TO THE MINISTRY OF HOUSING

Pursuant to Article 36(4) of the Constitution of the State of Sarawak [G.N.S

163/63], and vested in the State Secretary by a delegation made under the Yang

di-Pertua Negeri (Delegation of Powers to Appoint Constituted and Designated Posts to the State Secretary) Notification, 1998 [Swk. L.N. 18/98], the State Secretary is pleased to appoint Puan Yusfida bt. Khalid to act as Permanent Secretary to the Ministry of Housing with effect from 14th day of September, 2009 to 11th day of October, 2009.

1. Arahan ini bolehlah dinamakan Arahan Tanah (Hak-Hak Adat Bumiputera) (No. 83) 2009 dan hendaklah mula berkuatkuasa pada 5 haribulan November 2009. 2. Kesemuanya kawasan tanah yang terletak di Sampadi, Lundu, yang dikenali sebagai Lot 323 Block 4 Sampadi Land District, yang mengandungi keseluruhan keluasan kira-kira 170.4 meter persegi, seperti yang digariskan dengan lebih khusus lagi dalam Pelan Cetakan Nombor KD/12/11-3/2/43 (2008) dan dipinggirkan dengan dakwat merah, adalah dikehendaki bagi suatu maksud awam, iaitu Proposed Siting & Detailed Plan For Sekolah Kebangsaan Sampadi, Lundu. Butir-butir selanjutnya berkenaan tanah itu boleh didapati dari pejabat Penguasa Tanah dan Survei, Bahagian Kuching, Kuching.

3. Oleh sebab tanah yang tersebut di atas dikehendaki oleh Kerajaan, maka Kerajaan kenalah mengambil alih tanah tersebut. Berikutan dengan itu, segala hak adat bumiputera ke atas tanah itu akan diambil alih oleh Kerajaan tertakluk kepada pembayaran pampasan di bawah seksyen 5(3) Kanun Tanah.

4. Mulai tarikh berkuatkuasanya Arahan ini, segala hak adat bumiputera ke atas tanah tersebut tidak lagi wujud dan tanah tersebut hendaklah kembali kepada Kerajaan bagi maksud awam yang tersebut di atas.

5. Barang siapa yang mempunyai apa-apa tuntutan yang sah mengikut hak adat bumiputera ke atas tanah tersebut atau mana-mana bahagian daripadanya dan yang hak mereka itu terjejas disebabkan Arahan ini hendaklah, dalam tempoh enam puluh (60) hari dari tarikh penyiaran arahan ini dalam sebuah akhbar yang beredar di Sarawak, mengemukakan tuntutannya, berserta bukti sebagai menyokong tuntutannya itu, kepada Penguasa, Jabatan Tanah dan Survey, Bahagian Kuching, Kuching dalam borang yang ditetapkan oleh Penguasa yang boleh didapati dari pejabatnya di Jabatan tersebut. All area of land situated at Kampung Sampadi, Lundu, known as Lot 323 Block 4 Sampadi Land District, containing altogether an aggregate area of approxi-mately 170.4 square metres, as more particularly delineated on the Plan, Print Number KD/12/11-3/2/42 (2008) and edged thereon in red, is required for Proposed Siting & Detailed Plan For Sekolah Kebangsaan Sampadi, Lundu. Further details regarding the land can be obtained from the office of the Superintendent of Lands and Surveys, Kuching Division, Kuching.

3. As the aforesaid land is required by the Government, the Government has to acquire it. In consequence thereof, all native customary rights over such land shall be taken over by the Government subject to the payment of compensation under section 5(3) of the Land Code.

4. As from the date of coming into force of this Direction, all native customary rights over the said land shall cease to subsist and the said land shall revert back to the Government for the aforesaid public purpose.

5. Any person having any lawful claim to native customary rights over the said land or any part thereof and whose rights are affected by this Direction shall within sixty (60) days from the date of publication of this Direction in newspaper circulated in Sarawak, submit his claim, together with evidence in support thereof, to the Superintendent of Land and Survey Department, Kuching Division, Kuching in a form prescribed by the Superintendent and obtainable from his office in the said Department. Compensation will be paid to those claimants with proven native customary rights over the said land or any part thereof in accordance with the provisions of the Land Code.

Butir-butir selanjutnya berkenaan tanah itu boleh didapati dari pejabat Penguasa Tanah dan Survei, Bahagian Kuching, Kuching.

Setuan Drainage Scheme, Mukah. Further details regarding the land can be obtained from the office of the Superintendent of Lands and Surveys, Mukah Division, Mukah.

Compensation will be paid to those claimants with proven native customary rights over the said land or any part thereof in accordance with the provisions of the Land Code.
