleh Survey Bersama dan tertera pada peta yang dilampirkan pada Perjanjian ini.
(b) Dari titik perpotongan yang paling Utara meridian 141° Bujur Timur dengan alur pelayaran (Thalweg) Sungai Fly (sekarang terletak pada 6° 191
24" Lintang Selatan) garis batas mengikuti alur pelayaran itu sampai pada titik perpotongan paling Selatan dengan meridian 141° 01' 1011
Bujur Timur (sekarang terletak pa-da 6° 53 1

Lintang Se Iatan).
(c) Dari titik tersebut terakhir garis batas adalah meridian 141° Ol 1 1011 Bujur Timur mengarah ke Selatan sampai titik 9° 08' 08" Lintang Selatan (Titik B3 tergambar pada peta terlampir pada Perjanjian ini) dan meridian tersebut dinyatakan terletak sepan-j ang garis-garis geodetis yang berturut-turut menghubungkan tanda-tanda MM11, MM121 MM13 dan MM14 yang telah ditempatkan oleh Survey Bersama dan dinyatakan pada peta yang dilampirkan pada Perjanjian ini.
PASAL 2
Pemerintah Indonesia dan Australia segera keadaan memungkinkan setelah mulai berlakunya Perjanjian ini, dan pada waktu yang disetujui bersama, mengusahakan pemotretan udara atau satelit terhadap bagian Su-ngai Fly sebagaimana disebut dalam Pasal l ayat b Perjanjian ini. Dike-mudian

pemotretan seperti itu terhadap bagian Sungai Fly tersebut di-usahakan secara berkala menurut jangka waktu yang disetujui bersama.PASAL 3
Didepan pantai Selatan pulau Irion (New Guinea) garis batas antara daerah dasar laut yang berbatasan dengan dan termasuk wilayah
Indonesia dan daerah yang berbatasan dengan dan termasuk wilayah Papua New Guinea adalah garis-garis lurus sebagaimana digambarkan pada peta yang dilampirkan pacla Perjanjian ini, dimulai pada titik 9° 241

30" Bujur Timur (Titik Bl) dan selanjutnya menghu-bungkan titik - titik yang dinyatakan dibawah ini dengan urutan sebagai be-rikut :

-82. Titik 9° 231 Lintang Selatan, 140° 521 Bujur Timur B3. Titik 9° 081 0811 Lintang Selatan, 141° 01 1 1011 Bujur Ti-mur tersebut dalam pasal 1 ayat c Perjanjian ini.PASAL 4
Titik B3 tersebut pada Pasal 1 ayat c don Pasal 3 Perjanjian in1 adalah letak kini dari pada titik perpotongan meridian 141° 01 1 1011 Bujur Timur dengan garis air rendah rota-rota pada pantai Selatan pulau Irion (New Guinea). Jika titik B3 tidak lagi merupakan titik perpotongan sedemikian maka garis batas darat tersebut dalam Pasal 1 ayat c don ga-ris batas dasar lout tersebut dalam Pasal 3 bertemu don berakhir dimana garis-garis I urus yang menghubungkan titik-titik MM14, B3 dan B2 seba-gaimana digambarkan pada peta terlampir pada Perjanjian ini memotong ga-ris air rendah rota-rota dipantai Se Iatan.
PASAL
5
Untuk maksud Perjanjian ini, dalam pengertian 11
dasar laut11 ter-masuk tanah dibawahnya, kecuali dimana hubungan kalimat menghendaki lain.
PASAL 6
Apabila terdapat suatu kumpulan tunggal dari cairan hidrokarbon atau gas alam, atau apabila terdapat suatu deposit mineral lainnya di
bawah dasar lout yang mel intas garis-garis tersebut dalam Perjanjian ini, don sebagian dari kumpulan a tau deposit yang terl etak di salah satu sisi dari garis tersebut seluruhnya atau sebagian dapat diambil dalam bentuk cairan dari sisi lain dari garis itu, maka kedua Pemerintah akan
berusa-ha untuk mencapai persetujuan tentang cara yang paling efektip untuk mengadakan eksploitasi dari kumpulan atau deposit itu dan tentang pem-bagian keuntungan yang adil dari eksploitasi tersebut.
PASAL

Didepan pantai Utara dan Selatan pulau Irion (New Guinea) garis-garis batas lateral, yang memisahkan lout-lout wilayah dan jalur perikanan ekslusip sepanjang lebarnya masing-masing, jatuh bersamaan de-ngan garis-garis batas yang disebut dalam Pasal 3 Perjanjian ini dan da-lam Pasal 4 Persetujuan Dasar Laut 1971.

-PASAL 8
1. Kapal-kapal atau kendaraan air lain, yang menurut hukum Papua
New Guinea diijinkan berlayar dibagian Sungai Bensbach yang mengalir dalam wilayah Papua New Guinea, untuk memasuki atau meninggalkan Su-ngai itu akan mempunyai hak lintas melalui perairan Indonesia yang
ber-dekatan.
2. Untuk memasuki muara Sungai Bensbach pejabat-pejabat Indonesia
don Papua New Guinea akan menjamin tetap terbukanya dan menandai alur-al ur yang mungkin diperl ukan untuk keselamatan pelayaran.
PASAL 9
l . Koordinat-koordinat dari titik-titik yang tercantum dalam Perjan-jian ini, adalah koordinat-koordinat geografis. Letak yang sebenarnya da
-ri setiap titik a tau ga-ris yang disebut dalam Perjan jian ini dan yang bel um ditetapkan, akan ditentukan dengan cara yang akan disetujui bersama oleh pejabat-pejabat yang berwenang dari Pemerintah Indonesia dan Australia.
2. Untuk maksud ayat 1 Pasal ini, pejabat-pejabat yang berwenang
adalah Ketua Badon Koordinasi Survey don Pemetaan Nasional Indonesia
atau setiap orang yang dikuasakannya don Director of National N\apping
Australia dan setiap orang yang dikuasakannya.
PASAL 10
Setiap persel isihan yang timbul antara Pemerintah Indonesia dan Pemerintah Australia mengenai penafsiran atau pelaksanaan Perjanjian int
akan disel esaikan secara damai sesuai dengan prosedur-prosedur yang dise-but dalam Pasal 33 Piagam Perserikatan Bangsa-Bangsa.
PASAL 11
1. Perjanjian ini akan disyahkan menurut ketentuan konstitusionil masing-masing negara, don akan mulai berlaku pada tanggal penukaran Piagam Pengesahannya.
2. Dimakl umi bahwa persetujuan House of Assembly of Papua New
Guinea atas Perjanjian ini harus diperoleh sebelum dilakukan ratifikasi Perjanjian ini oleh Australia.

INDONESIA AND AUSTRALIA,
Recognizing the desirability of having boundaries of political and physical permanence between Indonesia and Papua New Guinea,
Considering the desirability of demarcating more precisely in certain respects the land boundaries on the island of Irion (New Guinea) as described in Articles I, 11, 111 and IV of the Convention between Great Britain and the Netherlands dated the sixteenth day of May One thousand eight hundred and ninety-five,
Noting the steps taken since then in relation to the demarcation
of the land boundaries on the island of Irion (New Guinea),
Noting in particular, with appreciation, the work of the Joint Survey by the Indonesia and Austral ion Survey Authorities (in this Agree-ment called "the Joint Survey") in surveying boundaries on the island of Irion (New Guinea) as described in their final report dated the twelfth day of February One thousand nine hundred and seventy,

ARTICLE l
The boundary between Indonesia and Papua New Guinea on the
island of Irion (New Guinea) shal I be more precisely demarcated as fol lows:

-(a) In the north the boundary is the meridian of Longitude 141° East extending southwards from the point of the intersection of the meridian with the mean low water line on the northern coast, located at Latitude 2° 35' 3711 South, to the point of its most norther! y intersection with the waterway ( 11

the Fly River and that meridian shall be deemed to lie along the geodesic lines successively linking the markers MM11 MM21
MM3, MM4, MM5, MM6, MM7, MM8, MM9 and MM10
established by the Joint Survey and indicated on the chartannexed to this Agreement.
(b) From the point of the most norther I y intersection of the
meridian of Longitude 141° East with the waterway(11
thalweg11 ) of the Fly River (at present located at Latitude 6° 19' 2411
South) the boundary I ies along that waterway to the point of its most southerly intersection with the meridian of Longitude 141° 01' 10 11
East (at present located at Latitude 6° 53' 3311
South). (c) From the last-mentioned point the boundary is the meridian
of Longitude 141° 01' 1011
East extending southwards to the point of latitude 9° 08' 0811
South (Point 83 shown on the chart annexed to this Agreement) and that meridian shall be deemed to
lie along the geodesic lines successively linking the markers MM111
MM12, MM13 and MM14 established by the Joint Survey and indicated on the chart annexed to this Agreement.
ARTICLE 2
The Governments of Indonesia and Australia, as soon as practicable after the entry into force of this Agreement and at a time to be agreed
upon by them, shal I arrange for aerial or sate I I ite photography of that part
of the Fly River referred to in Article l(b) of this Agreement. Thereafter, such photography of that part of the Fly River shall be arranged
periodically at intervals to be agreed upon.
ARTICLE 3
Immediately off the southern coast of the island of Irion (New
Guinea), the boundary between the area of seabed that is adjacent to and appertains to Indonesia and the area that is adjacent to and appertains to
Papua New Guinea shal I be the straight I ines shown on the chart annexed to this Agreement commencing at the point of Latitude 9° 24' 30 11
South, Longitude 140° 49' 3011 East (Point Bl) and thence connecting the points
specified hereunder in the sequence so specified :

ARTICLE 4
The point 83 referred to in Articles l (c) and 3 of this
Agree-ment is the present location of the point of intersection of the meridian
of Longitude 141° Ol 1 1011 East with the mean low water line on the
southern coast of the island of Irion (New Guinea). If the point 83
ceases to be the point of such intersection the land boundary referred to
in Article l(c) and the seabed boundary referred to in Article 3 shall
meet and terminate at the point at which the straight lines connecting
the points MM14, B3 and B2 shown on the chart annexed to this
Agree-ment intersect the mean low water I ine on the southern coast.
ARTICLE 5
For the purpose of this Agreement 11seabed11 includes the subsoil
thereof, except where the context otherwise requires.
ARTICLE 6
If any single accumulation of liquid hydrocarbons or natural gas,
or if any other mineral deposit beneath the seabed, extends across any of
the seabed boundary Ii nes that are referred to in this Agreement, and the
part of such accumulation or deposit that is situated on one side of the
line is recoverable in fluid form wholly or in part from the other side of
the I ine, the Governments of Indonesia and Australia wil I seek to reach
agreement on the manner in which the accumulation or deposit shall be
most effectively exploited and on the equitable sharing of the benefits
arising from such exploitation.
ARTICLE 7
Off the northern and southern coasts of the island of Irion (New
Guinea) the lateral boundaries of the respective territorial seas and
exclusive fishing zones shal I so far as they extend coincide with the seabed boundary I ines referred to in Article 3 of this Agreement and in
Article 4 of the 1971 Seabed Agreement.

-ARTICLE 8
l. Vessels or other craft permitted by the laws of Papua New Guinea to navigate on that part of the Bensbach River flowing within Papua New Guinea shall for the purpose of entering or leaving the river have a right of passage through the adjacent Indonesian waters. 2. For the

ARTICLE 9
l. The co-ordinates of the points specified in this Agreement ore geographical co-ordinates. The actual location of any points or lines referred to in this Agreement which have not yet been determined shal I be determined by a method to be agreed upon by the competent authori-ties of the Government of Indonesia and the Government of Australia. 2. For the purpose of paragraph l of this Article the competent authorities shal I be the Chief of the Co-ordinating Body for National
Survey and Mapping (Ketua Badon Koordinasi Survey Dan Pemetaan
Nasional) of Indonesia and any person acting with his authority, and the Director of National Mapping of Australia and any person acting with his authority.
ARTICLE 10
Any dispute between the Governments of Indonesia and Australia arising out of the interpretation or implementation of this Agreement shall be settled peacefully in accordance with the procedures mentioned in Article 33 of the Charter of the United Nations.
ARTICLE 11
l. This Agreement is subject to ratification in accordance with the constitutional requirements of each country, and shal I enter into force on the day on which the Instruments of Ratification ore exchanged.
2. It is understood that the approval of the House of Assembly of Papua New Guinea to this Agreement shall be obtained before Australian ratification of the Agreement.
