Pemerintah Republik Indonesia dan Pemerintah Republik Rakyat China (untuk

sclanjutnya disebut para " Pihak''):

Merujuk kepada Persetujuan Perdagangan antara Pemerintah Rcpublik Rakyat

China dan Pemerintah Republik Indonesia yang ditandatangani pada tanggal 8

Agustus 1990 di Jakarta:

Mengingat Deklarasi Bersama antara Pemerintah Republik Rakyat China dan

Pemerintah Republik Indonesia mengenai Kemitraan Strategi s yang ditandatangani kedua Kepala negara pada 25 April 2005 di Jakarta ;

Mcmpertim bangkan Memorandum Sali ng Pengertian antara Pemerintah Republik

Rakyat China dan Pemerintah Rcpublik Indonesia mengenai Pembcntukan ｋｯｭｩ ｾ ｩ＠

Bersama mengenat ｋ･ｾｪ｡ｳ｡ｭ ｡＠ Ekonom i. Perdagangan dan Tcknik yJng

ditandatangani 17 November 1990 di Beiji ng;

Dengan mempertim bangkan kedekatan geografis. persamaan budaya.

komplementaritas kuc.t di bidang ekonomi dan potensi ｢｣ｾ｡ｲ＠ untuk mengembangkan

ke1:jasama ekonomi dan perdagangan an tara para Pihak:

Berkeinginan untuk mcmperluas dan memperdaiClm ｫｾｾｲｪ｡ ｳＸ ｭ｡＠ ekonom! dan

perdngangan an tara Republ ik Rakyat China Jan Rcpubl ik indonesia, untuk lebih

mtningkatkan tingkat ｫ･ｾｪ｡ｳ｡ｭ｡＠ dan ｬｬ ｬｾｩ ｵｫ＠ ml:mprornos;k:m p-.:rkembangan susiai

dan ekonom i ｭ｡ｳｩｮｧＭｭ｡ ｾ ［ｩｮｧＺ＠

P ASAL r

Dengan tujuan memanfaatkan secara penuh potensi pasar secara timbal balik dan mengembangkan perdagangan dan investasi bilateral. para Pihak harus mendorong komunitas-komunitas industri dan bisnis dari kedua negara untuk turut serta dalam pameran, misi dagang dan seminar yang diselcnggarakan oleh salah satu negara dan akan memberikan fasilitas yang diperlukan. Para Pihak akan mempertimbangkan secara positif untuk mempromosikan kebijakan-kcbijakan terkait perdagangan,

investasi. pariwisata dan ｫ･ｾｪ｡ｳ｡ｭ｡ Ｍｫ｣Ｑ ｪ｡ｳ｡ｭ｡＠ ekonomi lainnya yang saling

menguntungkan

PASAL II

Berdasarkan kesetaraan dan keuntungan bersama serta sejalan dengan peraturan-peraturan pasar, para Pihak harus secara aktif mendorong pengusaha-pengusaha kedua negara untuk memperluas volume perdagangan bilateral, menstabilkan dan mempromosikan perdagangan antara kedua negara dalam skala besar, produk elektronik dan mesin berat serta produk bernilai tinggi, meningkatkan kualitas dan tingkat perdagangan, dan terus menctorong kcmajuan pertumbuhan perdagangan yang mcndalam dan berkesinambungan antar kcdua Pihak.

PASAL III

Sejalan dengan ketaiig\a !tukum dan kebijakan di negara Pihak dan berdasarkan tingkat teknis, kemampuan peralatan manufaktur scrla pengalaman konstruksi kedua negara di sektor industri terkait, para Pihak sepakat untuk mendorong pengusaha-pengusaha untuk menjalankan kerjasama ekonomi dalam berbagai macam di bidang-bidang berikut:

I. Pertanian, termasuk pcrkebunan, pemrosesan dan pemasaran produk

pertanian, promosi bersama produk-produk pertanian, ｫ･ｾｪ｡ｳ｡ｭ｡＠ mesin

pertanian, kerjasama karantina.

2. lnfrastruktur tei·masuk pembangkit listrik, telekomunikasi, jalan raya, rei

kereta api, pclabuhan, jembatan. pe!abuhan darat, pelabuhan udara.

perscdiaan air, drainase dan konstruksi ｰｾｮ｡ｮｧ｡ｮ｡ｮ＠ air limbah.

3. Industri. termasuk kendaraan bennotor, industri kimia, konstruksi kapallaut,

semen, peralatan rumah tangga, mesin tekstil. manufaktur perabot/mebel,

industri bcsi baja, sutra mmi, ｫ･ ｲｾｪｩｮ｡ｮＮ＠ batu IT'ulia. penilaian standar dan

kesesuaian., kulit. kert:.1s dan bubur ｫ･ｲｴ｡ｾＮ＠ alas kak i dan industri makanan

dan ｫ･ｲｾｪ｡ｳ｡ｲｮ｡＠ pcningkatan kemampuan untuk sckolah :cknik dan kcjuruan

serta ｫｾﾷｲｪ｡ｳ｡ｭＳ＠ UKl\11.

4. Pcngembsngan sumber daya energi, perikamm dan ke:lautan, kdwuman, dan

mineral.

5. Area industri dan zona pros,.;s c:kspor lc.\/H>rt ｰｲｯ｣･ｳｳｩｲ･ｾ＠ ｾｯｮ･ＩＮ＠

6. Obat-obatan dan kesehatan.

7. Pariwisata. termasuk hubungan masyarakat dan promosi. pengembangan

produk.

8. Keamanan Produk.

9. Resolusi Perdagangan dan

I 0. Bidang-bidc.ng iainnya yang disepakati old1 ｾ｡ｲ｡＠ Pihak.

PASALIV

Meninclaklanjuti kesepakatan yang dicapai pada Sesi ke-9 Komisi Bersama

ｋ･ｾｪ｡ｳ｡ｭ｡＠ Ekonomi, Perdagangan dan Teknik antara Pemerintah Republik

Indonesia dan Pemerintalt Republik Rakyat China, para Pihak sepakat untuk

mcmbentuk Kelompok ｋ･ｾｪ｡＠ Resolusi Pcrdagangan ( H'orking Group on Trade

Resolution).

PASAL V

I. Para Pihak sepakat unluk memhentuk Kclompok Kerja Kerjasama Ekonomi

(Economic Cooperatwn TVorkinR Group ( .. ECWG'')) di dalam kerangka

Komisi Bersama ｋ･ｾｪ｡ｳ｡ｭ｡＠ Ekanomi. Perdagangan dan Teknik antara

Pemerintah Republik Indonesia dan Pemerintah Republik Rakyat ｃｨｩｮ｡ｾ＠

2. ECWG terdiri dari kementerian terkait kedua Pihak, memili!(i tanggung

jawab untuk menel iti metode kerjasarna dalam iJidang-bidang yang disebutkan dalam Pasal III Persetujuan ini, memberikan petunjuk bagi pengusi:1ha-pengusaha untuk mengidentifikasi dan melaksanakan

proyek-proyek prioritas sejalan dengan peraturan-peraturan pasar (market rules),

sesuai dengan peraturan perundang-undangan pemerintah yang berlaku di kedua Pihak serta memutuskan pola kerjasama yang terperinci krmasuk pengaturan pembiayaan dan teknik. Proyek-proyek kerjasama terinci tersebut akan dilaksanakan oleh perusahaan sesuai dengan

percturan-peraturan pasar tmarket rules) dan peraturan perundang-undangan yang

berlaku padi kedua Piha:c EC\VG akan bertemu secara berkala. Pertcrnuan pertama akan dilaksanakan dalam waktu yang tidak terlalu lama setclah penandatanganan Persetujuan ini untuk menyusun Program Pembar.gunan

lima tahun pe11ama Jalam bidang·-bidan t!, yang 1_{elnh discpakati dalam}

PASAI VI

Para Pihak sepakat untuk mendorong institusi kcuangan dan asuransi masing-masing pihak untuk memprioritaskan pembiayaan dan dukungan asuransi bagi proyek-proyek dalam bidang-bidang yang telah disebutkan dalam Pasal III Persetujuan ini.

PASAL VII

Sejalan dengan Persetujuan antara Pemerintah Republik Rakyat China dan Pemerintah Republik Indonesia tentang Promosi dan Perlindungan lnvestasi yang

ditandatangani di Jakarta pada tanggal 18 November 1994, para Pihak sepakat

untuk terus mendukung perusahaan dan pengusaha kedua negara untuk memperluas investasi dan kerjasama yang saling menguntungkan. dan untuk menyediakan sarana-prasarana yang diperlukan.

PASAL VIII

I. Para Pihak sepakat untuk memperkuat pertukaran dan kerjasama dalam

pengembangan sumber daya manusia pada bidang-bidang antara lain pelatihan pejabat pemerintah dan pegawai teknis profesional.

2. Tanpa prasangka terhadap hak-hak fasilitas dan kekebalan khusus yang ada,

semua pihak yang terlibat dalam kegiatan terkait Persetujuan ini harus menghonnati kemerdekaan politik, kebangsaan, dan integritas wilayah negara setempat. harus memiliki kewajiban untuk tidak mencampuri urusan dalam negeri negara setempat, dan menghindari kegiatan-kegiatan yang tidak sejalan dengan maksud dan tujuan Persetujuan ini.

3. lndividu atau kelompok yang memiliki hak fasilitas dan kekebalan khusus

dari suatu pe1:janj ian internasional a tau peiaturan dan perundang-undangan negara setcmpat harus menghormati peraturan dan perundang-undangan negara set em pat.

Having regard to the geographical contiguity, cultural similarity, strong

｣ｯｭｰｬ･ｭ｣ｮｴ｡ｲｩｴｩ･ｾ［＠ in economy and the great pokntial in development of bilateral

economic and trade cooperation between the Parties:

Desiring to expand and deepen economic and trade cooperation ｢･ｴｷｾ｣ｮ＠ China and

Indonesia. to furthe:- enhance the level of cooperation and to promotl' respective economic and social dev·eiopments:

Pursuant to the prcva i I ing laws and ｲ･ｧｵｬ｡ｴｩｯｮｾ［＠ of the rcspedivc countries.

ARTICLE I

With a view to fully utilizing reciprocal market potential and expanding bilateral trade and investment the Parties shall encourage industrial and business communities from both countries to participate in exhibitions, fairs and seminars held in each other's country and provide all necessary facilities thereof. The Parties shall positively consider promoting measures related to trade, investment. tourism and other mutually beneficial economic cooperation.

ARTICLE II

Based on equality and mutual benefit and in line with market rules, the Parties shall actively encourage enterprises from both countries to expand bilateral trade volume. stabilize and promote trade between the two countries in large commodities, large

machinery & electronic products as well as high value-added products. improve

trade quality and leveL and continue to push forward deepened and sustained growth oftrade between the two sides.

ARTICLE III

In compliance with legal and policy frameworks in each other's country and based on technical level. equipment manufacturing capability as well as construction experience of both countries in related industries. the Parties agree to encourage enterprises to carry out economic cooperation of various forms in the following fields:

I. Agriculture. including agricultura l plcmlation, processing and marketing of

agricultural products, joint promotion for agricultural products. agricuh:ural

machinery cooperation. quarantine cooperation.

2. Infrastructure including power station. telecommunication. high'.vay,

r?.ilway. harbor, ｢ｲｩ､ｧｲｾＬ＠ dryport, airport. water supply. drainage and waste

\Vater treatment constructions.

3. Industry, including automobile, chemical industry. ship building, cement,

household appliance, textile machinery, furniture manufacturing, steel industry, silk rami. craft. gemstone, standard and conformity assessment, leather, pulp and paper, footwear and food industry and cooperation of

cc.pacity building for technical and vocational school and S!VlE cooperation.

4. Development of e11crgy, fishery. forestry. and mineral resources.

6. Medical and health.

7. Tourism. including publicity and promotion, product development.

8. Product Safety.

9. Trade Resolution and

I 0. Other fields agreed by the Patties.

ARTICLE IV

Following up the consensus reached on the 91

h Session of The Joint Commission on

Economic. Trade. and Technical Cooperation between The Government of The Republic of Indonesia and The Government of The People's Republic of China, the Parties agree to establish the Working Group on Trade Resolution.

ARTICLE V

I. The Pm1ies agree to establish the Economic Cooperation Working Group

("EC\VG'') within the framework of Joint Commission on Economic, Trade and Technical Cooperation between the Government of the Republic of Indonesia and the Government ofthe People's Republic of China;

2. ECWG, consisting of rdevant ministries of both Parties. is responsible for

researching the cooperation method in the fields prescribed in Article Ill of this Agreement, guiding their respective enterprises to identify and to carry out the preferential projects in I ine with market rules. in accordance with the prevailing government laws and regulations of the respective Parties as well

as deciding the specific cooperation mode ｩｮ｣ｬｵ､ｩｮｾ＠ financing and technical

arrangements. The specific cooperation prqjects wi II be carried out by the

cnkrpr!scs in ascordance with ｴｾｵｵｫ･ｬ＠ regulations and the prevailing

government laws and regulat!c:ns of the ｐｾｳｰ･｣ｴｩｶ･＠ Parties. ECWC slt::.tll

meet reguiarly. Its first meeting shall be ｨｾｬ､＠ at the earliest ｰｯｳｳｩ｢ｬＺ Ｎｾ＠ time

after the signing; of th i:-: Agreement to drmv up the first five-ycm Development Program in the agreed areas under this Agreement.

ARTICLE VI

The Parties agree to encourage their respective financial and insurance institutions to give priority to financing and insurance support for those projects in

the above-mentioned fields as appear in Article III 0f this Agreement.

ARTICLE VII

ln compliance with the Agreement between the Govemment of the People's Republic of China and the Government of the Republic of Indonesia on the Reciprocal Encouragement and Protection of Investment signed in Jakarta on

November 18th I <)94. the Parties agree to continue encouraging enterprises of the

two countries to expand mutual investment and cooperation, and to provide all necessary facilities thereof.

ARTICLE VIII

I. The Parties agree to strengthen the exchange and cooperation in human

resource development in the areas such as training for government officials and professional technical personnel.

2. Without any prejudices to any applicable privilege and ｩｭｭｵｮｩｴｩｾｳＮ＠ all

persons engaged in activities related to this Agreement shall respect political independence, sovereignty, and territorial integrity of the host country, shall

have a duty not to interfere in internal affairs of the host country, and will

avoid any activities inconsistent with the purposes and objectives of this Agreement.

3. Persons who enjoy privileges and immunities provided by international

agreement or by relevant laws and regulations of the host country have the duty to respect the laws and regulations ofthe host country.

ARTiCLE IX

The Parties shali provide facilities including visa and security

ｰｾｲｳｯｮｮ･ｬＬ＠ and protect their legitimate rights and interests for the above-mentioned

economic and trade cooperation.

ARTICLE X

Any disputes ansmg out of the interpretation or implementation of this

Agreement shall he settled amicably by consultation or ｮｾｧｯｴｩ｡ｴｩｯｮ＠ ｢･ｴ｜ｶ｣Ｎｾｮ＠ the

Parties.

ARTICLE XI

This Agreement may be amended at any time by mutual written consent of

the Parties. ｾＮＮＬｵ｣ｩＱ＠ amendments shall enter into force on such date as may be

determined by the ?artics anJ shall form (ltl integral part to this Agreement.
