ABSTRAK
Dalam hal terjadi perceraian, Pasal 105 Kompilasi Hukum Islam menerangkan bahwa pemeliharaan anak yang belum mumayyiz atau belum berumur 12 tahun adalah hak asuh ibunya. Seseorang yang akan melaksanakan tugas hadhanah harus memenuhi syarat-syarat sesuai dengan dalil dalam kitab Kifayatun Akhyar II halaman 94. Kasus perceraian yang terjadi pada public figure Marshanda dan Ben Kasyafani dalam memperebutkan hak asuh atas Sienna, bahwa Marshanda menderita penyakit Bipolar Disorder sejak tahun 2009. Hal ini menyebabkan bahwa Marshanda tidak memenuhi syarat hadhanah yaitu berakal sehat, meskipun Marshanda telah dijamin oleh Pasal 105 KHI. Tujuan yang hendak dicapai dari penelitian ini adalah untuk mengetahui, mengkaji, dan menganalisis kualifikasi hukum dan penetapan hak asuh anak dari perceraian orang tua yang menderita Bipolar Disorder.
Metode yang digunakan dalam penelitian ini adalah yuridis normatif yang menekankan pada norma hukum sebagai alat untuk menyelesaikan permasalahan yang dihadapi. Spesifikasi penelitian ini adalah deskriptif analitis dengan menggambarkan permasalahan yang terjadi dalam perebutan hak asuh anak dari perceraian orang tua yang menderita Bipolar Disorder. Tahap penelitian dilakukan dengan cara kepustakaan dan studi lapangan, dan analisis data dilakukan secara yuridis kualitatif.

ABSTRACT
In order to divorce, Article 105 Compilation of Islamic Law explain that the maintenance of children who have not mumayyiz or the child who is not yet was 12 is the right of her mother. Someone who will undertake the task hadhanah must fill up the terms of in accordance with a postulatein the book of Kifayatun Akhyar II page 94. Divorce cases that occur on Public Figure, Marshanda and Ben Kasyafani in getting custody of Sienna, that Marshanda suffering from Bipolar Disorder since 2009. It means that Marshanda not qualified hadhanah which is dietetic, although Marshanda have been guaranteed by Article 105 of KHI. The purpose of this research is to determine, review, and analyze the legal qualifications and the determination of custody of the children from a divorce parents who suffer from Bipolar Disorder.
The methods used in this research is juridical normative which focuses on legal norms as a tool to resolve the problems. The specification of this research is descriptive analysis by describing the problem that occurred of custody of the children from a divorce parents who suffer from Bipolar Disorder. A research phase done by literature and field studies, and analysis of data conducted by qualitative juridical.
The result of this research show that: first, in the case decide the race for custody of children more appropriate use the act of child protection by judges than KHI, because the act of child protection holds the principle of the best interest of the child. Second, the determination of custody of the children from a divorce parents who suffer from Bipolar Disorder get into parents who are able to guarantee the rights of their children, in this case is Ben Kasyafani. it is accommodated in the act of child protection and based on the principle of the best interest of the child.
