THE SUBMISSION OF APPLICATIONS FOR GROWTH QUOTAS (KPt) OF TEXTILE AND CLOTHING (TPT) FOR 2002 WITH DESTINATION COUNTRY :

Referring to the Decree of the Minister of Industry and Trade No. 02/MPP/Kep/1/2001, the following matters are provided :
1. The export quotas of Textile and Clothing (TPT) derived from Growth Quotas (KPt) which are destined for the United States, European Union, Turkey and Canada are distributed to Small-scale Businesses and Cooperatives (PKK) not later than the third week of February 2002.
2. Approved Exporters of Textile and Clothing which are Small-scale Businesses and Cooperatives (ETTPT-PKK) can submit applications for the allocation of KPt to the respective IPSKET as from October 1 to 31, 2001.
3. Companies allowed to submit applications for the allocation of KPt are companies according to the criteria stipulated in the Decree of the Minister of Industry and Trade No. 02/MPP/Kep/1/2001. The said criteria are as follows :
2) Being independent, not subsidiaries or branches of companies owned, controlled by or affiliated directly or indirectly to medium or large-scale companies;
3) Having industrial licenses (IUI or TDI) in accordance with what is mentioned in letters of approval of ETTPT and having the relevant IUI or TDI already valid for at least one year upon the submission of applications for KPt in 2002;
4) Never shifting part or all of KPt obtained previously;
5) Location of factories being in accordance with the licensing addresses owned and being mentioned in producer ETTPT;
6) Having applications for KPt in 2002 signed by owners of ETTPT, if names mentioned in letters of approval of ETTPT are different or having agreements with partners on matters such as the production field, business field and marketing field acknowledged by local provincial service in charge of the industry and trade, in the case of partnership;
7) People (executives/owners/personnel in charge) or business entities possessing more than one ETTPT can only obtain KPt for one ETTPT with NOKOKOM being issued previously.
4. ETTPT allowed to submit KPt-2002 are ETTPT having their letters of approval issued before September 30, 2001, viewed from the date of issuance of both new and renewed letters of approval of ETTPT. Therefore, ETTPT having their (new or renewed) letters of approval signed after September 30, 2001 are not entitled to submit applications for KPt-2002.
5. Applications for KPt are considered legitimate, if the application forms of Growth Quotas (SP-KPt) are completed in accordance with the enclosed attachment (Attachment 1) and the date in evidences of receipt is the same as the date of receipt of the applications by local IPSKET. The applications must be completed with copies of documents required in point 8 (eight) and submitted to local IPSKET.
6. The requested categories are maximally 5 (five) for the whole destination countries (USA, EU, Canada and Turkey) with the provision that the number of categories is 2 (two) at the maximum for every destination country. In the case of ETTPT-PKK applying for more than 2 (two) categories for every destination country, the categories of quotas to be allocated are stipulated by local IPSKET.
7. The submitted applications for KPt are processed if they are accompanied by the following documents :
a. deeds of establishment of companies/cooperatives (the latest deeds);
b. industrial business license (IUI) or industrial registry numbers (TDI);
c. decisions on recognition as ETTPT;
d. corporate profile as meant in Attachment 2;
e. payment forms of Income Tax on companies or cooperatives in the last year.
Post Offices.
1. Local IPSKET will select administratively and apply field inspection to every application for the allocation of KPt to ensure the truth of data/information mentioned in licensing documents of ETTPT being applicants with the field conditions including :
a) Administrative affairs :
1) deeds of establishment of companies/cooperatives (the latest deeds);
2) industrial business license (IUI) or industrial registry numbers (TDI);
3) decisions on recognition as ETTPT;
4) corporate profile as meant in Attachment 2;
5) payment forms of Income Tax on companies or cooperatives in the last year.
b) Field inspection :
1) to examine the truth of addresses of factories (one address only can be used for one ETTPT);
2) to examine the existence and feasibility of sewing machines used in the said addresses (the number of sewing machines is 15-150);
3) to examine the number of workers.
2. Results of selection of the respective IPSKET already fulfilling the requirements (already final) are conveyed to the Team for the Assessment of Feasibility of Small-scale Companies and Cooperatives (according to Attachment 3) with a copy being made available to the Director of the Export of Industrial Products not later than December 31, 2001, accompanied by copy of official reports on field inspection of ETTPT-PKK.
