UNTUK

PENGEMBANGAN PUSAT KELAUTAN DAN 1KLIM INDONESIA - TIONGKOK

Kementerian Kelautan dan Perikanan Republik Indonesia (selanjutnya disebut "KKP") dan Administrasi Kelautan Negara Republik Rakyat Tiongkok (selanjutnya disebut "AKN"), secara bersama disebut Para Pihak;

MENGJNGAT Deklarasi Bersama antara Republik Indonesia dan Republik Rakyat Tiongkok tentang Deklarasi Kemitraan Strategis yang ditandatangani pada tanggal 25 April 2005 dan Rencana Aksi untuk Pelaksanaan Deklarasi Bersama antara Republik Rakyat Tiongkok dan Republik Indonesia tentang Kemitraan Strategis yang ditandatangani pada tanggal 21 Januari 2010;

MERUJUK kepada Memorandum Saling Kesepahaman antara Kementerian Kelautan dan Perikanan Republik Indonesia dan Administrasi Kelautan Negara Republik Rakyat Tiongkok yang ditandatangani pada tanggal 10 November 2007 yang telah diamandemen dengan Protokol Perubahan Memorandum Saling Kesepahaman antara Kementerian Kelautan dan Perikanan Republik Indonesia dan Administrasi Kelautan Negara Republik Rakyat Tiongkok yang ditandatangani pada tanggal 29 April 201 1;

MEMPERTIMBANGKAN Pengaturan Pelaksana tentang Pembentukan Pusat Kelautan dan Iklim Indonesia-Tiongkok antara Badan Riset Kelautan dan Perikanan

Kementerian Kelautan dan Perikanan Republik Indonesia dan Institut Oseanografi Pertama Administrasi Kelautan Negara Republik Rakyat Tiongkok yang clitandatangani

pada tanggal 13 Mei 2009.

MEMPERTIMBANGKAN

Komunike Bersama antara Kementerian Kelautan dan Perikanan Republik Indonesia dan Kementerian Sains dan Teknologi Republik Rakyat Tiongkok (selanjutnya disebut dengan "MST") yang ditandatangani pada tanggal 27

September 201 O;

MEMPERHA TIKAN

Memorandum Saling Kesepahaman Kerja Sama Maritim antara Pemerintah Republik Indonesia dan Pemerintal1 Republik Ral(yat Tiongkok yang

ditandatangani pada tanggal 23 Maret 2012;

SESUAI DENGAN

ketentuan hukum dan peratw·an perundang-undangan yang berlaku di kedua nega.ra;

TELAH MENYEPAKATI

pengaturan sebagai berikut:

Pasal I

Definisi

1. Pusat Kela.utan dan Iklim Indonesia-Tiongkok (selanjutnya disebut dengan PKIIT)

adalal1 suatu pusat bersama yang be1tujuan untuk mendorong pengembangan dan ke1ja sama dalam bidang ilmu dan teknologi kelautan , memajukan penelitian ilmiah kelautan dan menyumbang terhadap perlindungan lingkungan laut serta penggunaan sumber daya kelautan secara berkelanjutan.

2. Rencana Kerja Pengembangan PKIIT 2011-2013 antara KKP dan AKN (selanjutnya

disebut dengan Rencana Kerja) adalah rencana ke1ja kegiatan kerja sama yang

disepakati oleh Para Pihak pada Seminar Ilmu Kelautan dan Perlindungan Lingkungan Indonesia-Tiongkok kelima yang dilaksanakan pada tanggal 15-16

Pasal II

Tujuan

1. Mengembangkan PKIIT sebagai institusi tingkat nasional dan menugaskan PKIIT

sebagai koordinator kegiatan kerja sama antara Para Pihak dalam bidang ilmu dan tek:nologi kelautan, memajukan penelitian ilmiah kelautan, perlindungan lingkungan laut serta penggunaan sumber daya kelautan secara berkelanjutan.

2. Kegiatan ke1ja sama untuk pengembangan PKIIT akan meliputi, namun tidak terbatas pada, rencana untuk:

a. membentuk stasiun-stasiun observasi kelautan bersama lainya;

b. mengembangkan fasilitas dan infrastruktur pcnunjang PKIIT termasuk sebuah

kapal riset;

c. mendorong konsep "Ekonomi Biru"; dan

d. mendorong program pertukaran pejabat dan peneliti.

3. Mendukung Komite Kerja Sama Maritim yang dibentuk dibawah Memorandum Saling Kesepahaman tentang Kerja Sama Maritim antara Pemerintah Republik Indonesia dan Pemerintah Republik Rakyat Tiongkok.

Pasal III

Rencana Kerja

1. Pelaksanaan Pasal II wajib dilaksanakan berdasarkan rencana kerja.

2. Rencana Ketja akan dilampirkan sebagai lampiran dan menjadi bagian yang tidak terpisahkan dari pengaturan ini.

PasalIV

Pengarahan

1. Para Pihak wajib membentuk Kornite Pengarah untuk mengarahkan pengembangan

PKIIT melalui pe11emuan tahunan Komite Pengarah.

2. Para Pihak wajib membahas kegiatan ke1ja sama untuk pengembangan PKIIT dalam pe11emuan tahunan Kelompok Kerja Bersama Indonesia-Tiongkok.

3. Perkembangan PKIIT wajib dilaporkan kepada Komite Teknis Kerja Sama Maritim (selanjutnya disebut KTM) yang dibentuk dibawah Memorandum Saling Kesepahaman Kerja Sama Maritim antara Pemerintah Republik Indonesia dan Pemerintah Republik Rakyat Tiongkok.

Pasal VI Keuangan

1. Pengembangan PKIIT berdasarkan Pengaturan ini wajib dilaksanakan berdasarkan ketersediaan dana Para Pihak.

2. Pengembangan PK.HT dapat mengunakan Dana Kerja Sama Maritim (selanjutnya disebut sebagai DKM) yang dibentuk dibawah Memorandum Saling Kesepahaman Kerja Sama Maritim antara Pemerintah Republik Indonesia dan Pemerintah Republik Tiongkok.

Pasal VII

Hak-Hak Kekayaan Intelektual

1 . Para Pihak menyetujui bahwa Kekayaan Intelektual yang timbul dari pelal(sanaan Memorandum Saling Kesepahaman ini akan dimiliki bersama dan:

a. Masing-masing Pihak wajib diizinkan untuk menggunakan Kekayaan Intelektual tersebut untuk tujuan pemeliharaan, adaptasi dan penyempurnaan Kekayaan Intelektual terkait;

b. Dalam hal Kekayaan Intelektual tersebut digunakan oleh salah satu Pihak dan/atau lembaga atas nama Para Pihak untuk tujuan komersial, Pihak yang lainnya harus mendapatkan bagian royalti yang adil;

c. Masing-masing pihak wajib bertanggung jawab atas setiap klaim yang dibuat oleh pihak ketiga mengenai kepemilikan dan legalitas dari penggunaan kekayaan intelektual, yang diajukan oleh Pihak tersebut diatas untuk pelaksanaan kegiatan-kegiatan kerjasama berdasarkan Memorandum Saling Kesepahaman ini.

2. Para Pihak akan saling menjamin bahwa Hak Atas Kekayaan Intelektual yang dibawa oleh salah satu Pihak ke dalam wilayah Pihak lainnya dalam rangka pelaksanaan setiap pengaturan proyek atau kegiatan bukan merupakan hasil pelanggaran hak yang sah dari pihak ketiga.

Pasal VIII

Sumber Daya Genetika dan Pengetahuan Tradisional

l. Para Pihak wajib mengakui pentingnya mendorong perlindungan efektif terhadap Surnber Daya Genetika dan Pengetahuan TradisionaJ (selanjutnya disebut sebagai "SDGPT') serta hak masing-masing Pihak untuk mencegah setiap penyelewengan dan penyaJahgunaan SDGPT yang dimilikinya.

2. Setiap akses dan penggunaan SDGPT dari masing-masing Pihak dalam pelaksanaan Pengaturan ini wajib memperoleh izin terlebih dahulu dari pihak berwenang di masing-masing Pihak ..

3. Apabila kegiatan ke1jasama dan/atau kolaborasi berdasarkan Pengaturan m1

menggunakan SDGPT untuk tujuan-tujuan komersial, masyarakat lokal terkait, melalui Pemerintahnya, wajib untuk mendapatkan pembagian keuntungan yang adil danseimbang. Pembagian keuntungan demikian didasarkan pada ketentuan yang disepakati bersama.

4. Para Pihak wajib mengambil langkah-langkah yang sesuai, efektif dan terukur untuk mengatasi situasi bagi pemegang SDGPT dalam hal dimana pembagian keuntungan yang adil dan seimbang sebagaimana ditetapkan pada ayat 3 tidak te1jadi.

Pasal IX Amandemen

Setiap amandemen terhadap Pengaturan ini hanya akan dibuat setelah tercapainya kesepakatan bersama melalui konsultasi dan dengan konfirmasi tertulis oleh salah satu pihak.

Pasal X

Penyelesaian Sengketa

Setiap sengketa yang mungkin te1jadi antara Para Pihak dalam pelaksanaan Pengaturan ini wajib diselesaikan secara damai melalui konsultasi.

Article XI

Mulai Berlaku, Masa Berlaku dan Pengakhiran

1. Pengaturan ini akan mulai berlalrupada saat penandatangan oleh kedua Pihak. Pengaturan ini akan tetap berlaku sampai 13 Mei 2013 dan akan diperbaharui berdasarkan kesepakatan Para Pihak.

2. Pengaturan ini dapat diakhiri masa berlakunya setiap saat oleh salah satu Pihak dengan memberikan pemberitahuan tertulis enam bulan sebelumnya kepada Pihak yang lain.

3. Para Pihak akan menyusun Rencana Kerja bagi setiap pembaharuan Pengaturan. 4. Pada saat Pengaturan ini berakhir, Para Pihak akan menentukan arah selanjutnya

dari semua kegiatan yang sedang berlangsung yang ditetapkan di bawah Pengaturan

ini, dengan persyaratan dan kondisi yang j elas.

SEBAGAI BUKTI, yang bertanda tangan telah menandatangani Pengaturan ini.

DITANDATANGANI di Beijingpada 2..3> ｾｲ･ＺＮｴ＠ 2012. , rangkap dua, dalam bahasa

Indonesia, Tiongkok dan Inggris semua

RENCANA KERJA 2011 - 2013 PENGEMBANGAN PUSAT KELAUTAN DAN IKLIM INDONESIA - TIONGKOK

ANTARA

I. Latar Belakang

DENG AN

ADMINISTRASI KELAUTAN NEGARA REPUBLIK RAKYAT TIONGKOK

Pusat Kelautan dan Iklim Indonesia - Tiongkok (selanjutnya disebut PKIIT) adalah pusat kerjasama yang didirikan oleh KKP-RI dan APN-RRT, untuk mendorong kerjasama dan

komunikasi kelautan mengacu pada Kesepakatan Bersama mengenai Ke1jasama Kelautan antara KKP-RI dengan APN-RRT yang ditandatangai di Jakarta pada tanggal 10 November 2007 dan Protokol Perubahan MoU yang ditandatangani di Jakarta pada tanggal 29 April

2011. PKIIT merupakan pusat penelitian dan pengembangan kelautan di bawah arahan KKP-RI dan APN-PRT, dengan penelitian di Samudera Hindia dan laut sekitarnya, dengan tugas utama sebagai berikut:

• Memfasilitasi penelitian bidang perubahan iklim dalam wadah kerjasama antara Indonesia dan Tiongkok;

• Mengkoordinasikan aktifitas kerjasama antara Indonesia - Tiongkok, melalui dan tidak terbatas pada stasiun kerjasama dalam pengamatan bersama, pelayaran penelitian bersama, dan lain-Iain.

• Mengkoordinasikan pertukaran kunjungan dan peningkatan kapasitas antara

Indonesia dan Tiongkok (workshop, program pelatihan, dll) untuk bidang terkait; • Membangun dan mengoperasikan stasiun pengamatan bersama (di Padang, dsb); • Menginisiasi dan menjadi pusat data dan informasi mengenai laut dan iklim

untuk Samudera Hindia dan Iaut sekitarnya.

II. Rencana Kerja 2011-2013

PKIIT mengembangkan rencana kerja untuk periode 2011 - 2013 sebagai berikut:

1. Membangun Sistem Pengamatan Bersama Laut. PKIIT menyelesaikan pembangunan dan menjalankan operasi stasiun Pengamatan Laut Padang dan Pulau Natuna, untuk dapat diadopsi dalam Rencana Aksi Nasional Indonesia terhadap Perubahan Iklim. Lima stasiun pengamatan kelautan lainnya, termasuk

stasiun percobaan pemantauan terumbukarang, akan dibangun di laut-laut Indonesia dan menjadi contoh bagi Indonesian Global Ocean Observing System

(INAGOOS). Tiga hingga lima bouy mooring akan dipasang bersama untuk pengamatan laut dan iklim di perairan sekitar Samudera Hindia.

2. Memfasilitasi Riset Bersama. PKIIT memfasilitasi peneliti-peneliti Indonesia dan Tiongkok dalam menyelenggarakan pelayaran dan penelitian bersama untuk kerjasama penelitian yang sedang berjalan seperti JUV, SITE, ROSE, dan MOMSEI.

3. Mendorong aktivitas kerjasama baru. PKIIT mendorong secara aktif penelitian-penelitian kerjasama baru antara peneliti-peneliti Indonesia dan Tiongkok serta

peran pusat-pusat penelitian perubahan iklim, pertukaran massa air melalui selat-selat, interaksi laut-atmosfer, pengembangan dan penerapan bioteknologi dan sumberdaya kelautan, ekosistem dan keragaman hayati laut tropis, pertukaran karbon dan paleo-klimat laut di daerah tropis, geologi laut, perlindungan

lingkungan laut dan pengelolaan kawasan pesisir terpadu, pengetahuan laut dalam dan kutub, dsb.

4. Mendorong Pusat Informasi Laut Regional. PKIIT melanjutkan pembangunan dan operasi pusat data dan informasi kelautan dan iklim Samudera I-Iindia, Samudera Pasifik dan laut-laut sekitarnya, menjadikan pusat informasi dengan reputasi global dan mempersiapkan dukungan teknis dengan data dan produk

penelitian perubahan iklim di Indonesia, Tiongkok dan wi !ayah Samudera Hindia serta dunia.

5. Memjasilitasi workshop bersama dan penyebaran informasi lainnya. PKIIT menfasilitasi pemerintah Indonesia dan Tiongkok dalam penyelenggaran

workshop secara regular mengenai ilmu dan teknologi kelautan dan perlindungan lingkungan, menyelenggarakan dan mempersiapkan proyek kerjasama kelautan. Forum-forum bukan regular dan pe1temuan konsultasi para peneliti dan pusat penelitian akan diselenggarakan untuk membahas skup dan detil ke1jasama

6. Pertukaran peneliti dan pegawai. PKIIT melanjutkan mendorong peningkatan kapasitas bidang kelautan dan perubahan iklim di Indonesia dan Tiongkok, mengembangkan pertukaran personil dan pelatihan bagi para peneliti, teknisi, manajer, dan pegawai pemerintah, dan setiap tahun akan mengorganisir sepuluh atau lebih peneliti muda untuk hadir dalam berbagai pelatihan.

7. Peningkatan Kapasitas. PKIIT meningkatkan kapasitas terkait sarana perkantoran, sumber daya manusia se1ta pengelolaan keuangan. PKIIT

melanjutkan peningkatan kapasitas penelitian melalui pengoperasian bersama Kapa! Riset, dan pengiriman peneliti dan pakar secara regular. PKIIT mengambil

langkah untuk berkomunikasi dengan pihak luar dan pengembangan diri memajukan komunikasi dengan pusat-pusat penelitian yang relevan di Indonesia,

Tiongkok dan di regional, memelihara serta meningkatan secara kontinu laman PKIIT, dan menyebarkan informasi melalui media mengenai penelitian dan kegiatan-kegiatannya. PKIIT juga men ingkatkan juga akan menarik perhatian dan

dukungan lebih dari pemerintah Indonesia dan Tiongkok, dan berupaya untuk mengidentifikasi sumber-sumber pendanaan.

Ill. Pendekatan Pelaksanaan Rencana Kerja

Rencana Ketja dilaksanakan melalui Pertemuan Komisi Bersama Indonesia-Tiongkok mengenai ke1jasama dalam bidang kelautan, setelah disetujui oleh KKP dan AKN.

Operasionalisas i aktivitas pada rencana ke1ja ini perlu d itandatangani oleh kedua belah pihak melalui Pengaturan Pelaksanaan.

L KKP, AKN, dan MST akan mendorong keterl i.batan kementerian terkait, institusi, dan universitas di Republik Indonesia dan RRT, dikoordinasi oleh KKP dan AKN.

2. KKP dan AKN mendorong ke1jasama yang bermanfaat yang setara dan saling

menguntungkan antar kementerian, institusi dan universitas di Republik Indonesia dan Republik Rakyat Tiongkok.

3. KKP dan AKN akan merencanakan dan meninjau aktivitas kerjasama dan melalui Pertemuan Komisi Bersama Tiongkok-lndonesia mengenai Kerjasama Bidang Kelautan.

4. KKP, AKN, dan MST akan memberikan pertimbangan prioritas pada ketersediaan dukungan pendanaan untuk kegiatan-kegiatan tersebut.

ARRANGEMENT BETWEEN

THE MINISTRY OF MARINE AFFAIRS AND FISHERIES OF THE REPUBLIC OF INDONESIA

AND

THE STATE OCEANIC ADMINISTRATION OF THE PEOPLE'S REPUBLIC OF CHINA

ON

THE DEVELOPMENT OF THE INDONESIA-CIDNA CENTER FOR OCEAN AND CLIMATE

The

Ministry

of Marine Affairs and Fisheries of the Republic of Indonesia

(hereinafter referred to as "MMAF,,) and the State Oceanic Administration of the People's Republic of China (hereinafter referred to as "SOA"), collectively referred to as the "Parties";

RECALLING the Joint Declaration between the Republic of Indonesia and the

People's Republic of China on Strategic Partnership Declaration, signed on 25tb April

2005 and the Plan of Action for the Implementation of the Joint Declaration between the People's Republic of China and the Republic of Indonesia on Strategic Partnership,

signed on 2151 January 2010;

REFERRING to the Memorandum of Understanding on Marine Cooperation between the State Oceanic Administration of the People's Republic of China and the Ministry of

Marine Affairs and Fisheries of the Republic of Indonesia, signed on I 0111 _November

TAK.ING INTO ACCOUNT the Implementing Arrangement on Establishment of Indonesia-China Center for Ocean and Climate between The Agency for Marine and Fisheries Research of the Ministry of Marine Affairs and Fisheries of the Republic of Indonesia and the First Institute Oceanography of the State Oceanic Administration of the People's Republic of China signed on 13th May 2009.

CONSIDERING the Joint Communique between the Ministry of Marine Affairs and Fisheries of the Republic of Indonesia and Ministry of Science and Technology of the People's Republic of China (hereinafter referred to as "MOST"), signed on 27th

September 2010;

NOTING the Memorandum of Understanding on Maritime Cooperation between the Government of the Republic of Indonesia and the Government of the People's Republic of China, signed on 23rd March 2012;

PURSUANT to the prevailing laws and regulations of the respective Countries;

HA VE AGREED to the following arrangement:

Article I Definition

1. Indonesia-China Center for Ocean and Climate (hereinafter referred to as "ICCOC") is a joint center with the purpose of promoting development and cooperation on marine science and technology, advancing marine scientific research and contributing to the protection of maifoe environment as well as the sustainable use of marine resources.

2. Work Plan 2011-2013 of the Development Plan of ICCOC between MMAF and SOA (hereinafter referred to as "Work Plan'') is a cooperative activities work plan agreed by the Parties in the Fifth Indonesia - China Workshop On Marine Science and Environmental Protection conducted on 15 - 16 December 2011 in Xiamen.

Article II Objectives

1. Developing the Indonesia-China Center for Ocean and Climate (ICCOC) as a national level institute and assigning ICCOC as the coordinator for the cooperative activities between the Parties on marine science and technology, advancing marine scientific research, protection of marine environment as well as the sustainable use of marine resources .

2. The cooperative activities for the development of ICCOC will include, but not limited to, the plan to:

a. establishing other joint stations for ocean observation;

b. developing infrastructure and facilities including a research vessel to support the ICCOC;

c. promoting the concept of 'Blue Economy'; and

d. promoting the exchange of officials and scientists program.

3. Supporting the Maritime Cooperation Committee established under the Memorandum of Understanding on Maritime Cooperation between the Government of the Republic oflndonesia and the Government of the People's Republic of China.

Article III

Work Plan

1. The implementation of Article II shall be done according to the Work Plan.

2. The Work Plan shall be attached as Annex and becomes an integral part of this arrangement.

Article IV

Direction

1. The Parties shall establish a Steering Committee meeting to direct the developments of the ICCOC jointly through annual Steering Committee Meeting.

2. The Parties shall discuss the cooperative activities for the developments of the JCCOC in the annual meeting oflndonesia-China Joint Working Group.

Memorandum of Understanding on Maritime Cooperation between the Government of the Republic of Indonesia and the Government of the People's Republic of China.

Article V

Finance

1. The developments of ICCOC under this anangement shall be subjected to the availability of funds by the Parties.

2. The developments of ICCOC may use the Maritime Cooperation Fund (hereinafter refened to as "MCF") established under the Memorandum of Understanding on Maritime Cooperation between the Government of the Republic of Indonesia and the Government of the People's Republic of China.

Article VI

Intellectual Property Rights

1. The Parties agree that intellectual property arising under the implementation of this

Memorandum of Understanding will be jointly owned and:

a. Each Party shall be allowed to use such intellectual property for the purpose of maintaining, adapting and improving the relevant intellectual property; b. In the event the intellectual property is used by either Party and/or institution

on behalf of the Parties for commercial purposes, the other Pruty is entitled to obtain royalty;

c. Each Party shall be liable for any claim made by any third party on the ownership and legality of the use of the intellectual property, which is brought in by the aforementioned Party for the implementation of the cooperation activities under this Memorandum of Understanding.

2. The Parties shall indemnify each other that the intellectual property rights brought by the Party into the territory of the other Party for the implementation of any project arrangements or activities is not resulted from any infringement of third Party's legitimate rights.

3. Whenever either Party requires the cooperation of another Party outside the Republic of Indonesia and the People's Republic of China for any commercial undertaking resulted from intellectual property covered by this Anangement, this Party will give preference of cooperation to the other Party under this

Anangement, which will be waived, if the other Party is unable to participate mutually in a beneficiary manner.

Article Vil

Genetic Resources and Traditional Knowledge

t. The Parties shall recognize the importance of promoting the effective protection of

Genetic Resources and Traditional Knowledge (hereinafter referred to as "GRTK") as well as each Parties' right to prevent any misappropriation and misuse of its GRTI(.

2. Any access to and use of GRTK of the respective Party under the implementation of this Memorandum of Understanding shall require prior consent from relevant authorities of the Party.

3. When the cooperative and I or collaborative activities under this Memorandum of

Understanding utilize GRTK for commercial purposes, the local communities concerned through their Government shall be entitled to receive fair and equitable benefit sharing. Such sharing shall be upon mutually agreed terms.

4. The Parties shall take appropriate, effective and proportionate measures to address

situations

for

holders

of GRTK in

cases where the fair

and

equitable

sharing of benefits as provided for in paragraph 3 has not occurred.

Article VIII Amendment

Any amendment to this Arrangement shall only be made after mutual consent achieved by consultation and with written confirmation by either Party.

Article IX Settlement of Disputes

Any dispute that may occur between the Parties in implementing this Arrangement shall

Entry into Force, Duration and Termination

1. The arrangement will come into force upon signature by both Parties. It will

remain in force until 13th May 2013 and will be renewed upon agreement by the

Parties.

2. The arrangement could be ｴ ･ｲｭｩｮｾｴ･､＠ at any time by either Party by giving a

six-month written notification to the other Party.

3. The parties will establish Work Plan for each renewal of the anangement.

4. Upon the termination of this arrangement, the Parties will determine the further

course of all ongoing activities concluded under this arrangement in clearly

defined terms and conditions.

English languages, all texts being equally authentic. In case ·of divergence in

Annex

Work Plan 2011-2013 of the Development oflndonesia-China Center for Ocean and Climate

between

The Ministry of Marine Affairs and Fisheries of the Republic of Indonesia and

The State Oceanic Administration of the People's Republic of China

I. Background

Indonesia-China Center for Ocean and Climate (hereinafter as ICCOC) is a cooperation unit jointly founded by State Oceanic Administration of the People's Republic of China (SO A-PRC), and the Ministry of Marine Affairs and Fisheries of the Republic of Indonesia (MMAF-RI), to promote marine cooperation and communication between China and Indonesia, according to the Memorandum of Understanding (MoU) on Marine Cooperation between MMAF-RI and SO A-PRC signed in Jakatta on 10th November 2007 and the Protocol Amending the MoU sign in Jakarta on 29th April 2011. ICCOC is a marine research and development institute directed by SOA-PRC and MMAF-RI. ICCOC focuses on researches in the Indian Ocean and adjacent seas, with main tasks as:

• To serve as the platform of cooperation between China and Indonesia in the field

of ocean and climate change;

• To coordinate the Indonesia-China collaborative activities, through but not

limited to joint observation stations, joint cruises, etc.

• To coordinate the exchanging visits and capacity building between Indonesia and

China Uoint workshops, training programs, etc) for pe1tinent fields;

• To build and operationally run the joint ocean observation stations (in Padang,

etc);

• To initiate and host the data hub and information center on ocean and climate for

the Indian Ocean and adjacent seas.

II. Work Plan 2011-2013

Change. Another 5 (five) more joint marine observation stations, including the demonstrative monitoring of coral reefs, will be constructed in Indonesian seas and become demos of the Indonesian Global Ocean Observing System (INAGOOS). 3 (three) to 5 (five) more surface/submarine mooring buoys will be jointly installed for ocean and climate observation in the seas adjacent to the

Indian Ocean.

2. To facilitate Joint Research. ICCOC will facilitate the Chinese and Indonesian scientists in conducting joint cruises and researches for the ongoing cooperative

projects such as

SITE, ROSE and MOMSEl.

3. To promote new cooperative activities. ICCOC shall actively promote new cooperative studies between Chinese and Indonesian scientists and research institutes on the ocean's role in climate change, water exchanges of strait passages, sea-atmosphere interactions, marine biotechnology and resources development and application, tropical marine ecosystems and biodiversity, marine carbon cycling and paleo-climate in the tropics, marine geology, marine environment protection and integrated coastal zone management, deep ocean and polar marine science, and etc.

4. To promote Regional Marine Information Center. ICCOC wi ll continuously construct and operate the marine and climate data hub and information center for the Indian Ocean, Pacific Oceru:i and adjacent seas, rendering it an information center with global reputation and providing technical supports with data and products to climate change studies in China, Indonesia, the Indian Ocean region and the world.

5. To facilitate Joint Workshop and other outreach. ICCOC will continue to assist China and Indonesia governments with the regular joint workshop of marine science and technology and environmental protection, to organize and prepare marine cooperation projects. Irregular forums and consultation meetings of scientists and research institutes will be organized to discuss cooperative research scopes and details and to review and assess research results.

6. Scientific and Official Exchange. ICCOC wi ll continuously promote capacity building in China and Indonesia for marine and climate change, develop personnel exchange and training of scientists, technicians, managers and governmental officials, and every year will organize ten or more young marine scientists to attend training courses.

7. Capacity Building. ICCOC will also improve its office facilities and personnel and financial management specifications. ICCOC will continue to improve

research capacity with jointly operation Research Vessel, and dispatched regular researchers and invited scholars. ICCOC shall take steps to communicate with outside and propagate itself, enhance the commun ication with relevant research institutes in China, Indonesia and in the region, continuously maintain and

improve the web pages of ICCOC, and press and release newsletters of research and working.

ID. Work Plan Implementation Approach

The implementation of activities in this Work Plan shall be approved by the Joint Working Group, authorized by MMAF-Rl and SOA-PRC through Implementation Arrangements and implemented through the Steering Committee of ICCOC. The implementation and outcome of t he activities shall be reviewed by the Joint Working Group.

I. MMAF-Rl, SOA-PRC and Ministry of Science and Technology of the People's

Republic of China (MOST-PRC) will encourage the involvement of the related ministries, institutions, and universities in the Republic of Indonesia and the People's Republic of China, coordinated by MMAF-Rl and SO A-PRC;

2. MMAF-RJ and SOA-PRC encourage equal and mutually beneficial cooperation between ministries, institutions and universities in the Republic of Indonesia and the People's Republic of China;
