WITH THE BLESSING OF ONE ALMIGHTY GOD

Considering: a. That in order to maintain continuity of pulp and paper
product industry export made from non-timber and
waste paper according Minister of Trade Regulation No.
64 / M / DAG / PER / 10/2012 on Export of Forest
Industry Products, as well as observing the letter of the
Director General of Foreign Trade No. 29 / DAGLU / SD
/ 1/2013 concerning the Exceptions of Pulp and Paper
Products Using Raw Materials Made From Non-Timber
from the Minister of Trade Regulation No. 64 / M / DAG
/ PER / 10/2012 and 124 / DAGLU / SD / 3/2013
concerning Exceptions of Pulp and Paper Products Made
of Raw Material from Waste / Recycled paper from the
Minister of Trade Regulation No. 64 / M / DAG / PER / DIRECTORATE GENERAL OF AGRO INDUSTRY Jendral Gatot Subroto Street Kav. 52-53 Jakarta 12950,

10/2012, it is needed to set a Procedure on Giving
Export Recommendation for Pulp and Paper Industry
Using Non-Timber and Waste Paper As Raw Material;
b. That it is necessary to stipulate the Regulation of the
Director General of Agriculture on the Procedure on
Giving Export Recommendation for Pulp and Paper
Industry Using Non-Timber and Waste Paper As Raw
Material;
In View Of: 1. Presidential Regulation No. 47 Year 2009 on the
Establishment and Organization of the State Ministries
as already amended by Presidential Regulation of the
Republic of Indonesia Number 91 Year 2011;
2. Presidential Regulation No. 24 Year 2010 concerning
Position, Duties and Functions of the State Ministries
and Organization Structure, Duties and Functions of
Echelon I of the State Ministries as already amended by
the Presidential Regulation of the Republic of Indonesia
Number 92 Year 2011;
3. Regulation of the Minister of Industry No. 105 / M-IND /
PER / 10/2010 on Organization and Work Procedure of
the Ministry of Industry;
4. Regulation of the Minister of Industry No. 55 / M-IND /
PER / 6/2011 about Public Services Unit of the Ministry
of Industry;
5. Regulation of the Minister of Industry No. 64 / M-IND /
PER / 7/2011 concerning the Types of Industries Under
the Development of the Directorate General and Agencies
within the Ministry of Industry.

DECIDED:
TO STIPULATE : REGULATION OF THE DIRECTOR GENERAL OF AGRO
INDUSTRY WITH REGARDS TO THE PROCEDURES ON
GIVING EXPORT RECOMMENDATION FOR PULP AND
PAPER INDUSTRY PRODUCTS USING NON-TIMBER AND
WASTE PAPER AS RAW MATERIAL.
Article 1
In this regulation the following means:
1. Company is the Company That Does the Export of Pulp and Paper Industry
Products.
2. Laboratory is the Testing Laboratory Which Has Been Accredited by KAN. 3. Director General is the Director General of Agriculture Ministry of Industry. 4. Director is the Director of Forest and Plantation Industry Products,
Directorate General of Agriculture Ministry of Industry.
Article 2
Pulp and paper products using non-timber and waste paper as contained in
the Appendix of this Director General Regulation.
Article 3
(1) Exporting company of pulp and paper industry products using non-timber
and waste paper shall have a recommendation letter signed by the
Director on behalf of the Director General.
(2) The recommendation referred to in paragraph (1) shall include, among
others, the amount, type and tariff heading / 10-digit HS code of pulp and
paper products, loading port and destination port.
Article 4
products using non-timber and waste paper as referred to in Article 3 is
submitted to the Director through the Public Service Unit (UP2) Centre
which is located on the 4th Floor of Ministry of Industry Building Gatot
Subroto Street Kav. 52-53 South Jakarta using the FM-I form and attach
the following documents together with it:
a. Copy of the business license in the field of industry issued by the competent authority;
b. Copy of Tax Identification Number (NPWP);
c. Copy of the Laboratory tests result that shows that the product to be exported are using non-timber and waste paper as raw material and
have it legalized by the testing Laboratory;
d. Reference letter on the responsibilities of the products in Indonesia. e. An affidavit letter using Rp 6000 stamp duty stating that the products
exported are using non-timber and waste paper as the raw material
and will be responsible if in the future these products are found not
made from non-timber and / or waste paper (attached in every exports
made), with accordance to the FM-III form.
(2) The application referred to in paragraph (1) shall include the export plan
that covers the amount, type of tariff heading / 10 digits HS codes, the
port of loading and port of destination in accordance with the form table of
FM-II and export plans table of goods in accordance with the model form
of FM -II A.
Article 5
(1) UP2 Centre checks the completeness of the application file and validate the file against the original document as referred to in Article 4.
(2) Once the document is complete, it is then submitted to the Director.
Article 6
(1) An application for recommendation as referred to in Article 5, if deemed
applicant company.
(2) Within a maximum period of 5 (five) working days, the Director shall issue:
a. Letters of recommendation on behalf of the Director-General addressed
to the Director General of Customs and Excise and forwarded to the
Director-General of Forestry Enterprises in accordance with the FM-I
model form and approval of pulp and paper industry export in
accordance with the FM-IA form containing among others the amount,
type and Post Tariff / 10 digits HS code, loading port and destination
port, once the petition is correct and completed;
b. Notification to correct and / or complete the application if there are
mistakes or shortcomings requirements; or
c. Letters of rejection if it does not meet the requirements
(3) If the applicant does not rectify and / or complete the requirements within
a maximum period of 5 (five) working days after being given a notice to
correct and / or complete the requirements referred to in paragraph (2) b,
the application shall be deemed withdrawn by the applicant.
Article 7
Letters of recommendation as referred to in Article 6 paragraph (2) letter a is
given to the needs of every 1 (one) year and can be extended if necessary.
Article 8
(1) Companies that have obtained a letter of recommendation from the
Director shall report on the realization of exports both in terms of realized
or not realized to the Director.
(2) The Director may reject theapplication for extension ofthe recommendation
letterfrom the companyreferred to in paragraph(1) if the export realization
report is found not valid and / or the type of goods that are exported are

(1) The form used in the implementation of this regulation, is as stated in the
Appendix of this Director General Regulation.
(2) The issuance of the recommendation process flow is as stated in the
Appendix of this Director General Regulation.
Article 10
This Regulation shall enter into force on the date specified.
