Pasal 1

TUJUAN

Tujuan Memorandum Saling Pengertian (MSP) ini adalah untuk menyediakan suatu kerangka kerja bagi Para Pihak dalam rangka meningkatkan dan memperluas suatu kerjasama yang saling efektif dan menguntungkan dalam pembangunan kedua provinsi.

Pasal2

RUANG LINGKUP KERJASAMA

Para pihak akan melaksanakan MSP ini pada bidang-bidang sebagai berikut : 1. Ekonomi

2. Perdagangan 3. Pendidikan 4. Budaya 5. Pariwisata

6. Bidang lain yang disetujui para pihak

Pasal3

PELAKSANAAN

Untuk memfasilitasi pelaksanaan MSP ini, Para Pihak dapat membuat pengaturan yang mencakup bidang-bidang sebagaimana pada pasal2

Pasal4

KEIKUTSERTAAN PIHAK KETIGA

Jika dianggap perlu, Para Pihak dapat melibatkan Pihak Keti~a untuk melaksanakan MSP ini sesuai dengan hukum dan peraturan perundang-undangan yang berlaku di masing-masing negara.

Pasal5

PENDANAAN

Pelaksanaan kegiatan di bawah MSP ini tergantung kepada ketersediaan dana dan personil dari Para Pihak

Pasal6

HAK KEKAYAAN INTELEKTUAL

1. Masing-masing Pihak harus melindungi, dalam wilayahnya, hak kekayaan intelektual Pihak lain sesuai dengan hukum nasional yang berlaku pada masing-masing Negara.

2. Bila pengaturan khusus, program atau proyek menghasilkan kekayaan intelektual, kekayaan tersebut harus dimiliki bersama, dan Para Pihak harus membuat pengaturan terpisah sesuai hukum dan peraturan peundang-undangan yang berlaku pada masing-masing Negara.

Pasal7

PENYELESAIAN SENGKETA

Segala sengketa atau perbedaan yang timbul dari interpretasi atau pelaksanaan MSP ini akan diatur melalui negosiasi dan konsultasi kedua belah Pihak

Pasal8

PERU BAHAN

1. MSP ini dapat diubah setiap saat dengan persetujuan tertulis dari Para Pihak.

2. Perubahan tersebut berlaku pada tanggal yang ditetapkan oleh Para

MASA BERLAKU, WAKTU, PENGHENnAN

1. MSP ini ber1aku efektif pacta tanggal penandatanganan.

2.

MSP

ini bertaku

selama

5

(lima) tahun, dan dapat diperpanjang melalui persetujuan tertulis antara Para Pihak untuk periode 5 (lima) tahun berikutnya.

3. Masing-masing Pihak

dapat

menghentikan MSP ini setiap

saat

dengan

mernberikan

pemberitahuan tertulis kepada Pihak lain minimal

(enam) bulan sebefumnya.

4.

Apabila MSP ini dihentikan, pengaturan atau program kegiatan yang sedang berjalan di bawah MSP ini tetap berlaku sampai selesainya

program

kegiatan tersebut, kecuali

apabila

disetujui lain oleh Para Pihak.

MEMORANDUM OF UNDERSTANDING BETWEEN

THE GOVERNMENT OF WEST SUMATERA PROVINCE OF

THE REPUBLIC OF INDONESIA AND

THE REGIONAL COUNCIL OF FES BOULMANE OF THE KINGDOM OF MAROCCO

SISTER PROVINCE COOPERATION

The Government of West Sumatera Province of the Republic of Indonesia and

the Regional Council of Fes Boulmane of the Kingdom of Marocco (hereinafter

referred to singularly as "the Party" and collectively a~ the Parties);

Desiring to promote friendship and mutual understanding as well as be-neficial

between the people and the governmental institutions of the Parties;

Recognizing the importance of principles of equality and mutual benefits;

Taking into account the Letter of Intents (Lol) between the Government of

West Sumatera Province, the Republic of Indonesia and the Regional Council

of Fes Boulmane, Kingdom of Marocco on the Cooperation of the Sister

Province on May 26th, 2014.

Pursuant to the prevailing laws and regulations of the respective countries;

Article 1 OBJECTIVES

The objectives of this Memorandum of Understanding (MoU) is to provide a

legal framework for the Parties in order to promote and expand an effective

and mutually beneficial cooperation in the development of both provinces.

Article 2

SCOPE OF COOPERATION

The Parties shall undertake to implement this MoU in the following fields:

1. Economic

2. Trade

3. Education

4. Culture

5. Tourism

6. Other fields mutually agreed by the Parties

Article 3

IMPLEMENTATION

To facilitate the implementation of this MoU, the Parties may conclude

arrangement which shall coverage the fields as provided in article 2.

Article 4

PARTICIPATION OF THE THIRD PARTY

If it is deemed necessary, the Parties may invite third party to implement this

MoU in accordance with the prevailing laws and regulations in their respective

Article 5 FUNDING

The implementation of the activities under this MoU is subject to the

availability of fund and personnel of the Parties.

Article 6

INTELECTUAL PROPERTY RIGHTS

1. Each Party shall protect, within its territory, intellectual property rights of

other party in accordance with thre national law in force in their respective

countries.

2. In case spesific arrangement, programs or project may results in

intellectual property, such property shall be jointly owned, and the Parties

shall conclude separate arrangement in accordance with their respective countries laws and regulations.

Article 7

SETTLEMENT OF DISPUTES

Any dispute or differences arising out of the interpretation or implementation of

this MoU will be arranged by negotiation and consultation in both Parties.

Article 8 AMENDMENT

1. This MoU may be amended at any time by mutual written consent of the

Parties.

2. Such amendment shall come into effect on such date as may be

ENTRY INTO FORCE. DURATION, AND TERMINAnON

1. This MoU shall be effective from the date of its signing.

2. This

MoU

shall be in

effect

for a period of 5 (five) years, and may be extended through mutual written consent between the Parties for another

period

of

5 (five)

years

3. Each Party may tenninate this MoU at any time by giving at least 6 (six)

months prior notice

to the

other Party.

4. Should this MoU be terminated, the arrangements or ongoing program and activities made under this MoU shall remain in

effect

untill their completion, unless agreed otherwise by the Parties.
