PENGESAHAN PROTOKOL ANTARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH DJEPANG MENGENAI PENJELESAIAN PENAGIHAN-PENAGIHAN TERHADAP NERATJA-NERATJA DIDALAM CLEARING ACCOUNT-CLEARING ACCOUNT JANG LALU DAN ACCOUNT-ACCOUNT
LAIN JANG BERSANGKUTAN.
Mengingat bahwa antara Pemerintah Republik Indonesia don Pemerintah Djepang pada tanggal duapuluh Djanuari seribu sembilanratus limapuluh delapan di Djakarta telah disetudjui don telah ditanda-tangani oleh Wakil-Wakil Berkuasa Penuh dari Pemerintah Republik Indonesia don Pemerintah Djepang, sebuah Protokol mengenai penjelesaian Penagihan-Penagihan terhadap Neratja-Neratja didalam Clearing-Clearing-Account jong lalu don Account-Account lain jong bersangkutan antara Pemerintah Republik Indonesia don Pemerintah Djepang, berdasarkan atas keinginan untuk menjelesaikan penagihan-penagihan mengenai neratja-neratja pembajaran jong belum dilunaskan menurut Persetudjuan Pembajaran antara Republik Indonesia don Djepang jong ditanda-tangani di Djakarta pada tanggal tudjuh Agustus tohun seribu sembilanratus limapuluh duo, serta peraturan-peraturan tambahannja pada tanggal jong soma.
Protokol tersebut kata demi kata berbunji sebagai berikut:
PROTOKOL ANTARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH DJEPANG MENGENAI PENJELESAIAN PENAGIHAN-PENAGIHAN TERHADAP NERATJA-NERATJA DIDALAM CLEARING
ACCOUNT-CLEARING ACCOUNT JANG LALU DAN ACCOUNT-ACCOUNT LAIN JANG BERSANGKUTAN.
Pemerintah Republik Indonesia don Pemerintah Djepang,
Berhasrat untuk menjelesaikan penagihan-penagihan mengenai neratja-neratja pembajaran jong belum dilunaskan menurut Persetudjuan Pembajaran antara Republik Indonesia don Djepang jong ditanda-tangani di Djakarta pada tanggal 7 Agustus 1952, serta peraturan-peraturan tam-bahannja pada tanggal jong soma;
Menjetudjui sebagai berikut:
Pasal I.
Djumlah tuntutan Djepang terhadap Republik Indonesia jong merupakan neratja bersih dari seluruh neratja-neratja pembajaran pada 20 Djanuari 1957 didalam rekening-rekening jong disebut dalam Persetudjuan Pembajaran antara Republik Indonesia don Djepang jong ditanda-tangani di Djakarta pada tanggal 7 Agustus 1952; Protokol jong dilampirkan pada Persetudjuan Pembojaron, jong ditando-tangani di Djakarta pada tanggol 7 Agustus 1952, don Pertukaran Noto mengenoi penghopuson neratjo bersih dalam Old Account antara Ketua Delegosi Menteri Luar Negeri Republik Indonesia dalom Perundingon Dagong lndonesia-Djepang dengan Ketua Delegasi Djepong, (jong berlaku pada tonggal 7 Agustus 1952) ditetapkan berdjumlah seratus tudjuhpuluh enam djuto sembilonrotus tigobelasribu sembilonratus limapuluhdelapan Dollar /\merika Serikot don empatpuluhsotu sen ($ 176,913,958.4 l ).
Pasal II.
l. Djepang membatalkan penagihannja sedjumlah seratus tudjuhpuluh enam djuta sembilanratus tigabelasribu sembilanratus limapuluhdelapan Dollar Amerika Serikat don empat-puluhsatu sen ($ 176,913,958.4 l ), jong telah diperintji didalam Pasal diatas.
2. Sebagai akibot dari ketentuan-keten1uan diatas, semua penagihan Republik Indonesia don Djepang jong timbul dari rekening-rekening jong ditentukan didalam
Pasal Ill.
Protokol ini okon diratifisir, don berloku podo tonggal pertukoran alat-alat ratifikasi atau pada fonggal muloi berlokunjo Perdjondjian perdomoian antara Republik Indonesia don Djepang, mana antaro tonggol itu jong lebih achir.
Untuk menjoksikonnja, jong bertando-tangon dibawah ini, jong untuk moksud ini diberi kuasa penuh oleh Pemerintohnjo mosing-masing, teloh menando-tongoni Protokol ini.
DIBUAT dolom rangkop duo di Djakarta, pada hari keduapuluh bulan Djonuari tahun seribu sembilanratus limapuluh delapan.

RATIFICATION OF THE PROTOCOL BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND JAPAN ·RELATING TO SETTLEMENT OF THE CLAIMS WITH RESPECT
TO BA:LANCES IN THE FORMER CLEARING ACCOUNTS AND OTHER ACCOUNTS.
Whereas a Protocol between the Government of the Republic of Indonesia and the Government of Japan relating to settlement of the claims with respect to balances in the former clearing accounts and other accounts based upon the desire of settling the claims with respect to outstanding balances in accounts opened in accordance with the Payment Agreement
between the Republic of Indonesia and Japan signed in Djakarta on the seventh day of August one thousand nine hundred and fifty-two and the arrangements supplementary there to of the same date, was concluded and signed by the Plenipotentiaries of the Government of the Republic of Indonesia and the Government of Japan on the twentieth day of January one thousand nine hundred and fifty-eight, which Protocol is, word for word as follows :
PROTOCOL BETWEEN THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND THE GOVERNMENT OF JAPAN RELATING TO SETTLEMENT OF THE CLAIMS WITH RESPECT
TO BALANCES IN THE FORMER CLEARING ACCOUNTS AND OTHER ACCOUNTS.
The Government of the Republic of Indonesia and the Government of Japan.
Desiring to settle the claims with respect to the outstanding balances in the accounts opened in accordance with the Payments agreement between the Republic of Indonesia and Japan signed
at Djakarta on August 7, 1952, and the arrangements supplementary there to of the same date;
Have agreed as follows :
Article I
The amount of claims which Japan has against the Republic of Indonesia as the overall net balance of the balances as of January 20, 1958 in the accounts provided for in the Payments
Agreement between the Republic of Indonesia and Japan signed at Djakarta on August 7, 1952; the Protocol attached to the Payments Agreement, signed at Djakarta on August 7, 1952; and
the Exchange of Notes concerning the disposal of balance of Old Account effected on August 7,
1952 between the Minister for ForeJgn Affairs of the Republic of Indonesia and the Chief Delegate of Japan to the Trade Conference between Indonesia and Japan are confirmed to be one hundred and seventy-six million nine hundred and thirteen thousand nine hundred and fifty-eight United
States of Amerika dollars and forty-one cents ($ 176,913,958.41 ).
Article II
1. Japan waives its claims of one hundred and seventy-six million nine hundred and thirteen thousand nine hundred and fifty-eight United States of America dollars and forty-one
cents ($ 176,913,958.41 ), specified in the preceding Article.
2. As a result of the foregoing, all claims of the Republic of Indonesia and Japan arising
out of the accounts provided for in the agreements enumerated in the preceding Article are finally disposed of.
Article Ill
Thi~ Protocol shall be ratified. It shall come into force either on the date of exchange of the instruments of ratification or on the date the Treaty of Peace between the Republic of Indonesia

Protokol ini akan diratifisir, don berlaku pada tanggal pertukaran alat-alat ratifikasi atau pada 1anggal mulai berlakunja Perdjandiian perdamaian antara Republik Indonesia don Djepang, mono antara tanggal itu jong lebih achir.
Untuk menjaksikannja, jong bertanda-tangan dibawah ini, jong untuk maksud ini diberi kuasa penuh oleh Pemerintahnja masing-masing, telah menanda-tangani Protokol ini.
